HomeMy WebLinkAbout11/11/2014 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING NOVEMBER 11, 2014 The regular meeting of the Fairfax City Council was held Tuesday, November 11, 2014, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright. Other city staff present: Kathy Everett, Cathy Bayne, and Lynn Miller. Motioned by Beer, seconded by Frieden to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. The Mayor explained the September 9, 2014 minutes need to be amended because the wording in the title of Ordinance 15 was incorrect. Motioned by Magers, seconded by Otto to approve the City Council minutes dated September 9, 2014 as amended, and the City Council minutes dated October 14, 2014. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Beer, seconded by Frieden to place on file the Library Board of Trustees minutes dated October 7, 2014 and the Parks and Beautification Committee minutes dated September 18, 2014. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Linn County Deputy Sheriff Egli presented the list of calls. Signal 88 reported that aside from a few open doors, it has been quiet. Cathy Bayne stated the deadbolt locks at the library caused a problem for a group using the community room. Council discussed the ongoing issues with the library locks and doors, and directed the maintenance department to research possible solutions. Fire Chief Mike Sankot reported the 2004 International was sold for $60,000. The fire department wants to use some of the money from the sale to buy a new truck to replace the 1979 grass buggy and the council agreed. They will also need to purchase another new truck but do not have a quote yet. An estimated cost is $520,000. They are applying for a grant for equipment. There will be further discussion at budget time. Lynn Miller stated they have not received the quote for storm sewer work needed in the 2nd Street area east of Driftwood Lane to just north of East Cemetery Road. A resident on Williams Blvd. asked the city to take over plowing the road by his home. Under the current 28E agreement the county plows the road, but it is low priority and snow removal is not done timely. The resident needs to have the snow cleared more quickly due to health issues. Council suggested contacting the county to see if a tradeoff could be arranged. JoAnn Beer reported that the Haunted Trail event was well attended; Parks and the Library worked together at a station on the trail. The Parks department is working on Winterfest planning, and will meet in November. Motioned by Frieden, seconded by Beer to approve the financial reports as submitted. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mike Defoe presented the engineering report. Travis Otto reported that Lance Quigley's driveway was 10' wide before the East Cemetery Road project, and is now 7' wide. Mike will check on it. Kandice Dennis expressed concerns about the speed hump on Church Street. Joe Kell reported on Winterfest activities. The parade route will start at Hawks Ridge Park and end at the Complex on Linn Street. The fire department will provide an escort for parade entrants needing to go from one side of town to the other, before and after the parade. A schedule will be set up. After the parade there will be a tree lighting ceremony at the Complex. The tree will be lighted, but no other decorations will be used. Help may be needed to clear snow from the parking lot at the Complex before the event. The Coalition is preparing a Winterfest brochure to mail to all Fairfax residents. The Coalition will provide materials and labor to prepare the mailing and would like the city to use its postage permit and pay postage costs. Motioned by Wainwright, seconded by Magers for the city to pay the postage costs for mailing the Winterfest brochure using the city's postage permit. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Kandice Dennis expressed concerns about the rezoning of her property at 519 Williams Blvd. that occurred in 2012 when the city updated the zoning map. Letters were sent to all residents whose property was affected, public hearing notices were published, and there was an article in the Fairfax Facts about the proposed rezoning. Kandice said they did not receive a notification letter. Council explained it would be necessary to go through the rezoning process if they want to change their zoning. The Mayor presented information from Hall & Hall showing the storm at the end of June created runoff volume much greater than the drainage systems would have been able to handle, even if all were operating as designed. Possible options were discussed but no action was taken. FEMA has reviewed all of the sites affected by the storm and will be working with the city to complete the necessary paperwork. Council discussed issues with East Southview Road from Highway 151 to Williams Blvd. related to the Special Use Permit Request filed with Linn County on behalf of K& B Ag Supply. Linn County wants to close the road and the city wants it to remain open. No action was taken. Council discussed the commercial sign permit process and concluded the sign ordinance permit requirement doesn't apply to changes made to an existing sign unless the structure is changed, so Jared TeBockhorst will not be required to obtain a Commercial Sign Permit. The status of the sewer work at Meadow Oak was discussed. Fairfax State Savings Bank has asked to be added to the locations approved to sell Fairfax garbage tags. Motioned by Magers, seconded by Beer to allow any business inside the Fairfax city limits to sell Fairfax garbage tags, and council approval is not required. