SPECIAL CITY COUNCIL MEETING
April 5, 2016
The special meeting of the Fairfax City Council was held April 5, 2016, at Fairfax city hall.
Mayor Frieden called the meeting to order at 6:00 PM. Council members present: JoAnn Beer,
Mike Daly, and Joe Kell. Absent: Nick Volk and Marianne Wainwright. Other city staff
present: Cynthia Stimson, Lynn Miller, Brian Merta, Dave Yanecek, Kevin Stensland, and Mike
Sankot.
Motioned by Beer, seconded by Kell to approve the agenda. Ayes: Beer, Daly, and Kell.
Nays: None. Absent: Volk and Wainwright. Motion carried.
Mayor Frieden opened the public hearing regarding the revised Fairfax Comprehensive Plan
and Future Land Use Map at 6:02 PM. The area of the proposed development was reviewed. No
oral or written comments were received at the city clerk's office. No one in the audience had
any comments. Mayor Frieden closed the public hearing at 6:03 PM.
Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2016-24,A
RESOLUTION TO ADOPT A REVISED COMPREHENSIVE PLAN AND FUTURE
LAND USE MAP FOR THE CITY OF FAIRFAX. Roll call vote: Ayes: Beer, Daly, and
Kell. Nays: None. Absent: Volk, and Wainwright. Motion carried. Mayor Frieden declared
RESOLUTION 2016-24 duly adopted.
Marianne Wainwright and Nick Volk, entered the meeting.
Mayor Frieden opened a public hearing regarding entering into a 28E Agreement with the
City of Cedar Rapids at 6:06 PM. Attorney Dan Manning, Sr. discussed the annexation process
status. The attorney for the City of Cedar Rapids has informed him they will not be taking action
on the 28E Amendment as they previously required. They have submitted a memo to the City
Development Board that they do not oppose Fairfax's current annexation action. They have
released their attorney concerning this topic, so he will not be attending the April 13 City
Development Board meeting. Many Linn County residents were present. A few asked about the
possibility of getting annexed into.the City of Fairfax. Attorney Dan Manning, Sr. gave an
overview of the voluntary annexation process. Mayor Frieden stated that the City of Fairfax will
be working to get our current annexation action approved, utilities extended, and the developers
to work before any other annexation area is reviewed. After that work is complete, the City of
Fairfax will be contacting the City of Cedar Rapids to discuss future annexation areas based on
smart planning principles. Mayor Frieden closed the public hearing at 6:32 PM.
No action was taken on the 28E Resolution.
Motioned by Kell, seconded by Daly to adjourn the meeting. Ayes: Beer, Daly, Kell, Volk
and Wainwright. Nays: None. Motion carried.
