REGULAR CITY COUNCIL MEETING
JULY 8, 2014
The regular meeting of the Fairfax City Council was held Tuesday, July 8, 2014, at
Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members
present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright.
Other city staff present: Cynthia Stimson, Cathy Bayne, and Lynn Miller.
Motioned by Magers, seconded by Beer to approve the agenda. Ayes: Beer, Frieden,
Otto, Magers, and Wainwright. Nays: None. Motion carried.
Motioned by Beer, seconded by Frieden to approve the City Council minutes dated June
10, 2014. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried.
Motioned by Beer, seconded by Magers to place on file the Library Board of Trustees
minutes dated June 3, 2014 and the Parks and Beautification Committee minutes dated May 15,
2014. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried.
Linn County Sheriff Deputy Egli presented the list of calls. The Sheriff's Department
was asked to patrol West Cemetery Road and Stallman Drive to watch for speeding and vehicles
too heavy to cross the bridge on West Cemetery Road. Deputy Egli stated that they made three
arrests in the Reynolds Street area and impounded their cars.
Cathy Bayne stated that the library has been busy. Gary Prybil is working on quotes for
work on the outside of the building.
Lynn Miller reported that the road situation has been a challenge for the fire department.
They had to position trucks on each side. They have had a lot of calls. He also reported that the
maintenance department has been swamped with flood issues. Marc Magers thanked city staff
for their hard work and dedication.
Motioned by Magers, seconded by Otto to approve the quote from CRL Lawn Care &
Landscaping for spraying at The Complex for $2,600.00 (corrected to $2,400.00 during meeting
08-12-2014). Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion
carried.
Bernie Frieden stated that the rain gardens at The Complex need to be fixed or removed.
They are unsightly and dangerous when filled with water.
JoAnn Beer stated that the Movie in the Park went well and they will have another one in
August. She asked why there aren't flowers in the north planter. Lynn Miller will be planting
different plants in the fall.
The utility billing financials were ready, but none of the other reports. They will be ready
by next meeting.
Shane Wicks reported that Shane Schrader has started work on the Meadow Oak
development. Hall and Hall Engineers will keep doing periodic inspections of the West
Cemetery Road bridge. Marc Magers asked that the City of Fairfax check on funding for repair
or replacement of this bridge. The IDOT has accepted a bid from Taylor Construction for their
bridge project on Highway 151. Work must begin by Thursday, July 10, with about two weeks
anticipated for the work.
Linn County Supervisor John Harris and Tracey Achenbach gave a presentation about the
Housing Fund for Linn County.
Drew Martel, Mobile Crisis Coordinator for Linn County Foundation 2 Crisis Center
gave a presentation about their services.
Discussion was held regarding the Commercial Building Permit Application from TJ
Rentals at 96 West Cemetery Road. Shane Wicks is recommending storm water management
not be required at this time, but if more development would happen here, it would be required at
that time. They have signed the Site Plan Acceptance of Conditions.
Motioned by Wainwright, seconded by Frieden to approve the Commercial Building
Permit Application from TJ Rentals at 96 West Cemetery Road, with the conditions in place.
Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried.
Discussion was held concerning a Conditional Use Permit Application with Linn County
from Zenisek LLC, for K&B Ag Supply. Steve Scott discussed their plans. Dan
Swartzendruber, Linn County Planning and Zoning Manager, discussed Linn County and
IDOT's request to close the intersection of Southview Road and Highway 151. Linn County
requires a business to have access to a hard surfaced road. The Fairfax City Council strongly
voiced their opposition to closing this intersection. They felt that customers need the ability to
cross directly across Highway 151 to go west. It was suggested to not allow a right turn at this
intersection or look at making it one way. Shane Wicks suggested that if development would
happen across Highway 151, the City may want the intersection angle straightened and we
should consider placing this as a condition for the future.
No action was taken on the Plat of Survey for Zenisek, LLC, due to the unknown action
by Linn County concerning the Conditional Use Permit Application.
