SPECIAL CITY COUNCIL MEETING
DECEMBER 4, 2014
The special meeting of the Fairfax City Council was held Thursday, December 4, 2014,
at Fairfax City Hall. Mayor Rabe called the meeting to order at 6:30 PM. Council members
present: JoAnn Beer, Bernie Frieden, Travis Otto, and Marc Magers. Marianne Wainwright was
absent. Other city staff present: City Engineer Mike Dufoe, Cynthia Stimson, Dave Yanecek,
and Lynn Miller.
Motioned by Magers, seconded by Otto to approve the agenda. Ayes: Beer, Frieden,
Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried.
Discussion was held about the easements and agreements presented. Everything is in
order as requested by the City of Fairfax. Mike Dufoe recommended approval.
Motioned by Otto, seconded by Beer to approve RESOLUTION 2014-100, A
RESOLUTION ACCEPTING EASEMENTS ON A PORTION OF THE PROPERTY
LOCATED AT LOT 148 OF PRAIRIE VIEW ESTATES, PART TWO TO THE CITY OF
FAIRFAX, LINN COUNTY, IOWA IN CONNECTION WITH THE MEADOW OAK
ADDITION IMPROVEMENTS. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers.
Nays: none. Absent: Wainwright. Motion carried. Mayor Rabe declared RESOLUTION
2014-100 duly adopted.
Discussion was held about a field tile. This will not be the City's responsibility.
The list of items to complete for the public improvements was discussed. Shane should
have revised bonds by Tuesday morning.
Motioned by Magers, seconded by Otto to approve RESOLUTION 2014-101, A
RESOLUTION ACCEPTING THE PUBLIC IMPROVEMENTS FOR THE MEADOW
OAK ADDITION, LOT 148 OF PRAIRIE VIEW ESTATES, PART TWO TO THE CITY
OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, and
Magers. Nays: none. Absent: Wainwright. Motion carried. Mayor Rabe declared
RESOLUTION 2014-101 duly adopted.
Discussion was held about issuing temporary and final occupancy certificates for this
area. They are unable to have all of the outside lot work completed in the areas yet to have a
building constructed. The work around the specific building will need to be completed before a
final occupancy certificate is issued. The requirement for a tree in each front yard was discussed.
Shane's final landscape plan will be on Tuesday's agenda for review.
Their crews will be working on the final items needed for the temporary certificate on
Friday. They will call when ready for an inspection. The street sign has been ordered and Shane
has agreed to reimburse the City of Fairfax for the sign and post. Shane was asked to make sure
that the street is kept open once someone moves into a unit. This will be needed for resident
travel as well as emergency vehicles.
Motioned by Otto, seconded by Magers to adjourn the meeting. Ayes: Beer, Frieden,
Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried.
Mayor Rabe adjourned the meeting at 6:55 PM.
