HomeMy WebLinkAbout03/11/2014 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING MARCH 11, 2014 The regular meeting of the Fairfax City Council was held Tuesday, March 11, 2014, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, and Marianne Wainwright. Marc Magers was absent. Other city staff present: Cynthia Stimson, Lynn Miller, and Dave Yanecek. Motioned by Otto, seconded by Frieden to approve the agenda. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Motioned by Beer, seconded by Otto to approve the City Council minutes dated February 11, 2014 and February 25, 2014. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Motioned by Otto, seconded by Beer to place on file the Planning and Zoning Commission minutes dated February 18, 2014 and the Library Board of Trustees minutes dated March 4, 2014, and the Parks and Beautification Committee minutes dated January 16, 2014. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Lynn Miller reported that the fire department has received the new radios and has completed CPR training as well as mask testing. He also reported that the City's new pick-up was purchased today. JoAnn Beer reported that the Parks and Beautification Committee has been working on the Easter Egg Hunt. Marc Magers entered at 7:04 PM. Mayor Rabe distributed drawings of a proposed park sign for The Complex. The City Council requested that changes be made to lower the expense estimate and a revised layout be submitted. Motioned by Beer, seconded by Magers to approve the financial reports as submitted. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Deputy LaMere presented the list of calls. Marc Magers asked about an animal problem and requested details be forwarded to the city clerk's office. Cathy Bayne mentioned complaints about vehicles running the stop signs at Front and Park Street. Two quotes for drywall repair and one quote for painting in the library were discussed. More quotes are to be obtained and reviewed during the special meeting on March 25. Three quotes for furnace and air conditioning unit replacements were discussed. Motioned by Otto, seconded by Frieden to accept the quote from Jordan's Heating and Cooling, Inc. of$17,114.00. The maintenance department will fix the concrete pad under one of the air conditioning units, if needed and Jordan's Hearing and Cooling, Inc. does not. Funding will be from the general fund in addition to current library budget. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe opened the public hearing regarding the FY15 budget at 7:48 PM. The city clerk reported that the clerk's office did not receive any written or oral comments about the budget. No one present had any comments. Mayor Rabe closed the public hearing at 7:49 PM. Motioned by Magers, seconded by Otto to approve RESOLUTION 2014-28, A RESOLUTION APPROVING CITY OF FAIRFAX'S ANNUAL BUDGET FOR FISCAL YEAR 2014-2015. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-28 duly adopted. Motioned by Magers, seconded by Otto to approve RESOLUTION 2014-29, A RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S PROPOSED AMENDMENT TO THE FISCAL YEAR 2013-2014 BUDGET. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-29 duly adopted. Discussion was held about the insurance renewal quote. Auto deductibles and coverages were reviewed. Motioned by Magers, seconded by Otto to approve RESOLUTION 2014-30, A RESOLUTION APPROVING THE INSURANCE COVERAGE FOR THE CITY OF FAIRFAX BEGINNING APRIL 1, 2014. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-30 duly adopted. Dave Yanecek reported that the Linn County Building Department has completed their review of Casey's Commercial Building Permit Application. City staff will be accompanying Linn County's building inspectors during inspections. Dave recommended approval of the commercial building permit. Linn County has billed the City of Fairfax for their services. Casey's will be invoiced for this amount along with Fairfax's fees. Motioned by Magers, seconded by Otto to approve Casey's General Stores' Commercial Building Permit Application. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Maggie Burger, of Speer Financial, reviewed the bids received during the bond sale this morning and recommended the City accept the bid from UMB Bank, n.a., Kansas City, Missouri with a true interest rate of 2.2440%. Motioned by Magers, seconded by Wainwright to approve RESOLUTION 2014-31, A RESOLUTION AWARDING SALE OF GENERAL OBLIGATION CORPORATE PURPOSE BONDS, SERIES 2014. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-31 duly adopted. Planning and Zoning Commission Member Dennis Kunze discussed the Commission's decision to not recommend changes to the accessory structure regulations. Discussion was held about the role of the Board of Adjustment and the process of combining lots. Mayor Rabe asked that research will be done about the regulations and processes of other communities. Motioned by Wainwright, seconded by Frieden to approve RESOLUTION 2014-32, A RESOLUTION SETTING PUBLIC HEARING CONCERNING ADOPTING A REVISED OFFICIAL ZONING MAP FOR THE CITY OF FAIRFAX. