Home My WebLink About12/09/2014 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING DECEMBER 9, 2014 The regular meeting of the Fairfax City Council was held Tuesday, December 9, 2014, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:01 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, and Marianne Wainwright. Marc Magers was absent. Other city staff present: Cynthia Stimson, Dave Yanecek, Cathy Bayne, and Lynn Miller. Motioned by Beer, seconded by Frieden to approve the agenda. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Motioned by Frieden, seconded by Otto to approve the City Council minutes dated November 11, 2014, and December 4, 2014. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Motioned by Otto, seconded by Beer to place on file the Library Board of Trustees minutes dated November 4, 2014 as well as the Parks and Beautification Committee minutes dated October 16, 2014, and November 20, 2014. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Linn County Deputy Sheriff Egli presented the list of calls. Signal 88 distributed a form residents can fill out to have their house checked while they are away. The Linn County Sheriff's Department and Signal 88 both provide this free service. Fire Chief Mike Sankot reported that the new grass buggy is here in the building. They have the grant filled out for airpacks. Quotes for storm sewer work near Driftwood Lane were reviewed. Lynn Miller recommended the quote from Ken-Way Excavating, Inc. for $13,062.00 because it is the lowest quote and they will be fusing the piping and will provide a welding certificate. Shane Wicks asked about the size of pipe. Shane believes it is 10 inch, Lynn said it is 8 inch. The quote is for 8 inch. Motioned by Otto, second by Wainwright to accept the quote from Ken-Way Excavating, Inc. for $13,062.00 for the storm sewer work near Driftwood Lane. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Lynn Miller and Dave Yanecek discussed their concerns about some cut brush that is piled along Prairie Creek. This needs to be removed before spring rains. The property owner will be contacted. JoAnn Beer reported that the Parks Committee will be responsible for the Winterfest luminaries and participating in the parade. Parker Krouse read a project list compiled by the Park Committee. The annual report was reviewed. The City Clerk discussed a posting error discovered during the audit, this will be corrected this fiscal year. Motioned by Otto, seconded by Beer to approve the financial reports as submitted. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Shane Wicks reminded the City Council that they still need to accept the detention area near 80th Street and East Cemetery Road, after payment is received for the work performed. Jim Schiltz presented information about the health insurance renewal quote. Discussion was held about the different plans. No decision was made. Mike Goldberg, Linn County EMA Director, gave a presentation about their organization. JR Baines' request to leave a concrete pad at 96 West Cemetery Road was discussed. He plans to pulverize the slab, but not remove the material. It will be covered with dirt and grass so he can mow the area. Motioned by Frieden, seconded by Beer to allow JR Baines to amend the requirements of the site plan for 96 West Cemetery Road to allow him to pulverize the slab, but not remove the material, as long as dirt and grass is placed over the material. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Information was gathered from various departments about their budget requests for the next fiscal year. Quotes to fix the library doors were reviewed. Motioned by Wainwright, seconded by Otto to accept the quote from John's Lock and Key for $2,822.45 for work on the library doors. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. The tree is up at The Complex. It will have lights placed on it and lite after the Winterfest Parade. Motioned by Beer, seconded by Otto to approve RESOLUTION 2014-102, A RESOLUTION SETTING A PUBLIC HEARING DATE FOR ADOPTING THE LINN COUNTY MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN 2014-2019. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2014-102 duly adopted. Motioned by Beer, seconded by Otto to approve RESOLUTION 2014-103, A RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON A REZONING REQUEST. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2014-103 duly adopted. Motioned by Wainwright, seconded by Frieden to approve RESOLUTION 2014-104, A RESOLUTION APPROVING A COMMERCIAL REAL ESTATE PURCHASE AGREEMENT BETWEEN THE CITY AND WILLIAM G AND JEANNE T. GIBNEY TRUST, ESTABLISHED MARCH 20, 2000 FOR VACANT GROUND LOCATED WESTERLY OF CITY PARK, FAIRFAX, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2014-104 duly adopted. Information from ITC about trees they want to remove was discussed. Lynn Miller was instructed to contact ITC and inform them that the City of Fairfax does not want the trees removed. Motioned by Frieden, seconded by Beer to approve RESOLUTION 2014-105, A RESOLUTION TO APPROVE THE FINAL PAY APPLICATION FROM RAY'S EXCAVATING, LLC FOR STREAM CHANNEL FLOOD REPAIR WORK. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2014-105 duly adopted. FEMA continues to work on the paperwork concerning our expense claims. Discussion was held about the flooded business properties in the Karal's area. Mayor Rabe will initiate enforcement action to bring the Vance's Storage area into compliance with the original site plan. Motioned by Beer, seconded by Otto to approve RESOLUTION 2014-106, A RESOLUTION ACCEPTING MAINTENANCE BONDS FOR THE MEADOW OAK ADDITION, LOT 148 OF PRAIRIE VIEW ESTATES, PART TWO TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2014-106 duly adopted. Discussion was held about the landscaping plan for the Meadow Oak Addition. Shane Schrader will be contacted about possible revisions. No action was taken on their current plan. Shane Wicks discussed the proposed layout of Prairie Creek Estates 7th Addition's Plan of Improvements. If the future plans call for anything more than duplexes, the plan will be submitted back through the Fairfax Planning and Zoning Commission. Revisions are to be made to the Plan of Improvements. Bond planning was discussed. The City Council does want to do some projects in addition to the fire truck purchase. Speer Financial will be contacted about the quickest bonding timeline. Shane Wicks gave an update on the Phase 2 East Cemetery Road Area Improvements Project. A driveway needs to be widened, the IDOT will be contacted about signage at the intersection with Williams Blvd., estimates will be gotten for a drainage area, and the light poles in the Alliant area are still being discussed. Motioned by Frieden, seconded by Wainwright to approve RESOLUTION 2014-107, A RESOLUTION TO APPROVE PAY APPLICATION NO. 10 FROM TAYLOR CONSTRUCTION, INC. FOR THE FAIRFAX TRAIL ALONG EAST SIDE OF UNNAMED TRIBUTARY TO PRAIRIE CREEK BETWEEN EAST CEMETERY ROAD AND FRONT STREET PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2014-107 duly adopted. Discussion was held about opening up the new trail and pedestrian bridge. It was suggested to have the City's insurance agent and attorney review the proposed Hold Harmless Agreement. Motioned by Frieden, seconded by Beer to approve RESOLUTION 2014-108, A RESOLUTION TO ENTER INTO A HOLD HARMLESS AGREEMENT WITH TAYLOR CONSTRUCTION, INC. CONCERNING THE TRAIL AND PEDESTRIAN BRIDGE PROJECT, pending approval by the City's insurance agent and attorney. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2014-108 duly adopted. Motioned by Beer, seconded by Otto to approve RESOLUTION 2014-109, A RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S PROPOSED AMENDMENT TO THE FISCAL YEAR 2014-2015 BUDGET. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2014-109 duly adopted. Travis Otto asked if some sort of crosswalk will be painted across Front Street from the trail. The storm sewer work was discussed. The entire area to be replaced has blockage or settlement. The city clerk reminded everyone that she will be gone to a conference at the time of the regular January meeting. Budget work discussion will not be held until the special meeting later in January.
