REGULAR CITY COUNCIL MEETING
APRIL 8, 2014
The regular meeting of the Fairfax City Council was held Tuesday, April 8, 2014, at
Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members
present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright.
Other city staff present: Cynthia Stimson and Lynn Miller.
Motioned by Beer, seconded by Magers to approve the agenda. Ayes: Beer, Frieden,
Otto, Magers, and Wainwright. Nays: None. Motion carried.
Motioned by Beer, seconded by Frieden to approve the City Council minutes dated
March 11, 2014, March 18, 2014, and March 25, 2014. Ayes: Beer, Frieden, Otto, Magers, and
Wainwright. Nays: None. Motion carried.
Motioned by Magers, seconded by Frieden to place on file the Planning and Zoning
Commission minutes dated March 18, 2014 and the Parks and Beautification Committee minutes
dated February 20, 2014. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None.
Motion carried.
Mayor Rabe stated that he had viewed the Signal 88 Security reports and they are being
very thorough. He suggested the report is placed on Google Drive for council review.
Linn County Sheriff Deputy Egli presented the list of calls. Mayor Rabe asked that law
enforcement be ready to stop ATVs driving on the streets. The Deputy asked that if someone
sees this happening, to follow the driver and find out where the ATV is from. They will then
follow-up with the homeowner to stop this behavior. They want to be pro-active to avoid an
accident. The Linn County Sheriff s Department has been made aware that the City is now using
Signal 88 Security. Doug and Major Hansel have spoken about coverage in Fairfax.
The painting and drywall quotes for work at the library were reviewed.
Motioned by Magers, seconded by Otto to accept the quote from Paint Masters for
$5,625.00 to repair the drywall and paint in the library. Ayes: Beer, Frieden, Otto, Magers, and
Wainwright. Nays: None. Motion carried.
Brian Merta reported that the fire department had to do some work on a truck and they
are getting their gear.
A quote from CRL Lawn Care for spraying was reviewed, the new park is not included.
Motioned by Wainwright, seconded by Otto to approve the quote of$5,426.00 from CRL
Lawn Care for spraying. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None.
Motion carried.
A proposal from Kluesner Construction, Inc. for crack and joint sealing of city streets
was discussed.
Motioned by Magers, seconded by Wainwright to accept the proposal from Kluesner
Construction, Inc. for $18,154.22. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays:
None. Motion carried.
A quote from Merta Concrete Construction Co. for a basketball slab at Hawks Ridge Park
and city sidewalk was discussed. The size of the slab is to be changed to 46' x 74'. The quote is
from November 2013, so there may be some increase in costs. Brian Merta estimated the most
they would increase would be $1,200 for the slab and $900 for the sidewalk.
Kevin Christensen voiced his opposition to the idea of a basketball court being placed in
Hawks Ridge Park. He asked about the number of supporters and asked the council to survey the
community. The City Council stated that this project has been discussed at a park open house,
Parks and Beautification Committee meetings, and City Council meetings over several years.
Motioned by Wainwright, seconded by Beer to award the project for a 46' x 74'
basketball slab at Hawks Ridge Park to Merta Concrete Construction Co. Ayes: Beer, Frieden,
Otto, Magers, and Wainwright. Nays: None. Motion carried.
Motioned by Wainwright, seconded by Beer to award the project for 580 linear feet of
city sidewalk installation along the city's water retention area on Sunflower Drive to Merta
Concrete Construction Co. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None.
Motion carried.
A revised park brochure was reviewed. Mayor Rabe will try to edit the disc golf picture,
before printing. 500 are to be printed.
Discussion was held regarding installation of the new scoreboards. Two quotes from
professional sign companies were reviewed. It was decided that city staff will install the
scoreboards. Marc Magers has contacted a local electrician who will donate the labor to hook
them to power.
Motioned by Beer, seconded Magers to accept the monthly financial reports as presented.
Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried.
