HomeMy WebLinkAbout07/14/2015 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING July 14, 2015 The regular meeting of the Fairfax City Council was held July 14, 2015, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, and Marc Magers. Marianne Wainwright was absent. Other city staff present: Cynthia Stimson, Mike Sankot, Dave Yanecek, and Lynn Miller. Cathy Bayne entered later. Shane Wicks and Joel Gross, from Hall and Hall Engineers, Inc. were also present. Motioned by Beer, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Motioned by Frieden, seconded by Otto to approve and place on file the City Council minutes dated June 9, 2015, and June 25, 2015. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Motioned by Magers, seconded by Otto to place on file the Library Board of Trustees minutes dated June 2, 2015, and July 7, 2015; the Parks and Beautification Committee minutes dated May 21, 2015; as well as the Planning and Zoning Commission minutes dated May 19, 2015, and June 16, 2015. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Doug Mueller, with Signal 88, reported that they found someone driving on the grass at The Complex. The city clerk informed them about motorized bikes riding on the trail and bridge. Fire Chief Mike Sankot reported that USA Days went great, although, the fire department did have a fire call that morning. This shows the number of members involved and dedicated to both events. The fireworks were fantastic; we have received many compliments. We have some new junior members. Five previous junior members have now graduated. The new truck should be here the first of November. Motioned by Magers, seconded by Beer to purchase a harrow and pallet jack from Lynn Miller for $250.00. These are items that the City of Fairfax has been using and will have a need to use in the future. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. The playground equipment at Driftwood Lane Park will be installed in August. This will be after the maintenance department is back to full staffing. JoAnn Beer reported that the Parks and Beautification Committee sponsored the Movie in the Park on June 26. They will also be sponsoring "Big Hero 6" at Hawks Ridge Park on August 14. The detention area clean-up near Prairie View Drive will be held on August 15. Motioned by Frieden, seconded by Magers to approve the financials as submitted. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Shane Wicks announced that he will not be at the regular August meeting. Joel Gross will be representing Hall and Hall Engineers. Mayor Rabe opened the public hearing concerning rezoning of the property at 99 East Cemetery Road from AG: Agricultural to 44RS: Single Family Residential at 7:08 PM. No comments have been received by the city clerk's office. The property owner Zach Sobaski asked if anyone had any questions. Travis Otto asked about the driveway placement. Mayor Rabe closed the public hearing at 7:09 PM. Motioned by Frieden, seconded by Otto to introduce and approve the first reading of ORDINANCE 26, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY, NOW KNOWN AS: LOT 2, ARP'S MEADOWS FIRST ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA, FROM AG: AGRICULTURAL TO 44RS: SINGLE FAMILY RESIDENTIAL. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Motioned by Beer, seconded by Frieden to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 26. Motioned by Magers, seconded by Frieden to approve final passage and adoption with respect to ORDINANCE 26, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY, NOW KNOWN AS: LOT 2, ARP'S MEADOWS FIRST ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA, FROM AG: AGRICULTURAL TO 44RS: SINGLE FAMILY RESIDENTIAL. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Don Kleis, from Prairie Road Builders, was present to review the proposed street work list. Travis Otto discussed an area along Vanderbilt Street, near the Star Bar that needs work. Motioned by Magers, seconded by Frieden to approve the proposal of$46,420.87 from Prairie Road Builders for annual road maintenance work. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Discussion was held about a proposal for street work from Kluesner Construction. No action was taken at this time. Linn County Deputy Sheriff Daubs entered at 7:18 PM. He distributed the list of calls for service. Steve Tomash discussed his concerns about grass clippings being blown in the streets. The city will develop a door posting notice for staff to leave when this is noticed. Cathy Bayne entered at 7:23 PM and presented the library report. The council reviewed a quote from Eastern Iowa Building, Inc. for a park storage building. Discussion was held on placement and cost. Motioned by Magers, seconded by Otto to approve the quote with the concrete and electrical options for a total of $42,888.00. Ayes: Beer, Otto, and Magers. Nays: Frieden. Absent: Wainwright. Motion carried. Building Inspector Dave Yanecek reported that he checked the placement of the Casey's sign along Williams Blvd. It is set closer to the property line than allowed by our sign regulations. Based on this information, the City Council discussed allowing the sign for Cross Creek Body Shop to also be placed closer than allowed by sign regulations. Motioned by Otto, seconded by Beer to approve the commercial sign permit application as submitted by Cross Creek Body Shop. The current sign placement, which is within the code required set-back area, is approved, but if the sign is replaced, it must be moved and placed according to the regulations at that time. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe presented a recommendation to hire Brian Merta for the Public Works 11 employee. Mayor Rabe and Lynn Miller interviewed four applicants for the position. Brian's skills and experience made him their hire recommendation. Motioned by Magers, seconded by Frieden to hire Brian Merta as a Public Works II full-time employee as of no later than August 1, 2015, at $20.00 per hour. Incentives for certifications will be determined in the future. This employment offer is contingent on a satisfactory result on a pre-employment drug test according to federal requirements for a CDL employee. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Mayor Rabe reported that they are recommending hiring Kevin Stensland as the Public Works II - Water and Wastewater Certified employee. Mayor Rabe and Lynn Miller interviewed two for the position. Discussion was held about our current health insurance package and the wage range. The total benefit package has been discussed, but not finalized. Motioned by Magers, seconded by Frieden to make an employment offer to Kevin Stensland with our current insurance package, in the $34.00 per hour range giving Mayor Rabe negotiating powers, starting with three weeks of vacation, 16 hours of personal leave, and 24 hours of sick leave. This employment offer is contingent on a satisfactory result on a pre-employment drug test according to federal requirements for a CDL employee. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Motioned by Otto, seconded by Frieden to approve RESOLUTION 2015-58 A RESOLUTION TO ENTER INTO AN AGREEMENT WITH THE IOWA DEPARTMENT OF TRANSPORTATION FOR A DRAINAGE FLUME TO A PORTION OF HIGHWAY 151/WILLIAMS BLVD. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. The city clerk advised the Council the following measure has been requested by the Library Board of Trustees. Motioned by Beer, seconded by Otto to approve RESOLUTION 2015-59, A RESOLUTION TO SUBMIT TO THE VOTERS OF THE CITY OF FAIRFAX THE QUESTION OF ALTERING THE NUMBER OF LIBRARY TRUSTEES AND THE RESIDENCY REQUIREMENTS OF THE LIBRARY TRUSTEES. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. The city clerk presented reports showing the amounts that the library and fire department were under budget for FY15. They are requesting these amounts be transferred into their respective savings accounts. Motioned by Otto, seconded by Frieden to instruct the city clerk to transfer $8,065.54 from the general fund's checking account into the library's savings account and $637.62 from the general fund's checking account into the fire department's regular savings account. The amount under budget in the Local Option Sales Tax Fund will not be transferred into a savings account. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Shane Wicks reported that the Steering Committee discussing the north growth area will have one more meeting on Tuesday, July 28, at 5:30 PM. Shane Wicks reported that the plans and specifications are not ready for the Phase 4 and 5 Water Main Replacement and Vanderbilt Street Improvement Project. He stated they will be asking for an alternate to use asphalt rather than concrete because of the current high price of concrete. The City Council agreed to have a special meeting on Tuesday, July 28, 2015, at 7:00, in order to keep this project moving forward. Shane Wicks reported that he will not have specifics to discuss about the trail and East Cemetery Road lights until the trail project is closed. The Phase 1 East Cemetery Road Improvement Project is complete. We are waiting for the final documents. Phase 2 East Cemetery Road Improvement Project has a punch list of items to complete, such as seeding, grading, and moving a stock pile of dirt. Seeding of the Trail Project area was discussed. Motioned by Magers, seconded by Frieden to approve RESOLUTION 2015-60, A RESOLUTION TO APPROVE PAY APPLICATION NO. 12 FROM TAYLOR CONSTRUCTION, INC. FOR THE FAIRFAX TRAIL ALONG EAST SIDE OF UNNAMED TRIBUTARY TO PRAIRIE CREEK BETWEEN EAST CEMETERY ROAD AND FRONT STREET PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Discussion was held concerning the request for Change Order 412 for the Trail Project. More information is needed. This item will be placed on the special meeting's agenda. Joel Gross reported they are working on the facility plan for the UV Disinfection Upgrade for the Wastewater Treatment Plant Project. Hall and Hall Engineers discussed sandblasting and painting of the west clarifier at the WWTP. Verbal estimates were high and no quotes were received. Motioned by Frieden, seconded by Magers to approve the claims dated July 14, 2015. Ayes: Beer, Frieden, Otto, and Magers. Nays: None. Absent: Wainwright. Motion carried. Bernie Frieden asked about the status of the detention ponds at The Complex. The maintenance department has a plan, they are just waiting for full staffing to have the manpower to get the work completed. Travis Otto asked about the maintenance of the ATM area near Casey's. Staff will contact Fairfax State Savings Bank. Marc Magers mentioned that because of the new trail improvement a group of about 45 bike riders came to Fairfax. They enjoyed the trail area. Zach Sobaski briefly mentioned some topics he will discussing in more detail at a future meeting concerning his property at 99 E. Cemetery Road. The city clerk asked if the Mayor or any Councilmembers are planning on attending the Iowa League of Cities' Annual Conference in Cedar Rapids in September. The city clerk and deputy clerk will be attending. She also reminded the City Council that she will be attending the Municipal Professional's Academy at the end of the month in Ames. The city clerk asked if anyone knew if K&B Ag Supply was granted a special use permit through Linn County and, if so, if the City should be scheduling the required road work. Mayor Rabe reported that he has had discussions with the Prairie Creek Estates Homeowners' Association. They want to know who to contact about costs they have incurred dealing with the water and mud problems. It was suggested they contact both Jeff Then and Chris Mottinger.
