Mayor Frieden called the meeting to order at 6:01 PM. Council members present: JoAnn Beer, Mike Daly, and Nick Volk. Joe Kell and Marianne Wainwright were absent. Other city staff present: Cynthia Stimson, Lynn Miller, Kevin Stensland, Dave Yanecek, and Cathy Bayne. Motioned by Beer, seconded by Daly to approve the agenda. Ayes: Beer, Daly, and Volk. Nays: None. Absent: Kell and Wainwright. Motion carried. Motioned by Beer, seconded by Daly to approve the minutes from January 12, 2016 and January 27, 2016. Ayes: Beer, Daly, and Volk. Nays: None. Absent: Kell and Wainwright. Motion carried. Motioned by Beer, seconded by Daly to place on file the Planning and Zoning Commission minutes dated January 19, 2016. Ayes: Beer, Daly, and Volk. Nays: None. Absent: Kell and Wainwright. Motion carried. There was no Linn County Deputy Sheriff present. Ron Krueger, with Signal 88, introduced Daniel Berg, the corporate National Director of Operations for Signal 88. Mr. Berg has purchased the Cedar Rapids area franchise and will start working as the owner as of March 1, 2016. Mayor Frieden mentioned to Ron and Daniel that people have reported suspicious vehicles at the Complex and he asked them to patrol this area. Cathy Bayne stated the library has been busy and that they are working on their three year plan. Lynn Miller reported there has been nothing unusual for the fire department and the maintenance department has been working on fixing up the shop and pump house. Kevin Stensland reported they have been working on the UV process. The plans will be ready by May 1. A bid must be accepted by July 1, 2016. JoAnn Beer stated that the Parks and Beautification Committee is gathering information about a portable ice skating rink and a dog park. Motioned by Beer, seconded by Daly to approve the financial reports. Ayes: Beer, Daly, and Volk. Nays: None. Absent: Kell and Wainwright. Motion carried. Shane Wicks stated that the flood report is not ready. Joe Horaney gave a presentation about the Cedar Rapids/Linn County Solid Waste Agency. They are experiencing a huge increase in the cost to process recyclables. They are asking the other participating entities to cover the costs above their previous contract costs. Based on their current contract bids, Fairfax’s share would be $3,801.23 per year, which is about $1.79 per person. This would be the highest amount needed. They are still working with the contractor to lower the costs. Mike Nemeth gave a presentation about solar energy. Mayor Frieden requested some additional data details. Marianne Wainwright entered at 6:55 PM. Dennis Wilson discussed his request to have the stop signs on Front Street removed. He submitted a petition with signatures from several area residents. The City Council discussed the need for stop signs on Front Street at Vanderbilt Street, bus stop locations, and traffic flows. The City Council will consider an ordinance to move the stop signs on Front Street at Park Street to the Vanderbilt Street intersection after the Vanderbilt project is completed. Mayor Frieden opened a public hearing regarding vacating easements at 7:23 PM. The clerk’s office has not received any comments and no residents were present to make comments. Shane Wicks informed the audience that the easements being vacated are no longer needed because Sobaski Real Estate, L.L.C. has submitted a Replat of Lots 1, 2, and Outlot A of Sobaski’s Addition. Mayor Frieden closed the public hearing at 7:25 PM. Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2016-05, A RESOLUTION VACATING A PUBLIC ACCESS EASEMENT, A PRIVATE ACCESS EASEMENT, AND A SANITARY SEWER EASEMENT, ALL PART OF SOBASKI’S ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried. Mayor Frieden declared RESOLUTION 2016-05 duly adopted. Motioned by Wainwright, seconded by Daly to approve RESOLUTION NO. 2016-06, A RESOLUTION APPROVING THE FINAL PLAT FOR SOBASKI’S SECOND ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried. Mayor Frieden declared RESOLUTION 2016-06 duly adopted. Motioned by Volk, seconded by Daly to approve RESOLUTION NO. 2016-07, A RESOLUTION TO APPROVE PAY APPLICATION NO. 1 FROM RATHJE CONSTRUCTION, CO. FOR THE PHASE 4 WATER MAIN AND VANDERBILT PAVEMENT RECONSTRUCTION PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried. Mayor Frieden declared RESOLUTION 2016-07 duly adopted. Motioned by Beer, seconded by Volk to approve RESOLUTION NO. 2016-08, A RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING CONCERNING ADOPTING AN UPDATED FUTURE LAND USE MAP AS PART OF THE FAIRFAX COMPREHENSIVE PLAN FOR THE CITY OF FAIRFAX. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried. Mayor Frieden declared RESOLUTION 2016-08 duly adopted. Shane Wicks discussed Ordinance 2009-90, which stated that with an annexation the City Council can direct the Planning and Zoning Commission to recommend similar use zoning districts for the annexed area. Motioned by Wainwright, seconded by Daly to direct the Planning and Zoning Commission to review current land uses and recommend similar use zoning districts for the annexed area. Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried. Mayor Frieden and Shane Wicks discussed the annexation process and reviewed a timing spreadsheet. Bruce Sevig asked if they should get their attorney involved in the process. Mayor Frieden and staff will be meeting with Dan Manning on Thursday to discuss options. Motioned by Volk, seconded by Daly to approve RESOLUTION NO. 2016-09, A RESOLUTION SETTING SPECIFICS ABOUT THE FAIRFAX CITY COUNCIL MEETINGS. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried. Mayor Frieden declared RESOLUTION 2016-09 duly adopted. Council and mayor compensation was discussed and the code sections were reviewed. The city clerk/treasurer was directed to draft an ordinance change that would take effect as soon as the code allows, which would be January 1, 2018. Motioned by Beer, seconded by Wainwright to set the date of the city-wide garage sales to be Saturday, May 21, 2016. Ayes: Beer, Daly,Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried. Discussion was held about the Temporary Occupancy Certificate process. Staff was directed to enforce as written and inform contractors. Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2016-10,A RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S PROPOSED FISCAL YEAR 2016-201.7 BUDGET. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried. Mayor Frieden declared RESOLUTION 2016-10 duly adopted. The City Council discussed the FY17 budget. Staff was directed to draft ordinance changes to the water and sewer rates and prepare the budget notice. Motioned by Daly, seconded by Volk to approve the claims listed dated February 9, 2016. Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried. Motioned by Daly, seconded by Beer to adjourn the meeting. Ayes: Beer, Daly, Volk, and Wainwright. Nays: None.
