REGULAR CITY COUNCIL MEETING
January 12, 2016
The regular meeting of the Fairfax City Council was held January 12, 2016, at Fairfax city hall.
Mayor Frieden called the meeting to order at 7:00 PM. Council members present: JoAnn Beer,
Mike Daly, Joe Kell, and Marianne Wainwright. One council position is vacant. Other city staff
present: Kathy Everett, Cathy Bayne, Lynn Miller, Kevin Stensland, Dave Yanecek, and Brian
Merta. Fire chief Mike Sankot and Shane Wicks of Hall and Hall Engineers, Inc. were also
present.
Mayor Frieden discussed the vacancy on the city council created by his election to the office
of Mayor and recommended appointing Nicholas Volk to the city council.
Motioned by Kell, seconded by Daly to appoint Nicholas Volk to the Fairfax City Council to
fill a vacancy until the next regular municipal election. Ayes: Beer, Daly, Kell and Wainwright.
Nays: None. Vacant: One. Motion carried. Nicholas Volk took the Oath of Office and was
seated at the council table.
Mayor Frieden appointed Marianne Wainwright as Mayor Pro Tempore.
Motioned by Beer, seconded by Kell to approve the agenda. Ayes: Beer, Daly, Kell, Volk,
and Wainwright. Nays: None. Motion carried.
Motioned by Beer, seconded by Wainwright to approve and place on file the city council
minutes dated December 8, 2015 and December 16, 2015. Ayes: Beer, Daly, Kell, Volk and
Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Kell to place on file Library Board of Trustee minutes dated
December 8, 2015 and January 5, 2016. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays:
None. Motion carried.
Linn County Deputy Sheriff Egli arrived at 7:07 PM and gave the sheriff’s report. There was
one major auto accident last month. The sheriff’s office responded to a citizen complaint that a
suspicious person was going door-to-door selling vacuums. The officer could not locate the
person.
Ron Kruger with Signal 88 stated there were no major issues to report. He asked if the city
had received any complaints about their patrol vehicles using a flashing amber light. The city
received no complaints, so they will continue to use the light while on patrol.
Cathy Bayne reported no major issues at the Library.
Last year the Library Board of Trustees requested a measure be placed on the ballot for the
November 2015 election asking voters to approve changing the makeup of the Library Board by
reducing the number of Trustees from nine to seven. The measure was approved by the voters.
Trustees Theresa Whittlesey and Roger Abel have volunteered to step down from the board.
Based on the vote and Library Board’s recommendation, Mayor Frieden appointed the
following people to the new, reorganized Library Board with the following term expiration dates:
Dot Pospischil, July 1, 2016; David Lees, July 1, 2016; Jim Stallman, July 1, 2016; Mary Rita
Meyers, July 1, 2018; Linda Pribyl, July 1, 2018; William Toner, Jr., July 1, 2020; Bernice
Kleppe, July 1, 2020.
Chief Sankot gave the Fire Department report.
Maintenance supervisor Lynn Miller reported they have had no major issues. They have been
working on winterization in preparation for colder weather and snow.
The Parks and Beautification committee did not meet in December, so there was no report.
Motioned by Beer, seconded by Kell to approve the financials as presented. Ayes: Beer,
Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Shane Wicks gave the engineering report. Rathje Construction continues to work on the
Phase 4 water main replacement project as weather permits.
Motioned by Beer, seconded by Kell to reappoint Cynthia Stimson as the City
Clerk/Treasurer. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Wainwright, seconded by Volk to reappoint the law firm Simmons Perrine
Moyer Bergman PLC as the City Attorney. Ayes: Beer, Daly, Kell, Volk, and Wainwright.
Nays: None. Motion carried.
Motioned by Kell, seconded by Daly to reappoint Mike Sankot as Fire Chief. Ayes: Beer,
Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Three positions on the Planning & Zoning Commission are vacant. Mayor Frieden
recommended appointing Gary Pribyl for the remainder of the term ending 12-31-2018.
