Mayor Rabe called the meeting to order at 7:01 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright. Other city staff present: Cynthia Stimson and Lynn Miller. Motioned by Magers, seconded by Beer to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Frieden, seconded by Beer to approve the City Council minutes dated April 8, 2014. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Beer to place on file the Library Board of Trustees minutes dated April 1, 2014 and the Parks and Beautification Committee minutes dated March 20, 2014. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Linn County Sheriff Deputy Amos presented the list of calls. He stated that if anyone has outside security camera video for the night and area of the fire, they would be interested in viewing this video. Signal 88 has some video of the area. Marianne Wainwright asked that we contact Signal 88 and ask them to archive the videos for a longer time period. Motioned by Otto, seconded by Magers to accept the change order quote from Paint Masters for $3,350.00 for work in the library. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Marc Magers asked about the status of the library doors and the process for building issues. Fire Chief Mike Sankot reported that they had a structure fire that is under investigation, Alexis has the new truck and is making some repairs, and the department has recently completed some truck maintenance. Lynn Miller stated that the work on the dugouts is going well. JoAnn Beer stated that the Parks and Beautification Committee will be showing "The Lego Movie" in the park in June. She asked about the tree guarantee at The Complex. Culvers will be contacted. A quote from Dave Schmitt Construction for work in the parking lot at Prairie Creek Park was reviewed. $30,000 was budgeted from LOST funds in the FY15 budget. Motioned by Beer, seconded by Frieden to accept the quote of$39,013.75 from Dave Schmitt Construction for work in the parking lot at Prairie Creek Park, to be paid next fiscal year. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. A revised quote from Merta Concrete for the basketball court and sidewalk along a retention area was reviewed. Motioned by Otto, seconded by Beer to accept the quote of$18,820.00 for the basketball court at Hawk's Ridge Park and $12,165.00 for city sidewalk along a retention area from Merta Concrete Construction Co. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Otto to approve the financial reports as submitted. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Patrick Slater discussed the 2014 USA Days schedule and requested the City of Fairfax support this community event at the same level as last year. Motioned by Magers, seconded by Beer for the City of Fairfax to contribute $3,000 to the USA Days Committee. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mark Neuhaus requested to use The Complex on October 11 for a Cruise In. He would like to reserve the area on the next Saturday, October 18 as a rain date. There may be enough room to park the cars in the parking lot. If not and if the ground is suitable, they may park some cars on the grass area. Motioned by Magers, seconded by Frieden to approve the use of The Complex on Saturday, October 11, 2014 for a Cruise In and Saturday, October 18, 2014, in case of rain on the I lth. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Discussion was held about the site plan for the elevator property at 268 Vanderbilt Street. Solon Feed Mill now owns the property and they plan to add building space. They are requesting the City of Fairfax approve the plan of improvements so that they can start some foundation work and get the building ordered. Motioned by Frieden, seconded by Otto to approve the plan of improvements from the Solon Fee Mill for 268 Vanderbilt Street with the understanding that more detailed building information will be submitted at the next meeting to issue a commercial building permit. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. The city clerk stated that six audit proposals were sent. The State of Iowa sent a letter stating they don't have time. Dietz, Donald & Company submitted the only proposal. Motioned by Magers, seconded by Beer to approve RESOLUTION 2014-49, A RESOLUTION ACCEPTING A PROPOSAL FOR AUDIT SERVICE. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-49 duly adopted. Mayor Rabe informed the City Council about the efforts to hire a janitor for some of the city buildings and parks. He will meet with an applicant and make a recommendation at the next meeting. Two bids were received for the 1992 pick-up and the City reviewed a quote for scrap value. Motioned by Magers, seconded by Beer to accept the bid of$2,540.00 from Zamastil Lawn Care and Landscaping for the 1992 Ford pick-up. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe discussed the idea of trying to get landlords to be more responsible for their tenants' actions. The surrounding neighborhoods suffer when rental properties are allowed to deteriorate. The City Council suggested the Mayor contact the management firm and the owner about the issues. Mayor Rabe asked the City Council what they would like to do with Bill Gibney's ground near City Park. Park users sometimes park on the ground. The City has been mowing the ground in exchange for this use. The City Council directed the City to contact Bill Gibney about marking the property as private and to stop mowing and using the area. Use of the old ball diamond area that the City leases from the Catholic Church was discussed. It was determined that some groups do still use this area, even if just for practice. The fencing will need to be removed and possibly upgraded. Motioned by Magers, seconded by Frieden to accept the quote of$5,910.00 from Eastern Iowa Building, Inc. to place steel inside the maintenance building. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Beer to approve RESOLUTION 2014-50, A RESOLUTION APPROVING A FIREWORKS PERMIT FOR WILLIAM BARRY. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-50 duly adopted. Mike Dufoe, of Hall and Hall Engineers, Inc., gave an update about Phase 1 of the East Cemetery Road Improvements. Hydrants need to be adjusted, a valve fixed, and staff trained on the sewer lift station. He also gave an update about Phase 2 of the East Cemetery Road Improvements. They have gotten a slow start due to the weather and relocation of the gas main. The plans are to pave the trail on the north side of East Cemetery Road next week. Motioned by Magers, seconded by Otto to approve RESOLUTION 2014-51, A RESOLUTION TO APPROVE PAY APPLICATION NO. 1 FROM RATHJE CONSTRUCTION, CO. FOR THE PHASE 2 EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL, AND DRAINAGE IMPROVEMENTS PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-51 duly adopted. Motioned by Magers, seconded by Otto to approve RESOLUTION 2014-52, A RESOLUTION EXECUTING AN AGREEMENT FOR DETENTION BASIN REPAIRS AT THE NORTHEAST CORNER OF 80TH STREET AND EAST CEMETERY ROAD IN CONNECTION WITH THE PHASE 2 EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL AND DRAINAGE IMPROVEMENTS PROJECT IN FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2014-52 duly adopted. Mike Dufoe gave a cost estimate for the pavement thickness proposal of just under $800. He was instructed to draft a change order for the next meeting. Discussion was held about the ditch near Prairie Creek Veterinary Clinic. We will be digging a little to try and improve drainage in the area without making a drastic change in the ditch. A change will be made for the staging at the drive of Royale Storage the cost estimate is about $500.00. Mike Dufoe gave an update about the trail project. The south pilings are complete. Mayor Rabe will meet with the property owner on East Cemetery Road near the trail head. Discussion was held concerning the multiple change orders for the trail project. Discussion was held with Shane Schrader concerning the Meadow Oak Addition Plan of Improvements and Site Plan. Mike Dufoe reviewed the conditions of approval. Motioned by Frieden, seconded by Magers to approve RESOLUTION 2014-59, A RESOLUTION TO APPROVE THE PLAN OF IMPROVEMENTS AND SITE PLAN FOR MEADOW OAK ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2014-59 duly adopted. Discussion was held about the sewer line to service Meadow Oak Addition. The City Council wants to view a firm quote for the needed work before deciding if they will be cost sharing. Motioned by Frieden, seconded by Beer to approve RESOLUTION 2014-60, A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE PAYMENT OF DEBT PRINCIPLE, INTEREST, AND FEES DUE JUNE 1, 2014. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2014-60 duly adopted. Dave Selzer discussed the status of the property on the north end of the Dairy Queen. The city clerk stated that she will be in Milwaukee next week, Joel is done scanning, Kathy is registered for the Academy in Ames in July, and that the City was not chosen for the All Star Community Award. Discussion was held regarding a request for `Children Playing Signs" on Sunflower, near 2nd Street and on Horizon near 1 sf Street. Mayor Rabe stated that he attended a Municipal Leadership Academy and suggested the City look into having a strategic planning session. JoAnn Beer pointed out an article in the CityScape to read. Travis Otto asked about the sidewalk notices, and Marc Magers asked about the street committee discussions. Motioned by Otto, seconded by Frieden to adjourn the meeting.
