Home My WebLink About09/08/2015 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING SEPTEMBER 8, 2015 The regular meeting of the Fairfax City Council was held September 8, 2015, at Fairfax City Hall. Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Travis Otto, Marc Magers, and Marianne Wainwright. Other city staff present: Cynthia Stimson, Brian Merta, Dave Yanecek, Mike Sankot, and Lynn Miller. Shane Wicks and Joel Gross of Hall and Hall Engineers, Inc. were also present. Motioned by Magers, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Frieden, seconded by Beer to approve and place on file the City Council minutes dated August 25, 2015. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Motioned by Frieden, seconded by Otto to place on file the Planning and Zoning Commission minutes dated August 18,2015. Ayes: Beer,Frieden, Otto,Magers,and Wainwright. Nays: None. Motion carried. The list of the calls from the Linn County Sheriffs Department was reviewed. The Deputy was asked to have patrol check parking on Linn Street during FYSA events. Doug Mueller stated that things have been quiet. The city staff made him aware that there will be park equipment at the Driftwood Lane Park on Monday, September 14, in preparation for installation the next day. Fire Chief Mike Sankot reported that they responded to a house fire. The department responded well and have been staying busy. Motioned by Otto, seconded by Frieden to approve the Option 2 quote from Cretex Concrete Products for $4,082.00 for the 29" pipe. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. The Council reviewed Kevin's report. The equipment installation at Driftwood Lane Park is scheduled for Tuesday, September 15. Work is to begin at 8:00 AM. Motioned by Beer, seconded by Frieden to approve the financial reports as submitted. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe opened the public hearing at 7:08 PM. The rezoning process was discussed. No comments have been received at the city clerk's office. Mayor Rabe closed the public hearing at 7:18 PM. Motioned by Magers, seconded by Beer to introduce and approve the first reading of ORDINANCE 27, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY, NOW KNOWN AS: PARCEL A, PLAT OF SURVEY #84 AS RECORDED IN VOL. 2132, PAGE 172 OF THE RECORDS OF THE LINN COUNTY, IOWA RECORDER ON MAY 5, 1992, BEING A PART OF THE NE 1/40F THE SECTION 9-82- 8, FAIRFAX, LINN COUNTY, IOWA, FROM C2: HIGHWAY COMMERCIAL TO 9RS: SINGLE FAMILY RESIDENTIAL. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Two quotes about estimated demolition costs for the property next door were reviewed. Possible needs for the property were discussed. The City Council directed Mayor Rabe to contact the property owner and negotiate purchasing the back lot only. Motioned by Beer, seconded by Otto to approve RESOLUTION NO. 2015-72, A RESOLUTION TO ENTER INTO AN AGREEMENT WITH SOBASKI REAL ESTATE, L.L.C. FOR CONNECTION TO THE CITY OF FAIRFAX'S WATER MAIN. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2015-72 duly adopted. Motioned by Magers, seconded by Otto to approve RESOLUTION NO. 2015-73, A RESOLUTION TO ENTER INTO AN AGREEMENT WITH SOBASKI REAL ESTATE, L.L.C. FOR CONNECTION TO THE CITY OF FAIRFAX'S SANITARY SEWER MAIN. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2015-73 duly adopted. Discussion was held concerning Sobaski's Second Addition, Lots 2 and 3 Site Plan and Utility Extension Project. Eastern Iowa Buildings, Inc. is requesting the city share in fifty percent of the costs of this project. The water main will be larger than they need to allow future extension and be extended beyond the new building's water service. Area drainage and street surfacing were discussed. The sewer line will be a private sewer line,but be billed for city sanitary sewer services. More details will be available for the next meeting. Maggie Burger, from Speer Financial, gave a presentation about financing options for the utility extensions to the north growth area. The developers will finance half of the project costs until the City has TIF revenues generated in this area to repay them. There is a 10-year limit on pay backs for residential TIF districts and they have a LMI requirement. A developer agreement is to be drafted and the City will set these payments up as an annual appropriation. Schedules for annexation, development, and Urban Renewal Plan revisions were reviewed. Maggie Burger presented the annual TIF Report. Motioned by Frieden, seconded by Otto to approve RESOLUTION NO. 2015-74, A RESOLUTION TO APPROVE CHANGE ORDER NO. 2 FROM DAVE SCHMITT CONSTRUCTION COMPANY, INC. FOR THE KARAL'S DRAINAGE IMPROVEMENTS PROJECT. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2015-74 duly adopted. Motioned by Magers, seconded by Beer to approve RESOLUTION NO. 2015-75, A RESOLUTION TO APPROVE CHANGE ORDER NO. 3 FROM DAVE SCHMITT CONSTRUCTION COMPANY, INC. FOR THE KARAL'S DRAINAGE IMPROVEMENTS PROJECT. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2015-75 duly adopted. Discussion was held concerning the quote from Linn County for work on the box culvert at 76th Avenue and Williams Boulevard. Truck use of Southview Road and the cost to repair/ upgrade that road if the culvert is closed was discussed. This will be discussed at the next meeting. Shane Wicks discussed the zero lot line issue that was raised by some condo owners. The Council favors establishing a zoning designation for zero lot line lots with one joined side. This issue will be referred to the Planning and Zoning Commission. Information regarding uniform and rug rental was referred to staff to make a choice of provider based on cost and service. Motioned by Frieden, seconded by Magers to approve RESOLUTION NO. 2015-76, A RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S PROPOSED AMENDMENT TO THE FISCAL YEAR 2015-2016 BUDGET. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2015-76 duly adopted. Motioned by Magers, seconded by Otto to approve RESOLUTION NO. 2015-77, A RESOLUTION APPROVING THE STREET FINANCE REPORT FOR FISCAL YEAR 2014-2015. Roll call vote: Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared RESOLUTION 2015-77 duly adopted. Motioned by Otto, seconded by Magers to approve the claims list dated September 8, 2015. Ayes: Beer, Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Dave Selzer asked about the culvert project. JoAnn Beer asked that the IDOT be contacted about mowing the weeds on the viaduct. The city clerk reminded the Council about the Iowa League of Cities' Annual Conference in Cedar Rapids and the deadline to submit election paperwork. Mayor Rabe discussed the new park storage building. The design will be changed to have two overhead doors for approximately an additional $3,000.
