HomeMy WebLinkAbout01/13/2015 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING JANUARY 1.3, 2015 The regular meeting of the Fairfax City Council was held 'ruesday, January 13, 2015, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members present. JoAnn Beer, Bernie Frieden, Marc Magers, and Marianne Wainwright, Travis Otto was absent. Other city staff present: Kathy Everett, Dave Yaneeek, and Lynn Miller. Motioned by Beer, seconded by Magers to approve the agenda with corrections. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Beer, seconded by Frieden to approve the City Council minutes dated December 9, 2014. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Magers, seconded by Frieden to place on file the Library Board of Trustees minutes dated December 2, 2014, and January 6, 2015, as well as the Planning and Zoning minutes dated December 16,2014. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Linn County Deputy Sheriff Lamere presented the list of calls. There was discussion of the break-ins at City Hall and the Library in December. Signal 88 discussed a report of cars broken into on Sunset Drive last weekend. The company will soon have new patrol vehicle in service, a Jeep. Quotes to replace the library entrance doors damaged during the break-in were reviewed. Lynn Miller said Liberty Doors could deliver new doors sooner so he recommended accepting their quote. Motioned by Magers, seconded by Beer to approve the quote from Liberty Doors, Inc. for $4,939.00 for new library front entrance doors. Ayes: Beer,Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Lynn Miller reported the Fire Department has been busy with calls, and a new truck has been ordered. The Maintenance Department has been working on replacing street signs and snow removal. JoArm Beer reported that the Parks Committee discussed priorities for 2015 at their last meeting. Motioned by Magers, seconded by Wainwright to approve the financial reports as submitted. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent. Otto. Motion carried. Mayor Rabe opened the public hearing concerning the re-zoning request for 620 Church Street from 9RS to 3RM at 7:12 PM. The city clerk's office has not received any comments. Joe Kell stated the Planning and Zoning Commission voted not to approve the request at the December 16 meeting due the Hurts absence and the resulting lack of information. The Hurts held a meeting January 5 at the library community room and were able to address questions and concerns. Tim McKeever attended the meeting, stated he was impressed by their plans and said he has concerns about the building remaining vacant. Joe Kell suggested a zoning classification of 5 RM would limit the lot to 6 units and would be preferable to 3RM. The Mayor stated the city attorney has advised against Council approving a zoning classification that was not listed on the original application. Mayor Rabe closed the public hearing at 7:21. 13M., The Hurts rescinded the request to rezone the property at 620 Church Street from 9RS to 3RM. Mayor Rabe opened the public licaring concerning the Linn County Multi-Jurisdictional I lazard Mitigation Plan 2014-2019 at 7:24 PM. The city clerk's office has not received any comments. No one was present to triake any comments on this topic. Mayor Rabe closed the public bearing at 7:24 PM. Motioned by Magers, seconded by Frieden to approve RESOLUTION 2015-0.1.,.A RESOLUTION ADOPTING THE LINN COUNT Y ,ml.]I,TI-J'(JR1,S,D,ICTIONA.tI HAZARD MITIGATION PLAN 2014-201.9. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright, N"ays, none. Absent: Otto. Motion carried.. Mayor Rabe declared RESOLUTION 2015-01 duly adopted. The resident at 401 Prairie View Drive has asked the city to repair the concrete around a manhole in his driveway. When the driveway was poured, the manhole was covered with cement which was later removed from the manhole to allow access. The surrounding section of cement has settled and the manhole extends above the surface of the concrete. After discussion, council agreed to share the cost to repair the concrete with the homeowner, but any future repairs will be the homeowner's responsibility. A resident has requested a change to the parking regulations on Commercial Court. Parking is currently prohibited on both sides of the street. After discussion, council questioned whether parked cars might interfere with fire trucks being able to turn onto nearby streets. The Fire Chief will be consulted and council will reconsider the request at their February meeting. Joe Kell reported the inaugural Winterfest was a success with community involvement and support from local businesses. He believes the event will grow each year, and suggested the city consider planting a tree at the Complex to be used as the city Christmas tree. Drainage issues related to areas affected by the June flood were discussed. The Mayor and city engineer will meet with a property owner to discuss changes that need to be completed by April 1, 2015 to improve drainage for neighboring properties. An agreement could be reached before the February council meeting. Quotes for a security system at city hall,the library, and the maintenance shop were reviewed. The owner of Absolute Security, Scott Schneider, was present to answer questions. Concerns about the security of the city's water utility system were also discussed. Motioned by Magers, seconded by Frieden to approve the quotes from Absolute Security for installation and monitoring of alarm systems at the city buildings,with the addition of security for the water utility system. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. The employee health insurance renewal options and costs were discussed. Motioned by Magers, seconded by Frieden to renew the current health insurance plan, Wellmark PremierBlue 750, with the city continuing to pay the full premium for employee coverage. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Budget issues were discussed, including the payment schedule for the new fire truck. A special council meeting is to be held January 27 at 6:00 PM at city hall. Motioned by Frieden, seconded by Magers to approve RESOLUTION 201502,A RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON VACATING AN UTILITY EASEMENT. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: none. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2015-02 duly adopted. The fire department vehicle has been ordered and. the bond will be in place before the first payment is due. Water Main Replacement Phases 4 and 5 cost estimates were reviewed.. Lost money could be used for street iniprovenients. The status of the Phase 2 East Cemetery Road Area Improvements was discussed. There are a few items left on the punch list, including street signs. Mr. Quigley's driveway needs to be widened. A revised landscaping plan for the Meadow Oak Circle development was reviewed. Motioned by Wainwright, seconded by Frieden to approve the revised landscaping plan for the Meadow Oak Circle Development. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Shane Wicks discussed.a new ADA requirement for sidewalk widths. The new regulation requires a 5'x 5' landing space every 200 feet, Rather than requiring 5' sidewalks, an alternative was suggested, to require a 5' sidewalk within the driveways. It is the Council's wish that all new sidewalks installed in the City of Fairfax meet this requirement. The Trail and Pedestrian Bridge project will not be completed until seeding is done in the spring. Signs have been ordered. Based on recommendations from the city's attorney and insurance agent, the Hold Harmless Agreement will be revised before acceptance by the city. The council discussed the Shared Road Maintenance and Winter Snow&Ice Control Agreement with Linn County Secondary Road Department, and made a slight change to the language of the agreement. The city will follow up with Linn County regarding the language change before action is taken to approve the agreement. Motioned by Magers, seconded by Beer to reappoint Jamie Meyers to the Fairfax Planning and Zoning Commission. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None, Absent: Otto. Motion carried. JoAnn suggested discussion of whether there is a need for a city administrator/manager at the budget meeting. Mike Nemeth, owner of Nemeth Energy Solutions discussed the possibility of incorporating solar systems into city buildings. Mike said tax credits could be used to provide cost savings for solar systems in green spaces that would generate revenue. Motioned by Beer, seconded by Frieden to adjourn the meeting, Ayes: Beer, Frieden, Magers, and Wainwright. Nays. None. Absent: Otto. Motion carried. Mayor Rabe adjourned the meeting at 9:12 PM.