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-32 duly adopted. Motioned by Wainwright, seconded by Beer to approve RESOLUTION 2014-33, A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-33 duly adopted. Motioned by Beer, seconded by Frieden to approve the third reading and give final approval to ORDINANCE NO. 09, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2012, BY AMENDING PROVISIONS PERTAINING TO THE ANIMAL PROTECTION AND CONTROL. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe gave a report from the Splash Pad Committee. After looking into the costs and process of placing a splash pad at Hawks Ridge Park, the Committee is recommending not placing one in this park. Instead, they suggest saving for a larger splash pad at The Complex. This will help with budgeting of needed infrastructure improvements and the placement of the planned basketball court at Hawks Ridge Park. Saturday, May 17, 2014, was set as the date of the Fairfax City-wide Garage Sale Day. Saturday, June 7, 2014, was set as the date for the annual Fairfax City-wide Waste Pickup Day. We will not be collecting hazardous waste materials this year. Discussion was held about possible Earth Day Activities. Discussion was held about a traffic study that Linn County is requiring for the proposed condo development area near Beverly Road. Mayor Rabe suggested the City share in the cost of this traffic study, as the City will use the information gained and will benefit from future development of this area. Motioned by Magers, seconded by Wainwright to share the cost of this required traffic study with Gordon Sevig. The City will pay 50% of the costs, up to a maximum of$2,500.00 contributed to the study's costs. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Motion carried. The Planning and Zoning Commission will be holding a public hearing regarding the rezoning request from Gordon Sevig for this property, on Tuesday, March 18, at 7:00 PM. Some City Council members may be attending this hearing. The city clerk was directed to post this as a special city council meeting, in case a quorum of the city council will be present. Motioned by Magers, seconded by Beer to approve RESOLUTION 2014-34, A RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON A REZONING REQUEST. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-34 duly adopted. Drainage in the area behind city hall was reviewed. The City has received two quotes for work to help the drainage. The IDOT will be contacted to ask about options for connection to drainage structures both before and after their planned road improvements. Mayor Rabe informed the City Council about the customer service problems the City has been having with our current uniform provider. They are to be notified in writing of the problems to begin the process of cancelling the contract. Two companies have been contacted for quotes and a third will be called. Samples and referrals are to be gotten from the preferred quote. Mike Dufoe, from Hall and Hall Engineers, gave an update of Phase 1, East Cemetery Road Area Improvements Project. The contractor is checking on why the alarm sounded at the sewer lift station. They are to make the access road usable, get the alarm system training scheduled, one lift station basket cleaned, the other placed, till the field, and do seeding. Mike Dufoe stated that the pre-construction meeting with Rathje Construction, for Phase 2, East Cemetery Road Area Improvements Project, is scheduled for 10:00 AM on Friday, March 14, 2014. Jeff Iben has been contacted about the needed detention basin improvements. He is requesting a written agreement with the City of Fairfax about acceptance of the basin. Hall and Hall Engineers will draft the agreement. The city clerk reminded the city council of the special city council meeting on March 25, 2014, at 6:00 PM. A few other items other than the bonding action, will be placed on the agenda. JoAnn Beer asked if Fairfax could have a representative go to the Linn County Trails meetings. Marc Magers volunteered. JoAnn will forward him meeting information. Marc Magers announced that the City of Ely is working on extending the trail in their community. There will be a meeting with Ely and Johnson County to discuss the process. He asked people to attend to show support of the project. Joann Beer mentioned an article in the CityScape about nuisance abatement. The city clerk asked about the submission of the All Star Community Award application. Mayor Rabe is working on this application. Motioned by Otto, seconded by Frieden to adjourn the meeting.