The route for the Masonic 5K was discussed. The City of Fairfax will not be closing any
streets for this event.
Discussion was held on several different flooding issues. The bridge on West Cemetery
Road is opened to local traffic, with a 5 ton weight limit. The weight limit is to be posted farther
to the south to help trucks know before they get to Stallman Drive. Signal 88 is to sit at the
bridge to enforce the weight limit. The IDOT has been contacted about signage and
enforcement.
The city clerk mentioned that a resident requested Stallman Drive be posted as no parking
on both sides of the street. The City Council did not agree. They feel the parked vehicles may
help to slow down traffic and that the business needs parking available.
The culvert at Williams Blvd and 76th Avenue was discussed. It is to be packed with
rock for now and the City will review plans and estimates for a long-term repair.
The roll-off container for flood damaged items will be kept until Monday, giving
residents another weekend to bring flood damaged items.
The City will look at having a tree service come to town annually.
JoAnn Beer asked about removal of tree debris from City owned trees which landed on
private property. The City's insurance agent has advised us that the City is not responsible and
the homeowners should contact their insurance agent for coverage.
Steve Waln, owner of Waln Repair & Collision Center, stated that his business sustained
a lot of flood damage. He asked the City to review the approved site plans for Vance's Storage.
He believes that the required waterway has been filled in, which contributed to the flooding of
his business.
Deanna Heintz, owner of Fairfax Storage, stated that they had 12 inches of water in their
office. This was more water than they have ever had.
Marc Magers expressed the City of Fairfax's frustration with Linn County's
unwillingness to assist during this time.
Mayor Rabe reviewed areas that experienced extreme flooding and asked the City to
determine how to improve our response. Issues discussed were: overflow agreement for sewer,
sewer lift stations, trail project damage, water across streets, drainage from farm ground, and
water detention areas.
Motioned by Magers, seconded by Otto to approve RESOLUTION 2014-68, A
RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS. Roll call vote: Ayes:
Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe
declared RESOLUTION 2014-68 duly adopted.
Mayor Rabe appointed Roger Abel to the Library Board of Trustees.
Shane Wicks gave an update concerning the Phase 1 East Cemetery Road Area
Improvements Project. They need to do grading and reseeding during the seeding season and to
flush valves and rotate fire hydrants as soon as possible. Shane also stated that the contractors
have started paving for the Phase 2 East Cemetery Road Area Improvements Project.
Motioned by Magers, seconded by Otto to approve RESOLUTION 2014-69, A
RESOLUTION TO APPROVE PAY APPLICATION NO. 3 FROM RATHJE
CONSTRUCTION, CO. FOR THE PHASE 2 EAST CEMETERY ROAD STREET
RECONSTRUCTION, TRAIL, AND DRAINAGE IMPROVEMENTS PROJECT IN THE
CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto,
Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION
2014-69 duly adopted.
Shane Wicks stated that the trail project did have some damage due to the flooding, they
will be pounding the pilings for the north abutment on July 9, and that they have to inspect the
north pier when the water allows.
Motioned by Wainwright, seconded by Otto to approve RESOLUTION 2014-70, A
RESOLUTION TO APPROVE PAY APPLICATION NO. 5 FROM TAYLOR
CONSTRUCTION, INC. FOR THE FAIRFAX TRAIL ALONG EAST SIDE OF
UNNAMED TRIBUTARY TO PRAIRIE CREEK BETWEEN EAST CEMETERY ROAD
AND FRONT STREET PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY,
IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none.
Motion carried. Mayor Rabe declared RESOLUTION 2014-70 duly adopted.
Motioned by Wainwright, seconded by Magers to approve the claims list dated July 8,
2014. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried.
Marc Magers thanked Mayor Rabe for the great job he did during this flooding
emergency time.
JoAnn Beer asked about the possibility of looking at an 80th Street extension.
Old sand bags may be brought to the shop area during business hours.
The clerk mentioned that she will be on vacation starting on Friday. Kathy will be taking
some vacation after which she will be going to Ames for training.