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Potential projects requiring bonding were discussed; the new fire department vehicle, Water Main Replacement Phases 4 and 5, and Street Improvements. Lynn also brought up possible water line improvements in the 80th Street area. Mike Defoe suggested scheduling survey work for December 2014 before winter weather sets in, for the Water Main Replacement Phases 4 and 5 and Street Improvements projects. Mike estimated the cost of the survey work would be $10,000. Motioned by Wainwright, seconded by Otto to authorize Hall & Hall Engineers to do the survey work needed for the Water Main Replacement Phases 4 and 5, and Street Improvements projects, at a cost not to exceed $10,000. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mike Defoe stated the Phase 2 East Cemetery Road Street Reconstruction, Trail, and Drainage Improvements Project is mostly completed. Seeding will be done in the spring. Hall & Hall has not received the signed pay application from Rathje Construction but recommend approval pending receipt of the signed pay application. Motioned by Wainwright, seconded by Otto to approve RESOLUTION 2014-96, A RESOLUTION TO APPROVE PAY APPLICATION NO. 7 FROM RATHJE CONSTRUCTION, CO. FOR THE PHASE 2 EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL, AND DRAINAGE IMPROVEMENTS PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA,pending receipt of the signed pay application from Rathje Construction, Co. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2014-96 duly adopted. Mike Defoe reported there is a shared jurisdiction with Alliant Energy for some of the street lights along East Cemetery Road. It was originally thought Linn County REC was responsible for all of the lights. The council chose the Linn County REC cobra head style lights on new wood poles. Mike will contact Alliant Energy about installing lights in their jurisdiction and report back to the council at the December 9 meeting. Motioned by Frieden, seconded by Magers to approve RESOLUTION 2014-97, A RESOLUTION DIRECTING LINN COUNTY RURAL ELECTRIC COOPERATIVE TO PROCEED WITH INSTALLATION OF STREET LIGHTS ALONG EAST CEMETERY ROAD IN CONNECTION WITH THE PHASE 2 EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL AND DRAINAGE IMPROVEMENTS PROJECT IN FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2014-97 duly adopted. Motioned by Magers, seconded by Wainwright to approve RESOLUTION 2014-98, A RESOLUTION TO APPROVE PAY APPLICATION NO. 9 FROM TAYLOR CONSTRUCTION, INC. FOR THE FAIRFAX TRAIL ALONG EAST SIDE OF UNNAMED TRIBUTARY TO PRAIRIE CREEK BETWEEN EAST CEMETERY ROAD AND FRONT STREET PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2014-98 duly adopted. Motioned by Wainwright, seconded by Beer to introduce and approve the first reading of ORDINANCE 18, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 65 STOP OR YIELD REQUIRED REGULATIONS. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Wainwright, seconded by Beer to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 18. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Frieden, seconded by Beer to approve final passage and adoption with respect to ORDINANCE 18, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 65 STOP OR YIELD REQUIRED REGULATIONS. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: Magers. Motion carried. Motioned by Magers, seconded by Frieden to approve RESOLUTION 2014-99, A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE PAYMENT OF DEBT FEES AND INTEREST DUE DECEMBER 1, 2014. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2014-99 duly adopted. Motioned by Magers, seconded by Beer to set a date for a public hearing for a budget amendment at the December meeting. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Motioned by Wainwright, seconded by Otto to approve the Annual TIF Report. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Motioned by Frieden, seconded by Beer to approve the issuance of a new Class C- Beer/Sunday Sales/Class LE-Liquor/Class B-Wine/Class B-Native Wine license to Casey's General Stores. Motioned by Magers, seconded by Otto to approve renewal of the American Legion PEKOMY Post 4572's Class C Liquor License with Sunday Sales, pending dram coverage.