Motioned by Beer, seconded by Volk to appoint Gary Pribyl to the Planning & Zoning
Commission for the term ending 12-31-2018. Ayes: Beer, Daly, Kell, Volk, and Wainwright.
Nays: None. Motion carried.
Mayor Frieden recommended appointing Jeff Christensen for the remainder of the term
ending 12-31-2019.
Motioned by Volk, seconded by Daly to appoint Jeff Christensen to the term ending 12-31-
2019. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Mayor Frieden recommended appointing Cindy Anderson to a new term ending 12-31-2020.
Motioned by Beer, seconded by Kell to appoint Cindy Anderson to a new term ending 12-31-
2020. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: Motion carried.
Mayor Frieden recommended reappointment of Annie Sobaski to the Planning and Zoning
Commission for a term ending 12-31-2020.
Motioned by Kell, seconded by Volk to reappoint Annie Sobaski to a term ending 12-31-
2020. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Mayor Frieden asked for a motion to reappoint Gib Boxa to the Board of Adjustment for a
term ending 12-31-2020.
Motioned by Volk, seconded by Kell to reappoint Gib Boxa to the Board of Adjustment for a
term ending 12-31-2020. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion
carried.
Shane Wicks explained that a public hearing is required for the easement vacations for
Sobasi’s 2nd Addition Final Plat, so no action can be taken.
Shane Wicks discussed the Highway 151 Bridge Replacement Project meeting. The city’s
annexation application packet is on the agenda for the City Development Board meeting
scheduled for Wednesday, January 13 in Des Moines. Mayor Frieden and Shane Wicks will
attend the meeting. The subdivision concept preliminary plat has been submitted for review by
the Planning and Zoning Commission at their meeting on Tuesday, January 19.
The council reviewed proposals for employee insurance coverages from Aflac, PDCM
Insurance, and Principal Financial. Jason Rabe with Principal Financial presented information
about the coverages available and answered questions. The city compared quotes for higher
levels of short term disability insurance and life insurance coverage they requested and quotes
for dental and vision coverage were reviewed. After discussion, council proposed accepting the
quote from Principal Financial for short term disability coverage of$300.00 per week, life
insurance coverage of$25,000.00, accidental death and dismemberment, and employee dental
and vision coverage with the premiums being paid by the city.
Motioned by Kell, seconded by Volk to accept the quote from Principal Financial for short
term disability, life insurance, accidental death and dismemberment, and employee dental and
vision coverage, with the full premiums to be paid by the city. Ayes: Beer, Daly, Kell, Volk and
Wainwright. Nays: None. Motion carried.
Motioned by Wainwright, seconded by Kell to approve the American Legion Pekomy Post's
Class C Liquor License with Outdoor Service and Sunday Sales. Ayes: Beer, Daly, Kell, Volk,
and Wainwright. Nays: None. Motion carried.
Motioned by Kell, seconded by Beer to approve RESOLUTION NO. 2016-01, A
RESOLUTION ACCEPTING THE KARAL'S ADDITION DRAINAGE
IMPROVEMENTS PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA.
Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Mayor Frieden declared RESOLUTION NO. 2016-01 duly adopted.
Motioned by Kell, seconded by Beer to approve RESOLUTION NO. 2016-02, A
RESOLUTION TO APPROVE FINAL PAY APPLICATION FROM DAVE SCHMITT
CONSTRUCTION, CO. FOR THE KARAL'S ADDITION DRAINAGE
IMPROVEMENTS PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA.
Roll call vote: Beer, Daly, Kell, Volk,and Wainwright. Nays: None. Motion carried. Mayor
Frieden declared RESOLUTION 2016-02 duly adopted.
The City Council will hold a special City Council meeting on Wednesday, January 27 at 6:00
PM to discuss FYI 7 budget issues.

Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
