SPECIAL CITY COUNCIL MEETING
November 24, 2015
The special meeting of the Fairfax City Council was held November 24, 2015, at Fairfax city
hall. Mayor Rabe called the meeting to order at 6:02 PM. Council members present: JoAnn
Beer, Bernie Frieden, Travis Otto, and Marianne Wainwright. Marc Magers entered at 6:06 PM.
Other city staff present: Cynthia Stimson. Shane Wicks of Hall and Hall Engineers, Inc. was
also present.
Motioned by Frieden, seconded by Otto to approve the agenda. Ayes: Beer, Frieden, Otto, and
Wainwright. Nays: None. Absent: Magers. Motion carried.
Mayor Rabe opened the public hearing regarding the annexation at 6:03 PM. Discussion was
held about burning, drainage, utility services, and property taxes for the annexed area. It was
suggested to develop an overlay for the area that may have some burning regulations like Linn
County’s rules. The amount of ground to be annexed and the annexation schedule were
discussed. The schedule about property tax rebates in the Iowa Code was reviewed. The City
will follow this schedule.
Mayor Rabe closed the public hearing at 7:01 PM.
Motioned by Beer, seconded by Wainwright to approve RESOLUTION NO. 2015-105, A
RESOLUTION APPROVING THE VOLUNTARY ANNEXATION (80/20) IN AN
URBANIZED AREA INCLUDING LAND WITHOUT THE CONSENT OF PROPERTY
OWNERS FOR PROPERTY LOCATED NORTH OF WEST CEMETERY ROAD,
NORTH OF HIGHWAY 151, AND WEST OF 80TH STREET. Roll call vote: Ayes: Beer,
Frieden, Otto, Magers, and Wainwright. Nays: None. Motion carried. Mayor Rabe declared
RESOLUTION 2015-105 duly adopted.
Discussion was held about the infrastructure report. A special city council meeting, with the
current and newly elected officials, was scheduled for Wednesday, December 16, at 6:00 PM.
Shane Wicks discussed trail placement at the West Cemetery Road Bridge. Marc Magers
discussed recent area break-ins and asked that we make sure Signal 88 has been informed.
Mayor Rabe wished everyone a Happy Thanksgiving.
Motioned by Frieden, seconded by Magers to adjourn the meeting. Ayes: Beer, Frieden, Otto,
Magers, and Wainwright. Nays: None. Motion carried.
Mayor Rabe adjourned the meeting at 7:22 PM.
