Home My WebLink About04/14/2015 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING APRIL 14, 2015 The regular meeting of the Fairfax City Council was held Tuesday, April 14, 2015, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, and Travis Otto. Marc Magers and Marianne Wainwright were absent. Other city staff present: Cynthia Stimson, Dave Yanecek, and Lynn Miller. Shane Wicks, president of Hall and Hall Engineers, Inc. was also present. Motioned by Frieden, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, and Otto. Nays: None. Absent: Magers, and Wainwright. Motion carried. Motioned by Otto, seconded by Beer to approve and place on file the City Council minutes dated March 10, 2015 and April 2, 2015. Ayes: Beer, Frieden, and Otto. Nays: None. Absent: Magers, and Wainwright. Motion carried. Marianne Wainwright entered the meeting at 7:03 PM. Doug Mueller, with Signal 88, stated that they have noticed several garage doors open and want to remind people to close them. The fire department has been busy and is working on getting the grass buggy fully set-up. The maintenance department started flushing hydrants on Monday. The city clerk's office has received calls about rusty water. Lynn Miller reported that the City of Fairfax hired LL Pelling to do street sweeping and they did a fantastic job. The maintenance department has some items to sell. These will be advertised locally for sealed bids. JoAnn Beer reported that the Easter Egg Hunt was a success. Motioned by Frieden, seconded by Beer to approve the financial reports as submitted. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: None. Absent: Magers. Motion carried. Discussion was held with Steve Smith, from Johnson County Refuse, about the solid waste contract. Changes will be made about bulk item collections and pricing. A revised contract will be reviewed during the May meeting. Discussion was held concerning the quotes received for drainage improvements in the Karat's Additions. The quotes are higher than the engineer's estimate. Dave Schmitt Construction submitted the lowest quote. The City Council wishes to accept this quote,pending obtaining signed easement agreements from all of the property owners. Motioned by Frieden, seconded by Otto to approve RESOLUTION 2015-22, A RESOLUTION TO APPROVE A QUOTE FOR DRAINAGE IMPROVEMENTS IN THE KARAL'S ADDITIONS IN THE CITY OF FAIRFAX,LINN COUNTY,IOWA. No action was taken regarding the commercial building permit applications from EIB. Linn County Deputy Sheriff Tim Daubs presented the list of calls. A report of a dirt bike on the street was discussed. Estimates for the required work on Southview Road were discussed. Linn County is requiring this work as part of the Special Use Permit process for K& B Ag's request. K& B Ag has agreed to pay one half of the costs involved to do the required work. Motioned by Frieden, seconded by Otto to approve RESOLUTION 2015-28, A RESOLUTION APPROVING A ROAD AGREEMENT FOR CONDITIONAL USE PERMIT, C- 10-14, ON SOUTHVIEW ROAD BETWEEN THE CITY OF FAIRFAX, K& B AG SUPPLY, LLC.,AND LINN COUNTY SECONDARY ROAD DEPARTMENT. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2015-28 duly adopted. Mike Nemeth, from Nemeth Energy, gave a presentation about solar power and how it may help reduce energy costs at three selected City of Fairfax properties. The process about development planning and annexation were discussed. Two concept plans from Shane Schrader were reviewed. Motioned by Otto, seconded by Frieden to approve the commercial sign permit application from Royale Pools. Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Patrick Slater gave a presentation about 2015 USA Days. The committee is requesting that golf carts be allowed to go over the trail bridge for USA Days. The City will provide them with our IDOT contact so they can look into the approval process. Motioned by Beer, seconded by Otto to give $3,500.00 to the USA Days Committee for event support. Motioned by Otto, seconded by Beer to close part of Linn Street between the two parks for USA Days activities on Saturday, June 27, pending fire department approval. Patrick Slater discussed his request for a four-way stop and crosswalk at Vanderbilt Street and Main Street. Motioned Otto, seconded by Beer to approve RESOLUTION 2015-29, A RESOLUTION TO FIX A DATE FOR A PUBLIC HEARING ON A LEASE-PURCHASE AGREEMENT IN THE PRINCIPAL AMOUNT NOT EXCEEDING $50,042.65 FOR THE PURPOSE OF ACQUIRING A SKID LOADER. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2015-29 duly adopted. Motioned Beer, seconded by Frieden to approve RESOLUTION 2015-30, A RESOLUTION TO FIX A DATE FOR PUBLIC HEARINGS ON LOAN AGREEMENTS IN A PRINCIPAL AMOUNT NOT TO EXCEED $2,080,000. Motioned Otto, seconded by Beer to approve RESOLUTION 2015-31, A RESOLUTION SETTING DATE FOR PUBLIC HEARING ON 2015 AMENDMENT TO URBAN RENEWAL PLAN FOR FAIRFAX URBAN RENEWAL AREA. The quotes for the park along Driftwood Lane were discussed. No exercise equipment will be placed here. A specific type of swing is to be requested. This information will be reviewed during the special meeting on April 28. Motioned by Frieden, seconded by Otto to introduce and approve the first reading of ORDINANCE 22, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 99, SEWER SERVICE CHARGES. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Motioned by Wainwright, seconded by Otto to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 22. Motioned by Frieden, seconded by Otto to approve final passage and adoption with respect to ORDINANCE 22, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 99, SEWER SERVICE CHARGES. Discussion was held about street design near the Fairfax Dairy Queen after the IDOT bridge project. The Veteran's Memorial will need to be moved for the best street design. The American Legion will be contacted for input. Shane Wicks was directed to tell the IDOT and Snyder and Associates that the City of Fairfax does want a trail underpass as part of one of the bridge projects to promote connectivity in the trail system. The dirt pile, Stark's gate connection, and Fred Woods' area drainage intake are items on the punch list for Phase 1 East Cemetery Road Area Project. LL Pelling will be out to paint the Phase 2 area tomorrow. A bid tab was reviewed for miscellaneous projects along East Cemetery Road. The new bids were too high and were not accepted for the proposed work. Contract pricing will be used, where possible. Quigley's will be contacted to see if they want the City's contractor to complete their driveway work or if they will be hiring someone else. Seeding of the trail and pedestrian bridge area should happen next week. A revised design of the Vanderbilt Street Reconstruction Project was reviewed. The work will stop at the current seal coat area with the trail on the west side. The Prairie Creek Estates 7th Addition was discussed. Installation of drain tile is to be added to the conditions of acceptance. Motioned Frieden, seconded by Beer to approve RESOLUTION 2015-32, A RESOLUTION TO PROCEED WITH THE PUBLIC IMPROVEMENTS TO PRAIRIE CREEK ESTATES SEVENTH ADDITION TO THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Motioned Wainwright, seconded by Beer to approve RESOLUTION 2015-33, A RESOLUTION AMENDING THE 28E AGREEMENT BETWEEN LINN COUNTY AND CITY OF FAIRFAX FOR BUILDING CODE SERVICES. Roll call vote: Ayes: Beer, Frieden, Otto, and Wainwright. Nays: none. Absent: Magers. Motion carried. Mayor Rabe declared RESOLUTION 2015-33 duly adopted. Several quotes for concrete work were reviewed. Motioned by Beer, seconded by Otto to approve the following concrete bids from Century Construction: • Concrete city sidewalk along Driftwood Lane for $2,480.00 • Concrete approach on from the Complex to Linn Street for $2,808.00 • Concrete city sidewalk along Wild Rose for $400.00 • Concrete city sidewalk connecting Meadow Oak development to Prairie View Drive for $24,858.00 • And concrete handicapped access at the Prairie Creek Park parking lot Ayes: Beer, Frieden, Otto, and Wainwright. Discussion was held about the city-wide clean-up project location. Two properties will checked on to see if they are available. The area along the Star Bar on Church Street was reviewed for placement of a bike rack. The Star Bar will purchase the rack. The no parking sign would need to moved east one space. Motioned by Wainwright, seconded by Frieden to allow the placement of a bike rack in this area. Ayes: Beer, Frieden, and Wainwright. Nays: None. Absent: Magers. Abstain: Otto. Travis Otto abstained because he is the owner of the Star Bar. Motion carried.
