REGULAR CITY COUNCIL MEETING
March 8, 2016
The regular meeting of the Fairfax City Council was held March 8, 2016, at Fairfax city hall.
Mayor Frieden called the meeting to order at 6:00 PM. Council members present: JoAnn Beer,
Mike Daly, Joe Kell, Nick Volk, and Marianne Wainwright. Other city staff present: Cynthia
Stimson, Lynn Miller, Kevin Stensland, Dave Yanecek, Brian Merta, and Cathy Bayne.
Motioned by Beer, seconded by Kell to approve the agenda. Ayes: Beer, Daly, Kell, Volk,
and Wainwright. Nays: None. Motion carried.
Motioned by Kell, seconded by Daly to approve the consent agenda. Ayes: Beer, Daly, Kell,
Volk, and Wainwright. Nays: None. Motion carried.
Major Hansel, from the Linn County Sheriff’s Department, was present to discuss a
resident’s concerns about patrolling. He and Deputy Egli discussed their procedure to pick
where to patrol, video capabilities, and options available to residents who are given a citation.
Rita Nierling expressed her concern about how tax dollars are being spent. She feels there is
over ticketing on two or three streets and not enough in other areas. She asked that other types of
devices be placed to slow traffic and to warn drivers of stop signs. She also asked that a
reminder to obey traffic laws be placed in the FACTS.
Daniel Berg, the new owner of Signal 88, introduced himself again. He mentioned that they
have received information from Joe Blood to watch for burglaries at Royal Storage.
Cathy Bayne stated the library has been running smoothly and busy.
Fire Chief Mike Sankot reported that the fire department calls have been normal and the
trucks are good.
Lynn Miller reported they will be sweeping the streets and that the Prairie students will be
coming for a public service day in April.
Discussion was held about the need to hire a seasonal maintenance employee and a
permanent part-time janitorial employee. Both positions will be posted with applications being
accepted until April 4. Hiring recommendations will be ready for the April 12 meeting.
Kevin Stensland reported they have been working on the well house and the systems are
working well.
JoAnn Beer stated that the Easter Egg Hunt will be held on Saturday, March 26, at 11:00
AM. No ideas or plans were submitted for an Earth Day activity.
Shane Wicks and Joel Gross were present from Hall and Hall Engineers, Inc. The Phase 4
Water Main Replacement and Vanderbilt Street Paving Reconstruction Project’s late start date is
March 14, 2016. Access and notices during this project were discussed. The city clerk requested
an article about this project from the engineers for the April FACTS. Shane Wicks discussed the
IDOT’s bridges project. Barb Conners asked about her property in relationship to drainage, the
sewer extension, and the trail project. The City does want to use some property for the sewer,
but not the trail since she is not interested in allowing for the trail.
Mayor Frieden opened the public hearing regarding the FY17 budget at 6:53 PM. No written
or oral comments have been received and no one in the audience had any comments. Mayor
Frieden closed the public hearing at 6:54 PM.
Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2016-12, A
RESOLUTION APPROVING CITY OF FAIRFAX’S ANNUAL BUDGET FOR FISCAL
YEAR 2016-2017. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Frieden declared RESOLUTION 2016-12 duly adopted.
Mayor Frieden opened the public hearing regarding a rezoning request from Chris Mottinger,
Legacy Land Investments, LLC, at 6:55 PM. The city clerk’s office did receive a letter about
this rezoning request and it was distributed to the Council. Chris gave a brief summary of the
reason for the request and the process he went through with the Fairfax Planning and Zoning
Commission. Public Works Supervisor Lynn Miller suggested on street parking be limited for
fire equipment access. Marianne Wainwright asked about drainage issues. Mr. Boland asked
about a field tile under 151. Chris stated that he has already completed work to fix the tile area.
City Engineer Shane Wicks is recommending this rezoning action and the current plat layout.
The Fairfax Planning and Zoning Commission also made a recommendation of approval for this
action during their February 23 meeting. Mayor Frieden closed the public hearing at 7:19 PM.

Mayor Frieden opened the public hearing regarding the Comprehensive Plan and Future Land
use Map Update at 7:21 PM. Joe Kell suggested the Council delay action on these topics until
after the annexation action. Mayor Frieden closed the public hearing at 7:26 PM.
Mike Nemeth gave a presentation about solar energy. The city clerk mentioned that Alliant
has offered to review presentations, quotes, or bids received.
Cory Stockton and his daughter Ryan gave input about their support of keeping the Front
Street and Park Street stop signs in place. They said the signs do work to slow down traffic and
make the bus stop area safer. Joe Kell mentioned that there are no sidewalks in the area, so he is
not in favor of moving the signs. It was suggested that when the Vanderbilt Street construction
is completed the Council may add stop signs at Vanderbilt Street and Front Street and not
remove the ones at Park Street.
Charlie Garwood, with Wilson-Hite Insurance, Inc., discussed the City’s commercial
insurance renewal.
Motioned by Beer, seconded by Kell to approve RESOLUTION NO. 2016-13, A
RESOLUTION AUTHORIZING COMMERCIAL INSURANCE COVERAGE FOR THE
CITY OF FAIRFAX. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Frieden declared RESOLUTION 2016-13 duly adopted.
Discussion was held about a plat outside of the city limits and the process the City of Cedar
Rapids tried to follow.
Motioned by Kell, seconded by Volk to approve RESOLUTION NO. 2016-14, A
RESOLUTION TO APPROVE THE FINAL PLAT FOR LEFEBURE ADDITION TO
LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright.
Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2016-14 duly adopted.
Shane Wicks discussed issues with a request to split property at 305 8th Street Court and 416
Creekside Drive. The City Council wants to see an agreement to address the issues and a plat of
survey.
A letter from Tom Arp requesting a delay in the sidewalk installation at his new house at 511
West Cemetery Road. The area has ditches and no curb and gutter.
Motioned by Volk, seconded by Kell to delay the sidewalk installation requirement for Tom
Arp at 511 West Cemetery Road until such time the City Council decides to require sidewalk in
this area. This delay is because of the current rural profile of ditches and no curb and gutter.

Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2016-15, A
RESOLUTION TO FIX A DATE FOR A PUBLIC HEARING ON A LEASE-
PURCHASE AGREEMENT IN THE PRINCIPAL AMOUNT NOT EXCEEDING $98,025
FOR THE PURPOSE OF ACQUIRING AN EXCAVATOR FOR THE MAINTENANCE
DEPARTMENT. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None.
Motion carried. Mayor Frieden declared RESOLUTION 2016-15 duly adopted.
Motioned by Beer, seconded by Volk to approve RESOLUTION NO. 2016-16, A
RESOLUTION APPROVING THE CONTRACT FOR LAW ENFORCEMENT
SERVICE WITH LINN COUNTY AND THE LINN COUNTY SHERIFF’S
DEPARTMENT FOR FISCAL YEAR 2016-2017 BUDGET. Roll call vote: Ayes: Beer,
Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared
RESOLUTION 2016-16 duly adopted.

RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE
PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY’S
PROPOSED AMENDMENT TO THE FISCAL YEAR 2015-2016 BUDGET. Roll call
vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor

REPAIR, AND REPLACEMENT AGREEMENT WITH SOBASKI REAL ESTATE,
LLC. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion
carried. Mayor Frieden declared RESOLUTION 2016-18 duly adopted.

RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS. Roll call vote: Ayes:
Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared
RESOLUTION 2016-19 duly adopted.
The city clerk explained their request to send out contact update forms and offer prizes for
their return.
Motioned by Kell, seconded by Daly to approve to award the list of prizes as presented by
random drawing of the contact update forms returned. Ayes: Beer, Daly, Kell, Volk, and
Wainwright. Nays: None. Motion carried.
Discussion was held about the FYSA lease and park fees. The lease has not been changed.
The park fees have been modified to delete the requirement for insurance and give FYSA the
ability to waive fees if they do not have work associated with the event.

RESOLUTION ENTERING INTO A PARK LEASE AGREEMENT WITH FAIRFAX
YOUTH SPORTS ASSOCIATION. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright.
Nays: None. Abstain: Kell. Joe Kell is abstaining because he is the current president of FYSA.
Motion carried. Mayor Frieden declared RESOLUTION 2016-20 duly adopted.

RESOLUTION ESTABLISHING PARK FEES. Roll call vote: Ayes: Beer, Daly, Volk, and
Wainwright. Nays: None. Abstain: Kell. Joe Kell is abstaining because he is the current
president of FYSA. Motion carried. Mayor Frieden declared RESOLUTION 2016-21 duly
adopted.

Hearing and Letting for the UV Disinfection Project. Ayes: Beer, Daly, Kell, Volk, and

Motioned by Kell, seconded by Daly to approve RESOLUTION NO. 2016-22, A
RESOLUTION SETTING PUBLIC HEARING FOR PLANS AND SPECIFICATIONS,
FORM OF CONTRACT, AND ESTIMATED COST AND SETTING THE DATE AND
TIME TO RECEIVE BIDS FOR UV DISINFECTION SYSTEM PROJECT. Roll call
vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor
Frieden declared RESOLUTION 2016-22 duly adopted.

RESOLUTION ENTERING INTO A CONTRACT FOR CULVERT REPLACMENET
WITH LINN COUNTY AND PETERSON CONTRACTORS, INC. Roll call vote: Ayes:
Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared
RESOLUTION 2016-23 duly adopted.
Shane Wicks discussed the sanitary sewer and storm sewer infrastructure to the North
Growth Area. He asked if they are to design for the entire drainage basin or just the proposed
annexation area. The City Council directed him to design the improvements for the entire
drainage basin.
The regional storm water retention area in Heartland Heights was discussed. More
information is needed about their size requirements and how much extra they are placing.
The estimate from CRL Lawn Care was reviewed. Joe Kell asked about the infield weeds on
the youth diamond at City Park.
Motioned by Kell, seconded by Volk to accept the estimate of$20,560.00 for the annual
spraying needed for the City of Fairfax. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays:
None. Motion carried.

Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Cheryl Cline, of 672 Secretariat Drive, discussed the water problems in their Homeowners'
Association area. She asked if the City could make any improvements to help. Shane Wicks
gave a few suggestions of things they might try. Staff will view the area.
JoAnn Beer asked that the Board of Adjustment minutes be included in their packets and
placed in the FACTS. She also asked for more information about the 28E topic before the
special meeting on April 5. Mayor Frieden stated if she lets him know what she wants he will
see that someone provides the information.
The city clerk discussed a meeting with Mary Meisterling, from Alliant Energy, about their
work to try and establish a Mega Park south east of Fairfax. Property owners have been
contacted and they are working on getting the purchase options in place.
