Home My WebLink About02/10/2015 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING FEBRUARY 10, 2015 The regular meeting of the Fairfax City Council was held Tuesday, February 10, 2015, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:01 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, and Marc Magers. Marianne Wainwright was absent. Other city staff present: Cynthia Stimson, Cathy Bayne, Mike Sankot, Dave Yanecek, and Lynn Miller. Shane Wicks, president of Hall and Hall Engineers, Inc. was also present. Motioned by Magers, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: None. Motion carried. Motioned by Beer, seconded by Frieden to approve and place on file the City Council minutes dated January 13 and 27, 2015. Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: None. Motion carried. Motioned by Beer, seconded by Frieden to place on file the Library Board minutes dated February 3, 2015, and the Planning and Zoning Commission minutes dated January 27, 2015. Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: None. Motion carried. Doug Mueller, with Signal 88, stated that they have been seeing some juveniles out after curfew. Cathy Bayne stated that the library staff have been trained about the security system. Mike Sankot stated that the fire department does not want to allow parking on Commercial Court because that would have it difficult, if not impossible, to get emergency vehicles through that area. He requested that the City make sure future streets are wide enough for parking and emergency vehicles. Motioned by Frieden, seconded by Otto to approve RESOLUTION 2015-07, A RESOLUTION AUTHORIZING THE PURCHASE OF A 2015 PIERCE IMPEL PUMPER FIRE TRUCK. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-07 duly adopted. Lynn Miller reported that the maintenance department has been working on getting the security systems installed. Work has begun on the storm sewer east of Driftwood Lane. JoAnn Beer reported the Parks Committee is working on planning the Easter Egg Hunt. Motioned by Magers, seconded by Otto to approve the financial reports, including the annual audit for FY14. Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: None. Motion carried. Shane Wicks informed the City Council that Mike Dufoe now works for the IDNR and that they have made a rate adjustment for 2015. Mayor Rabe opened the public hearing concerning revisions to the City of Fairfax's Comprehensive Plan's Future Land Use Map at 7:08 PM. It was discussed why this was necessary. No one had any other comments. The city clerk's office had not received any oral or written comments. Mayor Rabe closed the public hearing at 7:10 PM. Motioned by Magers, seconded by Frieden to approve RESOLUTION 2015-08, A RESOLUTION TO ADOPT A REVISED FUTURE LAND USE MAP FOR THE CITY OF FAIRFAX. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-08 duly adopted. Mayor Rabe opened the public hearing concerning a re-zoning request for 620 Church Street from 9RS to 5RM at 7:11 PM. No one had any comments. The city clerk's office had not received any oral or written comments. Mayor Rabe closed the public hearing at 7:12 PM. Motioned by Beer, seconded by Frieden to introduce and approve the first reading of ORDINANCE 20, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY, NOW KNOWN AS: LOTS 25, 26, 27, AND 28, IN GIDDINGS ADDITION TO VANDERBILT, NOW FAIRFAX, LINN COUNTY, IOWA FROM 9RS: SINGLE FAMILY RESIDENTIAL TO 5RM: MULTIPLE-FAMILY RESIDENTIAL DISTRICT. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: none. Motion carried. Motioned by Otto, seconded by Magers to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 20. The proposed action schedule, projects, and repayment options were discussed. The city council directed Maggie to begin the process as planned. She will check into TIF availability through the 12-year maturity. Utility rates were reviewed. The sewer rate needs to be raised to cover the bonding requirements and on-going expenses. Linn County Sheriff Deputy Daubs presented the list of calls. A break-in at the post office was discussed. Shane Schrader discussed his plans to have a 240 acre parcel annexed into the City of Fairfax and begin a residential development. He is working on the concept drawings and they should be ready for the next City Council meeting. Motioned by Frieden, seconded by Beer to approve the planning process to begin for this new annexation and development. The not to exceed amount for the City's planning process is $100,000. Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: None. Motion carried. Mayor Rabe and Lynn Miller reviewed information from ITC about their tree removal request. Motioned by Magers, seconded by Otto to approve ITC's plans for tree removal. Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: None. Motion carried. Mayor Rabe and Shane Wicks discussed plans for improvements to the drainage system at Vance Storage and the surrounding area. Melody Vance has agreed to make the required improvements to bring the site back to the approved specifications. The City of Fairfax wants to partner to make more improvements for drainage in the area. We are suggesting a 20 foot wide drainage area with a concrete bottom. Fences will need to be moved. Shane Wicks presented a cost estimate of$66,000. Easements and maintenance agreements were discussed. Jeff Iben's plans for Prairie Creek 7th Addition were discussed. If the utility lines are laid during the winter, the warranty bond will need to be extended to six years. The street name of Ridge View will be used for all of the condo area. They will be placing gravel for a turnaround area beyond the paving for the first set of houses. Jeff Iben will be responsible for maintenance. The fire hydrant will be placed so emergency vehicles can access it easily. Motioned by Magers, seconded by Otto to approve RESOLUTION 2015-09, A RESOLUTION TO PROCEED WITH THE PUBLIC IMPROVEMENTS TO PRAIRIE CREEK ESTATES SEVENTH ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-09 duly adopted. No action was taken on the road maintenance agreement. Motioned by Beer, seconded by Frieden to approve RESOLUTION 2015-10, A RESOLUTION APPROVING THE CONTRACT FOR LAW ENFORCEMENT SERVICE WITH LINN COUNTY AND THE LINN COUNTY SHERIFF'S DEPARTMENT FOR FISCAL YEAR 2015-2016 BUDGET. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-10 duly adopted. Phase 1 of the East Cemetery Road Area Improvements still has drainage swale and access road work to complete. Phase 2 of the East Cemetery Road Area Improvements has a punch list, signs, and a pay application pending. There is additional work to complete at Fred Wood's address and Arp's ditch/culvert. It was determined that most of the pile of dirt will be used for the project, Arps, or the City of Fairfax. Some of the street lights will have to be placed by Linn County REC and others by Alliant Energy, since they share the area. The Release Agreement between the City of Fairfax and Taylor Construction has been signed for the Trail Project. Discussion was held about possible changes in seeding specifications. Shane Wicks stated that they are working on the specifications, forms, and estimate for the UV sewer treatment upgrade. The timeline to complete the Water Main Replacement Phases is bid in May, start in June, seeding by the end of September. Motioned by Magers, seconded by Beer to approve RESOLUTION 2015-11, A RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT FOR PHASES 4 AND 5 WATER MAIN REPLACEMENT PROJECT. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-11 duly adopted. A special census was discussed. It was decided not to do one at this time. Motioned by Magers, seconded by Otto to approve RESOLUTION 2015-12, A RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S PROPOSED AMENDMENT TO THE FISCAL YEAR 2014-2015 BUDGET. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Absent: Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-12 duly adopted. Nays: None. Motion carried. The resident from 711 Commercial Court requested the City reconsider placing at least two parking spaces on Commercial Court near his house. The fire department will test the large truck in the area. Discussion was held about certifications available for a building inspector. Motioned by Magers, seconded by Beer to adjourn the meeting.
