Home My WebLink About10/14/2014 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING OCTOBER 14, 2014 The regular meeting of the Fairfax City Council was held Tuesday, October 14, 2014, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright. Other city staff present: Cynthia Stimson, Cathy Bayne, and Lynn Miller. Motioned by Magers, seconded by Beer to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Discussion was held about the wording of a motion during the September meeting. A clarification is to be added to the motion concerning cost sharing with Shane Schrader for sewer work at Meadow Oak Development. The motion should read: Motioned by Frieden, seconded by Magers for the City of Fairfax to pay 50%, up to a maximum of$5,000.00, of the quote to make this sewer main connection correction. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Beer, seconded by Frieden to approve the City Council minutes dated September 9, 2014 as amended. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Beer, seconded by Magers to place on file the Library Board of Trustees minutes dated September 2, 2014 and the Parks and Beautification Committee minutes dated August 21, 2014. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Linn County Deputy Sheriff Egli presented the list of calls. A car parked on Vanderbilt this weekend as well as East Cemetery Road's parking and speed ordinances were discussed. Cathy Bayne stated they hope the library building work will be completed by November 2, 2014. They have installed deadbolt locks to help with the door issues. Fire Chief Mike Sankot informed the City Council that they have another fire department interested in purchasing the 2004 International for $60,000. This truck is currently kept at Walford. The Department would like to sell this truck, order a new truck to be kept at Fairfax, and move a truck from Fairfax to Walford. They are working on the specifications for the new truck and will have quotes later. A bond issue will be required to purchase a new truck. The fire department can make the payments from their regular budget. Motioned by Otto, seconded by Frieden to approve selling the 2004 International fire truck for $60,000 to the Albion Fire Department. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. The City of Walford wants to upgrade their rescue truck. They purchased the truck, but it is in the City of Fairfax's name because of insurance. They will be paying for the new truck. Motioned by Frieden, seconded by Otto to sell or trade-in the 1995 GMC rescue truck according to the City of Walford's wishes, providing they purchase the replacement vehicle. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Lynn Miller stated that the City had the culvert east of Driftwood Lane scoped and jetted. They are in the process of getting a quote to make needed repairs. We have a supply of salt on hand for winter, the flushing is almost complete, and the new sidewalk is in at The Complex. Motioned by Magers, seconded by Otto to approve the financial reports as submitted. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Discussion was held about Winterfest activities. The Fairfax Coalition is requesting permission to use the new trail and bridge for a Winterfest Parade. The parade would begin at Hawks Ridge Park and go to the American Legion Hall. This would include golf carts, ATVs, a horse drawn wagon, and other entries. Types of acceptable use of the trail and bridge, snow removal, ice control, and lighting were discussed. Other Winterfest activities are a scavenger hunt, business open house, cookie walk, Santa, and more. Motioned by Otto, seconded by Frieden to approve a Winterfest Parade to begin at Hawks Ridge Park and go to the American Legion Hall on Saturday, December 13, and to use the trail and bridge for the Winterfest Parade with the following provisions: the City must have accepted the trail and bridge, the IDOT must give an ok for this type of use, the Fairfax Coalition is responsible for snow removal, the City of Fairfax will sand the area, and some sort of illumination is provided. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: Magers. Motion carried. Joe Kell gave a recap of FYSA's 2014. Hundreds of children and adults participated in t- ball, baseball, softball, and soccer. They added new leagues in 2014 and saw an increase in participation in all activities at all levels. FYSA also participated in the Easter Egg Hunt and the Haunted Trail. Larry Burger presented their annual TIF report. Discussion was held about the sewer line correction needed at Meadow Oak. Shane Schrader talked with Mayor Rabe and stated that he feels the City of Fairfax should pay the entire cost to correct the connection, not just $5,000 of the work. Motioned by Frieden, seconded by Otto to have the City of Fairfax pay for the sewer line connection correction at Meadow Oak, up to a maximum of$11,625 per the quote. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Shane Wicks submitted a report about flood impacted areas. Motioned by Magers, seconded by Otto to approve RESOLUTION 2014-87, A RESOLUTION TO APPROVE PAY APPLICATION NO. 1 FROM RAY'S EXCAVATING, LLC FOR STREAM CHANNEL FLOOD REPAIR WORK. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2014-87 duly adopted. Theresa Waln discussed their frustrations with drainage in the area of their business, Waln Repair and Collision Center. Melody Vance has been contacted about needed corrections. This topic will be on the agenda until all work is completed. Staff members have met with FEMA about the flood expenses. They are starting the required paperwork. Discussion was held about the MS Walk request to use The Complex in May of 2015. There is a men's softball tournament scheduled for that weekend. Jessica will be contacted to see if they can change the date. Motioned by Magers, seconded by Beer to approve a Commercial Sign Permit Application from Hayden Contracting at 325 80th Street Court. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mike Dufoe, Hall and Hall Engineers, gave an update about the Phase 2 East Cemetery Road Area Improvements Project. It is nearly complete, there is still some seeding to do. Drainage in the Both Street area and at Fred Wood's property was discussed as well as trail signage/painting. Motioned by Magers, seconded by Otto to approve RESOLUTION 2014-88, A RESOLUTION TO APPROVE CHANGE ORDER NO. 4 FROM RATHJE CONSTRUCTION, CO. FOR THE PHASE 2 EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL, AND DRAINAGE IMPROVEMENTS PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: none. Abstain: Wainwright. Marianne Wainwright abstained because of a conflict of interest. Motion carried. Mayor Rabe declared RESOLUTION 2014-88 duly adopted. Discussion was held concerning working days adjustment to the project. Hall and Hall Engineering is recommending 3.5 working days be added. Rathje Construction is requesting more days and has refused to sign Change Order No. 5. The City Council decided to accept the engineer's recommendation. Motioned by Magers, seconded by Otto to approve RESOLUTION 2014-89, A RESOLUTION TO APPROVE CHANGE ORDER NO. 5 FROM RATHJE CONSTRUCTION, CO. FOR THE PHASE 2 EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL, AND DRAINAGE IMPROVEMENTS PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Discussion was held about the street light design for East Cemetery Road. Type of light, type of pole, and outlets for holiday decorations were discussed. Motioned by Otto, seconded by Beer to approve RESOLUTION 2014-91, A RESOLUTION DIRECTING LINN COUNTY RURAL ELECTRIC COOPERATIVE TO PROCEED WITH DESIGN AND COST ESTIMATES FOR STREET LIGHTING ALONG EAST CEMETERY ROAD IN CONNECTION WITH THE PHASE 2 EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL AND DRAINAGE IMPROVEMENTS PROJECT IN FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2014-91 duly adopted. The detention basin at the corner of 80th Street and East Cemetery Road will need to be inspected and the work paid for before the City will accept the basin. Shane Wicks gave an update about the trail project. There are five working days left. Motioned by Otto, seconded by Beer to approve RESOLUTION 2014-92, A RESOLUTION APPROVING CHANGE ORDER#9 FOR THE FAIRFAX TRAIL PROJECT ALONG EAST SIDE OF UNNAMED TRIBUTARY TO PRAIRIE CREEK, IDOT PROJECT NUMBER STP-E-2462(601) FROM TAYLOR CONSTRUCTION, INC. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2014-92 duly adopted. Discussion was held concerning the City's Long Term Trails Plan. Revisions were suggested. Motioned by Magers, seconded by Beer to approve RESOLUTION 2014-95, A RESOLUTION TO APPROVE CITY OF FAIRFAX'S LONG TERM TRAILS PLAN. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2014-95 duly adopted. Shane Wicks discussed adopting the Cedar Rapids Metropolitan Area Design Standards. He will meet with staff to determine modifications they may want to make before adoption. Motioned by Wainwright, seconded by Beer to introduce and approve the first reading of ORDINANCE 16, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 69 PARKING REGULATIONS. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Wainwright, seconded by Otto to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 16. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Wainwright to approve final passage and adoption with respect to ORDINANCE 16, AN ORDINANCE AMENDING THE FAIRFAX CODE ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 69 PARKING REGULATIONS. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Discussion was held about the speed limit on East Cemetery Road. It is to be 25 mph from Williams Blvd to just east of Driftwood Lane. East of this point it is to be 35 mph. Motioned by Wainwright, seconded by Otto to introduce and approve the first reading of ORDINANCE 17, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 63 SPEED REGULATIONS. Motioned by Wainwright, seconded by Otto to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 17. Motion carried. Discussion was held concerning the Annual Holiday Decoration Contest. This year people are to nominate their own addresses. The list of nominated addresses will be in the December FACTS. People will be asked to vote during the Winterfest on December 13. Cindy Frey asked about ways to keep the cars off of the trail along East Cemetery Road and about placing stop signs on East Cemetery Road at 80th Street.