Joe Horaney, from the Cedar Rapids/Linn County Solid Waste Agency, gave a
presentation about their services and facilities.
The Commercial Building Permit Application from EIB was reviewed. They are
requesting to build a structure near the pond, similar to a park pavilion. The Fairfax Building
Department has reviewed this request and are recommending approval.
Motioned by Magers, seconded by Otto to approve the Commercial Building Permit
Application from EIB. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None.
Motion carried.
Mayor Rabe opened the public hearing concerning a budget amendment to the FYI
budget at 7:54 PM. The city clerk's office has not received any written or oral comments or
questions. No one present wished to make any comments. Mayor Rabe closed the public
hearing at 7:55 PM.
Motioned by Magers, seconded by Beer to approve RESOLUTION 2014-45, A
RESOLUTION AMENDING THE CURRENT BUDGET FOR FISCAL YEAR ENDING
JUNE 30, 2014. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays:
None. Motion carried. Mayor Rabe declared RESOLUTION 2014-45 duly adopted.
Mayor Rabe opened the public hearing concerning Gordon Sevig's rezoning request at
7:56 PM. The city clerk's office has received some calls asking questions about the rezoning
request and one written comment which was previously forwarded before the Planning and
Zoning Commission's hearing. Discussion was held with the audience and council about this
rezoning request. The layout of the lot, design of the buildings, street layout, and other possible
uses of the land were discussed. Mayor Rabe closed the public hearing at 8:13 PM.
The Fairfax Planning and Zoning Commission's hearing on this topic was discussed and
their minutes recommending approval of this rezoning request were reviewed.
Motioned by Wainwright, seconded by Magers to introduce and approve the first reading
of ORDINANCE 13, AN ORDINANCE AMENDING THE FAIRFAX ZONING
ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE
OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF
FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF
CERTAIN PROPERTY, NOW KNOWN AS: LOT 148, PRAIRIE VIEW ESTATES
PART 2, FAIRFAX, LINN COUNTY, IOWA FROM 9RS: SINGLE FAMILY
RESIDENTIAL TO 4RM: MULTIPLE-FAMILY RESIDENTIAL DISTRICT. Roll call
vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried.
Motioned by Magers, seconded by Beer to suspend the rule requiring that an ordinance
be voted on for passage at two council meetings prior to this meeting with respect to
ORDINANCE 13. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays:
None. Motion carried.
Motioned by Frieden, seconded by Otto to approve final passage and adoption with
respect to ORDINANCE 13, AN ORDINANCE AMENDING THE FAIRFAX ZONING
ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE
OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF
FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF

Mayor Rabe opened the public hearing regarding adopting a revised Official Zoning Map
at 8:15 PM. The city clerk's office has not received any written or oral comments or questions
concerning this issue. No one present had any comments. Mayor Rabe closed the public hearing
at 8:18 PM.
Motioned by Magers, seconded by Otto to introduce and approve the first reading of
ORDINANCE 14, AN ORDINANCE AMENDING THE FAIRFAX ZONING
ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY ADOPTING A NEW,
REVISED OFFICIAL ZONING MAP. Roll call vote: Ayes: Beer, Frieden, Otto, Magers,
and Wainwright. Nays: None. Motion carried.
Motioned by Beer, seconded by Otto to suspend the rule requiring that an ordinance be

ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY ADOPTING A NEW,
REVISED OFFICIAL ZONING MAP. Roll call vote: Ayes: Beer, Frieden, Otto, Magers,
and Wainwright. Nays: None. Motion carried.
Shane Wicks gave an update of the Phase 1 East Cemetery Road Area Improvements
Project. Ricklefs Construction plans to complete 4-5 days of work during the next 10 days.
They have a short punch list to complete.
