Mayor Rabe called the meeting to order at 7:00 PM. Council members present: JoAnn Beer, Bernie Frieden, Marc Magers, and Marianne Wainwright. Travis Otto was absent. Other city staff present: Cynthia Stimson, Cathy Bayne, Lynn Miller, Kevin Stensland, and Brian Merta. Shane Wicks of Hall and Hall Engineers, Inc. was also present. Motioned by Beer, seconded by Magers to approve the agenda. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Frieden, seconded by Beer to approve and place on file the city council minutes dated October 13, 2015. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Magers, seconded by Beer to place on file the Library Board of Trustee minutes dated November 3, 2015, the Parks and Beautification minutes dated September 17, 2015, and the Planning and Zoning Commission minutes dated October 20, 2015. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Ron Krueger introduced himself. He is the new Director of Operations for the Signal 88 franchise owners. He stated he worked for Doug for three years and is familiar with Fairfax. Cathy Bayne stated that the library has been busy. They are working on their strategic plan. The ballot measure passed and they will be making a recommendation to implement the smaller Library Board of Trustees. Brian Merta discussed a training burn the fire department hosted and that they will be picking up the new truck soon. Lynn Miller discussed placing the “Free Library” yet this fall and reviewed the invoice from Iowa Precision Concrete. Motioned by Frieden, seconded by Beer to approve the revised invoice for $9,576.00, with additional concrete work. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Kevin Stensland discussed data about sewer lift station pumping after rain events. He stated that the City needs to do a smoke test to show any storm water connections to the sanitary sewer system. The area that drains to the East Cemetery Road lift station is the first priority. The problem could also be manholes that become flooded. JoAnn Beer stated that the Haunted Trail went well and they are gearing up for Winterfest. Lynn Miller stated that two parks have been winterized. Motioned by Beer, seconded by Frieden to approve the financials as presented, including a revised Annual TIF Report based on new information provided by Linn County. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Rabe opened the public hearing regarding revising the Future Land Use Map at 7:17 PM. The city clerk’s office had not received any written or oral comments. Harold Miller asked how far north the map covered. Mayor Rabe closed the public hearing at 7:19 PM. Motioned by Magers, seconded by Beer to approve RESOLUTION NO. 2015-90, A RESOLUTION TO ADOPT A REVISED FUTURE LAND USE MAP FOR THE CITY OF FAIRFAX. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2015-90 duly adopted. Mayor Rabe opened the public hearing regarding a rezoning request from Shane Novak at 440 Highland Avenue, Fairfax, Iowa at 7:20 PM. The city clerk’s office had not received any written or oral comments. Discussion was held about the rezoning and then building permit procedures. An email from the city engineer was reviewed. Rebecca Daniels voiced her concerns about drainage in the area. The City Council requested being able to review a d rainage plan at the time the building permit application is filed. Mr. Novak was advised that once this is changed to residential and a house is built, he will not be able change the lot back to commercial. Mayor Rabe closed the public hearing at 7:40 PM. Motioned by Wainwright, seconded by Magers to introduce and approve the first reading of ORDINANCE 28, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY, NOW KNOWN AS: LOT 101, FAIRFAX HEIGHTS 2ND ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA, FROM C2: HIGHWAY COMMERCIAL TO 9RS: SINGLE FAMILY RESIDENTIAL. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Motioned by Magers, seconded by Frieden to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 28. Motioned by Magers, seconded by Frieden to approve final passage and adoption with respect to ORDINANCE 28, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY, NOW KNOWN AS: LOT 101, FAIRFAX HEIGHTS 2ND ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA, FROM C2: HIGHWAY COMMERCIAL TO 9RS: SINGLE FAMILY RESIDENTIAL. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Joe Kell reviewed FYSA’s 2015. Their focus continues to be on the children, which is great for the community. Discussion was held about the speed limits on Williams Blvd. Tony Schmidt has requested it be lowered to 45 miles per hour from the south edge of town to at least 80th Street. The City is to request a speed study from the IDOT. Linn County Deputy Sheriff Egli presented the list of calls. He was asked to see that vehicles are not to be parking on the trail along East Cemetery Road. Discussion was held about the handicapped parking designation made in the on street parking in front of Fairfax State Savings Bank. The bank went ahead and painted the area and posted the sign without City Council action. The