HomeMy WebLinkAbout04/12/2016 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING April 12, 2016 The regular meeting of the Fairfax City Council was held April 12, 2016, at Fairfax city hall. Mayor Frieden called the meeting to order at 6:00 PM. Council members present: JoAnn Beer, Mike Daly, Joe Kell, Nick Volk, and Marianne Wainwright. Other city staff present: Cynthia Stimson, Lynn Miller, Kevin Stensland, Dave Yanecek, Brian Merta, and Cathy Bayne. Motioned by Beer, seconded by Daly to approve the consent agenda. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Daniel Byrd, the owner of Signal 88, discussed enhancements to their reporting software. Patrolling at Royale Storage was discussed. Cathy Bayne stated the library has been working on their strategic plan. Fire Chief Mike Sankot reported that the fire department training fire went well. Lynn Miller reported Brian Merta passed the water treatment test and Lynn passed the storm water testing. Brian will attend the culvert project pre-construction meeting on Wednesday. A list of concrete equipment was reviewed. Dennis Merta is offering a large amount of equipment at a discounted rate. Motioned by Kell, seconded by Daly to purchase the concrete equipment on the list from Dennis Merta for $8,700.00 using Local Option Sales Tax funds. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Discussion was held about work that Del's Machine Service did to modify a pump engine. The initial cost quote was $500 to $600 for each pump engine modified. The work took much longer than anticipated. They will still honor the quote for each pump engine, but wondered if some sort of other compensation could be considered. Lynn Miller suggested to the City Council that they trade the increased labor costs on all of the pump engines for a sickle mower that the City of Fairfax has not used for years. Motioned by Wainwright, seconded by Kell to trade the old, no longer used sickle mower for the labor costs associated with the modifications to the pump engines made by Del's Machine Service. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden and Lynn Miller have interviewed four applicants for the open employment positions. They are recommending hiring Michael Rammelsberg for the seasonal part-time maintenance position. Motioned by Beer, seconded by Daly to hire Michael Rammelsberg at a rate of$12.61 per hour for the seasonal part-time maintenance position. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden stated that they are recommending hiring Brian Kindl for the permanent part- time janitorial position. Motioned by Kell, seconded by Beer to hire Brian Kindl at a rate of$12.61 per hour for the permanent part-time janitorial position. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Kevin Stensland stated that they have been flushing water lines and looking at valves. Adding new utility lines into the GIS software was discussed. JoAnn Beer asked about the smoke testing scheduled for May. JoAnn Beer reported that the Easter Egg Hunt went well and asked if some additional trash bins can be added on the south side of The Complex. Lynn stated that he feels the large evergreen tree that was moved to The Complex for a Christmas tree is probably going to die. Shane Wicks discussed an error on last month's fees report total. This made one of the invoices to be only partially paid last month. Mayor Frieden opened the public hearing regarding an amendment to the FYI budget at 6:36 PM. The city clerk reviewed the budget amendment report. No written or oral comments had been received at the clerk's office and no one at the meeting had any comments. Mayor Frieden closed the public hearing at 6:38 PM. Motioned by Kell, seconded by Volk to approve RESOLUTION NO. 2016-25,A RESOLUTION AMENDING THE CURRENT BUDGET FOR FISCAL YEAR ENDING JUNE 30, 2016. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2016-25 duly adopted. Mayor Frieden opened the public hearing regarding entering into a general obligation lease- purchase agreement to acquire an excavator at 6:39 PM. No written or oral comments had been received at the clerk's office and no one at the meeting had any comments. Mayor Frieden closed the public hearing at 6:40 PM. Motioned by Kell, seconded by Daly to approve RESOLUTION NO. 2016-26,A RESOLUTION APPROVING AND AUTHORIZING A LEASE PURCHASE AGREEMENT. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2016-26 duly adopted. Mayor Frieden opened the public hearing regarding the proposed plans, specifications, form of contract, opinion of probable cost and the proposed improvements described for the UV Disinfection System Project at 6:41 PM. No written or oral comments had been received at the clerk's office and no one at the meeting had any comments. Mayor Frieden closed the public hearing at 6:42 PM. Motioned by Wainwright, seconded by Kell to approve RESOLUTION NO. 2016-27, A RESOLUTION ADOPTING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATED COST FOR THE UV DISINFECTION SYSTEM PROJECT. