CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING MAY 12, 2015 The regular meeting of the Fairfax City Council was held Tuesday, May 12, 2015, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers and Marianne Wainwright. Other city staff present: Cynthia Stimson, Dave Yanecek, and Lynn Miller. Shane Wicks, president of Hall and Hall Engineers, Inc. was also present. Motioned by Magers, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Beer, seconded by Frieden to approve and place on file the City Council minutes dated April 14, 2015 and April 28, 2015. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Beer, seconded by Frieden to place on file the Library Board of Trustees minutes dated April 7, 2015 and the Parks and Beautification Committee minutes dated March 19, 2015. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Linn County Deputy Sheriff Egli presented the list of calls. Marc Magers asked them to check parking along Linn Street during FYSA activities. People are parking in no parking zones. The Deputy was informed that this Saturday is Fairfax's city-wide garage sale day. Doug Mueller, with Signal 88, requested a street light be placed at the intersection of Longview and W Cemetery Road. Linn County REC will be contacted. A construction trailer was recently broken into. No one from the library was present as they are also having their board meeting tonight. Mike Sankot reported that the fire department has been working on the specs for the new truck. They will be finalized with the company by June 1. Two bids were received for the F250 pickup. The first one opened was from Mary Blangy for $600.00 and the second one was from Mike Sankot for $500.00. Motioned by Beer, seconded by Magers to accept the bid of$600.00 from Mary Blangy, pending staff checking on the scrap value of the truck. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. No bids were received for the street sweeper. Staff was directed to advertise in a municipal publication. One bid, for $9,200.00 from Ace Electric, Inc., was received for the generator. Motioned by Magers, seconded by Wainwright to accept the bid of$9,200.00 from Ace Electric, Inc. for the generator. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. The fence on the newly purchased park ground was discussed. A bid to replace was reviewed. The City of Fairfax gains no benefit from this fence, it is on City of Fairfax property, and has trees growing through it. The fence is to be removed and not replaced. The adjoining resident is to be informed at least 30 days before the fence is removed. The bridge inspection report was reviewed. Motioned by Otto, seconded by Wainwright to accept the quote from Game Time for an Expression Swing to be placed in the park on Driftwood Lane. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Magers, seconded by Wainwright to approve the financial reports as submitted. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Marc Magers asked about the status of the UV project. Completion is required by the fall of 2016. Mayor Rabe opened the public hearing regarding the 2015 Amendment to the Fairfax Urban Renewal Area Plan at 7:42 PM. The city clerk's office has not received any oral or written comments. No one present had any comments. Mayor Rabe closed the public hearing at 7:43 PM. Motioned by Beer, seconded by Magers to approve RESOLUTION 2015-39, A RESOLUTION TO APPROVE 2015 URBAN RENEWAL PLAN AMENDMENT FOR THE FAIRFAX URBAN RENEWAL AREA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-39 duly adopted. Mayor Rabe opened the public hearing regarding the proposal to enter into a loan agreement in a principal amount not to exceed $1,980,000 at 7:43 PM. Motioned by Frieden, seconded by Beer to approve RESOLUTION 2015-40, A RESOLUTION APPROVING LOAN AGREEMENTS IN PRINCIPAL AMOUNT NOT TO EXCEED $2,080,000 AND AWARDING SALE OF GENERAL OBLIGATION CORPORATE PURPOSE BONDS, SERIES 2015. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-40 duly adopted. Motioned by Wainwright, seconded by Beer to approve RESOLUTION 2015-41, A RESOLUTION ENTERING INTO A SUPPLEMENTAL FINANCIAL SERVICES AGREEMENT WITH SPEER FINANCIAL, INC. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-41 duly adopted. Discussion was held concerning the solid waste contract. The proposed changes were reviewed. A list of bulky items tag requirements was reviewed. The solid waste collection fee will be changed by ordinance during the next meeting. The items list will be approved by resolution during the next meeting. Motioned by Wainwright, seconded by Frieden to approve RESOLUTION 2015-42, A RESOLUTION APPROVING THE WASTE AND RECYCLING COLLECTION AGREEMENT WITH JOHNSON COUNTY REFUSE, INC.. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-42 duly adopted. Daniel and Sandra Hurt were present to ask permission to stay in a camping trailer at their property at 620 Church Street during their construction project. Discussion was held about the ordinance and issues with this property. Motioned by Frieden, seconded by Otto to make an exception to Section 69.10, Paragraph 9. of the Fairfax Code of Ordinances 2012 to allow Daniel and Sandra Hurt to live in their camping trailer at 620 Church Street until October 1, 2015, as long as they don't dump any waste on site. This is being allowed due to the unique character of their lot and construction project. Ayes: Frieden, Otto, Magers, and Wainwright. Nays: Beer. Motion carried. Mark Neuhaus requested permission to use The Complex as the site of a 2015 Leon Evans Cruise In Car Show. He has already contacted FYSA and they will be running the concession stand. Motioned by Magers, seconded by Frieden to approve the 2015 Leon Evans Cruise In Car Show at The Complex on Saturday, October 10, 2015, with a rain date of October 17. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Discussion was held concerning the proposed drainage improvements in the Karal's Addition area. Shane will slightly revise the agreements and have the attorney review them before presenting this revision to the property owners. Two quotes for road work on Southview Road were discussed. It appears that the quotes are not for the exact same work. Motioned by Otto, seconded by Magers to approve the quote from Prairie Road Builders for $22,342.30 for work on Southview Road including double seal coating and base rock, with K&B Ag responsible to pay one half of the costs. Ayes: Beer, Frieden, Otto, and Magers. Nays: none. Marianne Wainwright abstained because she works for LL Pelling, who submitted the alternate quote. Motion carried. Patrick Slater's request for a four-way stop and crosswalk at Vanderbilt Street and Main Street was discussed. The City of Fairfax will be painting one crosswalk, from the bank parking lot corner across Vanderbilt and post the area to yield to pedestrians. Shane Wicks gave an update about Phase 1 of the East Cemetery Road Project. The work by Fred Wood and on Stark's gate will be completed next week. Discussion was held concerning Change Order 45 for Phase 2 of the East Cemetery Road Project. Hall and Hall Engineers, Inc. will be paying the majority of the expense. The City of Fairfax will cover the cost of the concrete per the unit price in the contract. Motioned by Otto, seconded by Beer to approve RESOLUTION 2015-43, A RESOLUTION TO APPROVE CHANGE ORDER NO. 5 FROM RATHJE CONSTRUCTION, CO. FOR THE PHASE 2 EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL, AND DRAINAGE IMPROVEMENTS PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-43 duly adopted. Shane Wicks gave an update about Phase 2. He suggested the City contact Rathje about the disincentive for working days and additional work to complete. Motioned by Otto, seconded by Wainwright to offer a swap of disincentive costs for the additional work. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Motioned by Otto, seconded by Beer to approve RESOLUTION 2015-44, A RESOLUTION TO APPROVE PAY APPLICATION NO. 8 FROM RATHJE CONSTRUCTION, CO. FOR THE PHASE 2 EAST CEMETERY ROAD STREET RECONSTRUCTION, TRAIL, AND DRAINAGE IMPROVEMENTS PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-44 duly adopted. Shane Wicks reported that the seeding at the trail and bridge project should be completed by the end of May. The City of Fairfax will hold an open house on Tuesday, May 19, from 5:30 —7:00 PM about the Water Main Replacement Projects and the Vanderbilt Street Reconstruction Project. Discussion was held about the IDOT's plans for the bridge replacements. Shane and Jason will meet with the IDOT soon to discuss the concept plan. The American Legion has been informed about the need to relocate the Veteran's Memorial. Motioned by Beer, seconded by Otto to approve RESOLUTION 2015-45, A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE PAYMENT OF DEBT PRINCIPLE, INTEREST, AND FEES DUE JUNE 1, 2015. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-45 duly adopted. Motioned by Magers, seconded by Beer to approve RESOLUTION 2015-46, A RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON A REZONING REQUEST. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Mayor Rabe declared RESOLUTION 2015-46 duly adopted. Motioned by Magers, seconded by Frieden to approve the release agreement and severance package offered to Jeff Ammeter. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Discussion was held concerning contracting for sewer Grade III services. Motioned by Magers, seconded by Otto to use Furler Utility Service LLC for sewer Grade III services on a month by month basis until the IDNR informs us exactly what is required going forward. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Motioned by Otto, seconded by Frieden to approve the quote from Absolute Security to add a security camera to capture the walk-in doors at city hall. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: none. Motion carried. Motioned by Magers, seconded by Beer to approve the American Legion's Outdoor Service request for USA Days pending their dram endorsement. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Jamie Strimple, 418 Main Street, discussed their sidewalk project. They will place the five foot sidewalk in the driveway and three foot on either side to meet the existing sidewalk that they are not replacing. The city clerk is registered to attend the Municipal Professional Academy in July in Ames, an updated 2015 Candidates Guide is now available, and the Iowa League of Cities' Annual Conference in Cedar Rapids was discussed. Travis Otto asked that the no parking sign along the Star Bar be moved as previously discussed so that he can have a bike rack installed before USA Days. Marc Magers thanked staff and Mayor Rabe for their efforts with the change in staffing. They are to be commended for their work. Motioned by Frieden, seconded by Magers to adjourn the meeting. It is not a bid. I would prefer to have the city select a contractor to meet their needs and pay for the cost of improving to hard surface and maintaining this road segment as hard surfacing. The Planning requirement is for access to be from a hard surfaced road. The city is willing to make this commitment and is only required to meet our minimum standard of a.sea] coat over a rock base with continued maintenance as a.seal coat. Because the business remains in the unincorporated portion of Linn County, we included the business in the agreement with Fairfax. The estimate was based upon the minimum double seal coat over 12"rock base required to have the county accept the maintenance responsibility in perpetuity. The city's commitment in the agreement allows a lower standard acceptable to the city to be applied. Limn County would not build this lower-standard. Since the property remains in the county jurisdiction, access would need to comply with county standard. We allow one access to the parcel. This access would be restricted to a width at the r-o-w line of 30'. The current access to the business does not appear to comply with this standard. In this case, Ave have the commercial access needs incorporated into the agreement to allow the business operation to dictate the access required to conduct the operation and that is acceptable to the county. The property owner takes responsibility for cost associated with these access needs. It would be the city making any needed repair, and their decision concerning invoicing for damage. Beyond the needs of the property owner,the agreement intends to cover future participation in the railroad crossing and the connection to Highway 151. The county interest in this access to Highway 151 is nil. The current intent is to recommend crossing closure and removal of the portion of the intersection of Southview Road east of Highway 151. The city has another interest. The agreement allows this interest to supersede the county's. After the city has an opportunity to review the agreement and make suggestions concerning changes,the agreement would be updated and changes made. We had obtained our own bids for what we believed the hard surface road requirement was last year. Those bids are attached and will be refreshed for Spring pricing. As you can see, the other bids are much lower than the Linn County cost estimate. I don't wish to negotiate for the city, however, I want to offer some thoughts on the agreement's structure. Can the agreement be restructured to define the hard surface road requirements and allow the City of Fairfax to seek and authorize the vendor of their choice to complete the requirements? Naturally, the Linn County bid would be one available to consider. t In our conversations with the City of Fairfax, K&B has agreed to cost share the project. I would like to gain the city's opinion on the agreement and recommendation for any revisions so we can have a final draft of the agreement available for the April 14, 2015 City Council meeting. Since the city of Fairfax views this differently and has not indicated that they intend to annex this area into their community and remove the road department from the review, an agreement must include the city and the property owner. The city is taking responsibility for building and maintaining the hardsurface between Highway 151 and Williams Blvd. They could have their engineer address the design need for their city street. The estimate of cost is for a 30' top width, 12"rock base and two seal coats. How the property owner shares the cost is up to the city with this approach. The county interest in the agreement is to assure that the road meets the hardsurface requirement and that access and control of right-of- way meet road department standard. The draft agreement does this. We will make changes as the owner and city review and indicate what needs to be included. It may ultimately be needed to have the city and county sign a 28E agreement for the road with the owner limiting the agreement to county requirements for owners use of r-o-w and for payment required to the city for the city's road work.