Shane Wicks discussed the Phase 2 East Cemetery Road Area Improvements Project. He
stated that Rathje Constructions plans to start work on Monday, April 14, 2014. There will be a
neighborhood meeting at 5:30 PM on Tuesday, April 15, 2014, at 85 E Cemetery Road. The
concrete thickness in the trail portion at the south edge of the street was discussed. Shane is to
draft a proposed change order and the Council will review the proposed cost at that time. The
preconstruction meeting minutes were reviewed.
Motioned by Wainwright, seconded by Beer to approve RESOLUTION 2014-46, A
RESOLUTION ACCEPTING TEMPORARY CONSTRUCTION EASEMENT ON A
PORTION OF THE PROPERTY LOCATED AT 70 EAST CEMETERY ROAD IN
CONNECTION WITH THE PHASE 2 EAST CEMETERY ROAD STREET
RECONSTRUCTION, TRAIL AND DRAINAGE IMPROVEMENTS PROJECT IN
FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and
Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-46
duly adopted.
Shane Wicks gave a project update concerning the Trail Project. The south pier piles are
driven.
Motioned by Wainwright, seconded by Magers to approve RESOLUTION 2014-47, A
RESOLUTION TO APPROVE PAY APPLICATION NO. 2 FROM TAYLOR
CONSTRUCTION, INC. FOR THE FAIRFAX TRAIL ALONG EAST SIDE OF
UNNAMED TRIBUTARY TO PRAIRIE CREEK BETWEEN EAST CEMETERY ROAD
AND FRONT STREET PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY,
IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None.
Motion carried. Mayor Rabe declared RESOLUTION 2014-47 duly adopted.
Motioned by Wainwright, seconded by Magers to approve RESOLUTION 2014-48, A
RESOLUTION APPROVING FIREWORKS PERMIT FOR THE FAIRFAX FIRE AND
RESCUE DEPARTMENT. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and
Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-48
duly adopted.
Lynn Miller stated that they have seen an improvement in the service received from
Aramark.
Motioned by Wainwright, seconded by Magers to approve the Class C Liquor License
renewal for the Star Bar, subject to receiving the dram insurance endorsement. Ayes: Beer,
Frieden, Magers, and Wainwright. Nays: None. Travis Otto abstained because he is the owner
of the Star Bar. Motion carried.
Motioned by Magers, seconded by Otto to approve the claims list dated April 8, 2014.
Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried.
Mark Banowetz is running for Linn County Supervisor. He gave a short speech about
himself and his candidacy.
The city clerk reported that the All Star Award application has been submitted and that
the park section of the website has been enhanced. She asked about the sidewalk situation once
the trail over the creek is completed and if the Council all saw the TIF legislation Call to Action.
Travis Otto asked about the status of sidewalk letters. A brief discussion was held about
sidewalk regulations. August 1 was set as the deadline for residents to complete any required
work.
Travis also asked about the trail bridge details. He has been contacted by residents
requesting that golf carts be allowed to cross the bridge. The design does not call for this.
Bollards will be installed to block access to anything other than a pedestrian, bicycle, or scooter
for handicapped accessibility.
Marc Magers asked if staff had looked at Don Sankot's front yard. They have not had a
chance, but they do have it on their list to view.
Marianne Wainwright asked if everyone noticed how the ATM property near Casey's is
not draining. Shane Wicks stated he noticed that the culvert was recently dug-up and may be
blocked. Mayor Rabe will check on this situation.
Bernie Frieden noted that a sign north of Casey's is leaning.
JoAnn Beer asked about the status of the restitution for the vandalism. The clerk will do
a report. She also asked if the hawk has been replaced. The clerk was directed not to replace
this. Mayor Rabe would like, if one is placed there again, it to be bigger and secured so that it
will not be stolen.
Discussion was held about the dumpster at the Dairy Queen. They were recently
overflowing and may be sitting on city property. The parking, traffic flow, and building status at
the two businesses at this location were discussed.

Otto, Magers, and Wainwright. Nays: None. Motion carried.
