HomeMy WebLinkAbout09/09/2014 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING SEPTEMBER 09, 2014 The regular meeting of the Fairfax City Council was held Tuesday, September 9, 2014, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, and Marianne Wainwright. Marc Magers and Travis Otto were absent. Other city staff present: Cynthia Stimson and Lynn Miller. Motioned by Beer, seconded by Frieden to approve the agenda. Ayes: Beer, Frieden, and Wainwright. Nays: None. Absent: Magers and Otto. Motion carried. Motioned by Frieden, seconded by Beer to approve the City Council minutes dated August 12, 2014 and August 21, 2014. Ayes: Beer, Frieden, and Wainwright. Nays: None. Absent: Mages and Otto. Motion carried. Motioned by Frieden, seconded by Beer to place on file the Library Board of Trustees minutes dated August 5, 2014 and the Parks and Beautification Committee minutes dated July 17, 2014. Ayes: Beer, Frieden, and Wainwright. Nays: None. Absent: Magers and Otto. Motion carried. Marc Magers entered at 7:02 PM. Doug Mueller, with Signal 88, discussed their reports. No one was present for the library. Lynn Miller discussed the hydrant replacement project, street work, flushing, and the two quotes for concrete trail work at The Complex. Motioned by Magers, seconded by Frieden to approve the quote from E & F Paving for $40,801.28 for concrete trail work at The Complex. An additional access is to be added and culvert work completed by staff Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Linn County Deputy LaMere presented the list of calls. The list was questioned because it is short and the hours still seem normal. JoAnn Beer reported that the parking lot at Prairie Creek Park is completed and looks great. She met with the Sankots about the detention basin area. It was suggested to have a neighborhood meeting to gather input from various residents and then present the ideas to the City of Fairfax. JoAnn will be viewing other ponds in small communities that allow fishing, but not swimming. Motioned by Frieden, seconded by Beer to approve the financial reports as presented. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Shane Wicks discussed the update the City received about the IDOT's bridge projects. Construction is slated for 2017. Current construction plans call for leaving one lane of traffic open over Prairie Creek during the work. Motioned by Beer, seconded by Magers to approve the liquor license renewal for the Pit Stop. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Beer, seconded by Frieden to approve the commercial sign permit application from Bushman Excavating, Inc. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. A request to make a portion of Railroad Street no parking was discussed. A revision of the parking ordinance is to be made near the loading dock area at The Waterworks. Patty Soukup gave a presentation about creating a historical Preservation Committee. Someone from Ely or Lisbon is to come and talk to the City Council about this program. Motioned by Frieden, seconded by Beer to approve RESOLUTION 2014-80, A RESOLUTION TO APPROVE THE PLAT OF SURVEY NO. 1942 —LOCATED IN THE NORTHWEST QUARTER OF SECTION 16, TOWNSHIP 82 NORTH, RANGE 8 WEST OF THE 5TH P.M. IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: none. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2014-80 duly adopted. Shane Wick led a discussion about the flood impacted areas. He had reports ready for two areas. Melody Vance, Vance's Storage, agreed to remove a culvert, dig out the ditch/swale area to the designed depth of 24", and remove some slats in a fence. Joe Blood is to be contacted about an erosion area. Other things that might help drainage in the area were reviewed. Property owners would have to agree to make some grading changes. A drainage swale along 2nd Street is not constructed properly between the houses. Discussion was held about drainage in this area. Mayor Rabe reported that he met with the IDOT and discussed Fairfax's concerns about the change in the Highway 100 proposed expansion layout. Shane Wicks asked if the City wants to give input on the staged construction alternatives. The City Council asked him to relay to the IDOT their dissatisfaction with the current plans. Mayor Rabe stated that Bill and Jeanne Gibney are wanting to sell two empty lots near City Park. City Council and Mayor Rabe both feel that an agreement for their current asking price should be drafted and the City should proceed with the purchase. The attorney will be contacted. A quote of$11,525.60 from Schrader Excavating & Grading Co. for the sewer line changes for Meadow Oak was discussed. The City of Fairfax will not issue any Occupancy Certificates for this development until the sewer main connection is corrected. Motioned by Frieden, seconded by Magers for the City of Fairfax to pay 50%, up to a maximum of$5,000.00, of the quote to make this sewer main connection correction. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. As amended 10-14-14 Shane Wicks stated that Phase 2 East Cemetery Road Area Improvements Project Ilas only two working days left. They are working on setting manholes and pouring driveways. The retaining wall on the west end will be removed and the area graded out into the field. Regis and Barbara Arp have declined to sign an agreement regarding redesigning of the swale through a portion of their property at 25 East Cemetery Road. Because of this, the project will be completed according to the original design. Motioned by Frieden, seconded by Beer to approve RESOLUTION 2014-81, A RESOLUTION TO APPROVE CHANGE ORDER NO. 3 FROM RATHJE CONSTRUCTION, CO. FOR THE PHASE 2 EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL, AND DRAINAGE IMPROVEMENTS PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: none. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2014-81 duly adopted. Motioned by Magers, seconded by Beer to approve RESOLUTION 2014-82, A RESOLUTION TO APPROVE PAY APPLICATION NO. 5 FROM RATHJE CONSTRUCTION, CO. FOR THE PHASE 2 EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL, AND DRAINAGE IMPROVEMENTS PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: none. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2014-82 duly adopted. There is a meeting tomorrow morning to discuss the trail project. There are 26 working days left. Motioned by Beer, seconded by Wainwright to approve RESOLUTION 2014-83, A RESOLUTION TO APPROVE PAY APPLICATION NO. 7 FROM TAYLOR CONSTRUCTION, INC. FOR THE FAIRFAX TRAIL ALONG EAST SIDE OF UNNAMED TRIBUTARY TO PRAIRIE CREEK BETWEEN EAST CEMETERY ROAD AND FRONT STREET PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: none. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2014-83 duly adopted. Motioned by Magers, seconded by Frieden to introduce and approve the first reading of ORDINANCE 15, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 168 SIGN REGULATIONS. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Magers, seconded by Frieden to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 15. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Wainwright to approve final passage and adoption with respect to ORDINANCE 15, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 168 SIGN REGULATIONS. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Wainwright, seconded by Beer to approve RESOLUTION 2014-84, A RESOLUTION TO APPROVE SIGN PERMIT FEE. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: none. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2014-84 duly adopted. Motioned by Frieden, seconded by Magers to approve RESOLUTION 2014-85, A RESOLUTION APPROVING STREET FINANCE REPORT FOR FISCAL YEAR 2013- 2014. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: none. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2014-85 duly adopted. Motioned by Magers, seconded by Beer to approve RESOLUTION 2014-86, A RESOLUTION TO APPROVE NAMING DEPOSITORIES. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: none. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2014-86 duly adopted. Motioned by Magers, seconded by Beer to approve the claims list dated September 9, 2014. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: none. Absent: Otto. Motion carried. Marc Magers asked about the status of the cracks in the sidewalk at The Complex. Lynn Miller stated that he has reviewed them, marked them on an area map, and contacted Dave Schmitt Construction. Marc also stated that he and staff must work on the pool regulations and have this topic ready by spring and asked staff to call if a quick answer is needed from city council on a topic. JoAnn Beer asked about some sandbags along Williams Blvd. that the IDOT placed. Bernie Frieden asked that a quote for proactive ground control in the parks is on the next agenda. He wants to make sure the grass survives and thrives. Motioned by Magers, seconded by Beer to adjourn the meeting. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto.