City Council asked if they designated spots on their property. Yes, they have painted one. While the process was not perfect, the City Council did not see a reason to remove the designation if the bank felt that this was beneficial to drivers using this area. Motioned by Beer, seconded by Magers to approve the handicapped parking spot located on Vanderbilt Street in front of Fairfax State Savings Bank. Ayes: Beer, Frieden, Magers, and Wainwright. The Mayor and clerk informed the City Council that we received a call stating that the buildings in the Meadow Oak Development are in violation of the Federal Fair Housing Code. The city attorney has been contacted and we are awaiting an answer. More information was presented to the City Council about building department issues. Job descriptions from Hiawatha were presented. This topic is to be placed back on the February agenda. Shane Wicks discussed the sanitary sewer main near EIB. If it is to be a public line, the City must be given 24/7 access. No action was taken on the Phase 2, East Cemetery Road Improvements Project due to not receiving documents from the contractor. Motioned by Frieden, seconded by Magers to approve RESOLUTION NO. 2015-91, A RESOLUTION ACCEPTING THE FAIRFAX TRAIL ALONG EAST SIDE OF UNNAMED TRIBUTARY TO PRAIRIE CREEK BETWEEN EAST CEMETERY ROAD AND FRONT STREET PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2015-91 duly adopted. The City Council was informed that MidAmerican Energy has contacted the City for permission to cut through the new trail to run gas service to a new house at the end of East Cemetery Road. The City Council does not want this new trail and street disturbed. Another option should be found. Shane Wicks stated they are working on the trail lights and will have an update for the next regular meeting. Motioned by Beer, seconded by Frieden to approve RESOLUTION NO. 2015-92, A RESOLUTION ENTERING INTO A 28E AGREEMENT BETWEEN LINN COUNTY AND CITY OF FAIRFAX FOR CULVERT REPLACEMENT. Roll call vote: A yes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Rabe declared RESOLUTION 2015-92 duly adopted. Several issues about the new growth area were then discussed: Shane Wicks asked the City Council about their thoughts for a wet pond in the new development area. Water quality, release rates, IDNR permitting, and flood plains were discussed. The City Council stated that they would like to see the sanitary sewer and the trail placed on purchased property leading to the new development area. Green space requirements were reviewed. A draft of the infrastructure report was discussed. Shane Wicks will be updating the report with exhibits next week. Financing the utility extensions was discussed. The revenue bond anticipation bond is to be used. We received advice from Bob Josten that the 28E Annexation Agreement with Cedar Rapids is no longer valid, due to a court decision and the Iowa Code 10 year limit for this type of agreement. Mayor Rabe and Mayor Elect Frieden along with Shane Wicks are to meet with the City of Cedar Rapids about this topic. The annexation schedule was reviewed. Although not required, the City will send representatives to the January 13 City Development Board meeting as well as the February 10 meeting. Discussion was held with resident on Longview about property tax rebates, utility service, and burning regulations once they are annexed into the City of Fairfax. The minutes from the pre-construction meeting for the Phase 4 Water Main Replacement and Vanderbilt Street Paving Reconstruction Project were given to the City Council. The project will be starting soon. Motioned by Magers, seconded by Frieden to approve RESOLUTION NO. 2015-103, A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE PAYMENT OF DEBT FEES AND INTEREST DUE DECEMBER 1, 2015. Motioned by Magers, seconded by Beer to approve the renewal of the American Legion Pekomy Post’s Class C Liquor License with Outdoor Service and Sunday Sales pending their submission of the dram insurance coverage. The city clerk was instructed to draft a notice to appoint to fill the vacancy during the January 12 meeting. Motioned by Magers, seconded by Wainwright to approve the claims list dated November 10, 2015. Ayes: Beer, Frieden, Magers, and Wainwright. Nays: None. Absent: Otto. Motion carried. Correspondence was reviewed. Shane Wicks discussed the process of a fill permit application from Travis Schrage. Information will be sent to the IDNR for their input. The City Council will hold a special City Council meeting on Tuesday, November 24, at 6:00 PM regarding the annexation public hearing. JoAnn Beer verified that Hurts are no longer living in the trailer and mentioned that the lights on the north entry sign are out. The city clerk has received draft plans for the IDOT bridge projects. There will be a field review meeting on Friday, November 20. She and Mayor Rabe have met with the two council members elect Joe Kell and Mike Daly. Mayor Elect Frieden directed the city clerk to register him for the first three MLA meetings. Motioned by Wainwright, seconded by Magers to adjourn the meeting.