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2016-27 duly adopted. The bids received on April 6, 2016, for the UV Disinfection System Project were reviewed. Hall and Hall Engineers, Inc., is recommending accepting the lowest bid, which is from Ricklefs Excavating, Ltd., for $243,500.00. Motioned by Wainwright, seconded by Daly to approve RESOLUTION NO. 2016-28, A RESOLUTION APPROVING AND MAKING AWARD OF CONTRACT FOR THE UV DISINFECTION SYSTEM PROJECT. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2016-28 duly adopted. Joe Blood discussed drainage and ground maintenance at Royale Storage. He would like to remove one of the detention basins. If that is not possible Joe wants to know so that he can clean up the area. Linn County Deputy Elgi entered the meeting. He distributed the monthly list of calls. Elaina Kempin, from Fairfax State Savings Bank, discussed the plans for 2016 USA Days. She requested the same level of donation from the City of Fairfax as last year. Motioned by Beer, seconded by Volk to donate $3,500.00 to the USA Days Committee for the 2016 celebration. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Jason Rabe, from the Fairfax Lions Club, discussed the 5K run they are organizing for 2016 USA Days celebration on Saturday, June 25. He reviewed the route. There will be no street closures and the trail will stay open. The 5K will start and stop at the Guaranty Bank parking lot. Mike Nemeth was not present. Joe Kell discussed FYSA's insurance bill and requested that the City of Fairfax reimburse FYSA the full amount of$1,516.00. Motioned by Daly, seconded by Beer to donate $1,516.00 to Fairfax Youth Sports Association. Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Abstain: Kell. Joe Kell abstained because he is very active in FYSA. Motioned by Beer, seconded by Wainwright to approve RESOLUTION NO. 2016-29, A RESOLUTION TO APPROVE PAY APPLICATION NO. 2 FROM RATHJE CONSTRUCTION, CO. FOR THE PHASE 4 WATER MAIN AND VANDERBILT PAVEMENT RECONSTRUCTION PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2016-29 duly adopted. Extensive discussion was held about the Heartland Heights preliminary plat conditions and annexed residential lots' special conditions. Shane Wicks will work on the project specifics, draft the conditions agreement, and get some City participation costs estimates to staff Pedestrian access for the IDOT bridge projects was discussed. Shane will let the IDOT know about the City's requests. A notification from the City of Cedar Rapids regarding a voluntary annexation petition was reviewed. The City of Fairfax has no objections or input. The city clerk reviewed information from a company that uses a drone to take pictures and video. She suggested the City of Fairfax consider getting some photos and footage before the development begins. Shane Schrader stated that he does this for all of his projects. The City will coordinate to receive this data. The Annual City-wide Clean-up Day was discussed. This will be held on Saturday, June 4. The church is to be contacted about using their parking lot again this year. Motioned by Beer, seconded by Wainwright to approve RESOLUTION NO. 2016-30, A RESOLUTION APPROVING FIREWORKS PERMIT FOR THE FAIRFAX FIRE AND RESCUE DEPARTMENT. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2016-30 duly adopted. Motioned by Beer, seconded by Wainwright to approve RESOLUTION NO. 2016-31, A RESOLUTION APPROVING FIREWORKS PERMIT FOR WILLIAM BARRY. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2016-31 duly adopted. JoAnn Beer asked a few questions about claims items. Two descriptions will be updated. Motioned by Wainwright, seconded by Volk to approve the claims list dated April 12, 2016. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. A resident asked if there was any update about drainage in the Triple Crown area. There will be no update until later in April. Project schedules, as well as incentives and disincentives for the water and sewer extension projects were discussed. Motioned by Wainwright, seconded by Kell to go into closed session per Iowa Code 21.5 1. j., to discuss the purchase of particular real estate where premature disclosure could be reasonably expected to increase the price the governmental body would have to pay for that property. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. The meeting room was cleared except for the City Council members, Mayor Frieden, City Clerk Cynthia Stimson, and City Engineer Shane Wicks. The City Council went into closed session. Motioned by Daly, seconded by Kell to reconvene the open session. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. .
