HomeMy WebLinkAbout05/10/2016 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING May 10, 2016 The regular meeting of the Fairfax City Council was held May 10, 2016, at Fairfax city hall. Mayor Frieden called the meeting to order at 6:00 PM. Council members present: JoAnn Beer, Mike Daly, Joe Kell, Nick Volk and Marianne Wainwright. Other city staff present: Cynthia Stimson, Lynn Miller, Dave Yanecek, Kevin Stensland, Mike Sankot, and Cathy Bayne. Motioned by Kell, seconded by Daly to approve the consent agenda. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Fire Chief Mike Sankot informed the City Council the fire department has the new monitor in service, the calls have been steady, some members have passed their classes, and they have been getting ready for USA Days. Lynn Miller reported that flushing is done and culvert work will begin soon. He then discussed the notice about blowing grass into the street. The City will do a mass mailing and staff will continue to place a door notice as a violation is observed. The Fairfax City-wide Garage Sale Day is Saturday, May 21. No parking signs will be placed as last year. Kevin Stensland stated 75% of the smoke testing is complete. Two locations were found to be possible infiltration problems. JoAnn Beer reported that the Parks Department is working on details about a dog park and memorial benches. Shane Wicks reported the IDOT wants to eliminate all sidewalk along the east side of their bridge projects. The City Council thought it would be fine as long as there will be sidewalk on the west side. Mayor Frieden opened the public hearing concerning the Plans and Specifications, Form of Contract, and Engineer's Cost Estimate for the 2016 801' Street Water Main Extension Project at 6:22 PM. No oral or written comments have been received at the city clerk's office. Shane discussed the project and gave a cost estimate of$335,000. The City will be receiving bids on Thursday, May 12. No one else had any comments. Mayor Frieden closed the public hearing at 6:24 PM. Motioned by Kell, seconded by Volk to approve RESOLUTION NO. 2016-34,A RESOLUTION ADOPTING PLANS, SPECIFICATIONS, FORM OF CONTRACT,AND ESTIMATED COST FOR THE 2016 80th STREET WATER MAIN EXTENSION PROJECT. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: none. Motion carried. Mayor Frieden declared RESOLUTION 2016-34 duly adopted. Mayor Frieden opened the public hearing concerning the Plans and Specifications, Form of Contract, and Engineer's Cost Estimate for the 2016 Sanitary Sewer Interceptor Main Extension Project at 6:25 PM. No oral or written comments have been received at the city clerk's office. Shane discussed the project and gave a cost estimate of$895,000. The City will be receiving bids on Thursday, May 12. Fire Chief Mike Sankot asked if they will be placing a water line under Highway 151 at the same time. Shane stated they will be placing a casing during the IDOT highway project. Mayor Frieden closed the public hearing at 6:29 PM. Motioned by Daly, seconded by Beer to approve RESOLUTION NO. 2016-35,A RESOLUTION ADOPTING PLANS, SPECIFICATIONS, FORM OF CONTRACT,AND ESTIMATED COST FOR THE 2016 SANITARY SEWER INTERCEPTOR MAIN EXTENSION PROJECT. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: none. Motion carried. Mayor Frieden declared RESOLUTION 2016-35 duly adopted. Discussion was held about Dan Bushman's request for a commercial parking lot at 600 Fairfax Road. Fire Chief Mike Sankot asked about road requirements to get back to the property. Motioned by Wainwright, seconded by Daly to approve the commercial site plan from Dan Bushman for 600 Fairfax Road, with the condition that prior to the City issuing an occupancy permit on this site for the purpose of housing and renting semi-trailers from this site, that the owner supply the City with certification from an engineer licensed in the State of Iowa that the pond/outlet structure has been constructed per the approved site plans. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Discussion was held about possible special conditions for the residential property being annexed into the City of Fairfax. Based on the answers to the questionnaire, it appears that burning is the only special condition needed. This special condition will be part of the rezoning ordinance and last for 10 years. Garbage service for houses in the annexation area was discussed. Motioned by Wainwright, seconded by Kell to waive the deposit requirement for current owners of homes in the annexation area who will be garbage only customers. Ayes: Beer, Kell, and Wainwright. Nays: Daly. Abstain: Volk. Nick Volk is abstaining because he will be moving to this area within a month. Motion carried. Extensive discussion was held concerning participation in future improvement costs for 80th Street. It was suggested to leave the participation at the $2,100 per acre but come up with a method to delay payment closer to the time the road will need to be improved. Linn County Deputy Sheriff Daubs presented the list of calls. A spreadsheet of City of Fairfax participation costs in the Heartland Heights Subdivision was reviewed. The City Council directed staff to add approximately $300,000 to the bond amount for the costs during the first year. Bruce Sevig asked about the timing of the final plat approval and issuance of building permits. If the City Council allows lots to be sold before acceptance of the final plat, the developer may be required to secure a letter of credit or some sort of surety for the work yet to complete. Joel Gross, Hall and Hall Engineers, gave an update about the Phase 4 Water Main and Vanderbilt Street Reconstruction Project. The water main is done except for Railroad Street and Alliant Energy and Mediacom have caused a delay in the project. Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2016-36,A RESOLUTION TO APPROVE CHANGE ORDER NO. 1 FROM RATHJE CONSTRUCTION, CO. Motioned by Kell, seconded by Beer to approve RESOLUTION NO. 2016-37,A RESOLUTION TO APPROVE PAY APPLICATION NO. 3 FROM RATHJE CONSTRUCTION, CO. FOR THE PHASE 4 WATER MAIN AND VANDERBILT PAVEMENT RECONSTRUCTION PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: none. Motion carried. Mayor Frieden declared RESOLUTION 2016-37 duly adopted. The UV Disinfection System Project's pre-construction meeting minutes were reviewed. Joel stated that the permit has arrived. Motioned by Kell, seconded by Daly to approve RESOLUTION NO. 2016-38,A RESOLUTION TO APPROVE CHANGE ORDER NO. 1 FROM RICKLEFS EXCAVATING, LTD. FOR THE UV DISINFECTION SYSTEM PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: none. Motion carried. Mayor Frieden declared RESOLUTION 2016- 38 duly adopted. Motioned by Volk, seconded by Kell to approve RESOLUTION NO. 2016-39, A RESOLUTION APPROVING AN IDOT AGREEMENT FOR MAINTENANCE & REPAIR OF PRIMARY ROADS. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: none. Motion carried. Mayor Frieden declared RESOLUTION 2016-39 duly adopted. Mayor Frieden discussed the possibility of the City leasing the Guaranty Bank building for city hall. Motioned by Kell, seconded by Wainwright to approve RESOLUTION NO. 2016-40,A RESOLUTION TO FIX A DATE FOR A PUBLIC HEARING ON A LEASE OF PROPERTY IN A PRINCIPAL AMOUNT NOT EXCEEDING$350,000 FOR USE AS CITY HALL. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: none. Motion carried. Mayor Frieden declared RESOLUTION 2016-40 duly adopted. Discussion was held about the need for a building official. Staff was directed to advertise. Mayor Frieden and Nick Volk will participate in the interview process. Motioned by Beer, seconded by Kell to approve RESOLUTION NO. 2016-41,A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE PAYMENT OF DEBT PRINCIPLE, INTEREST,AND FEES DUE JUNE 1,2016. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: none. Motion carried. Mayor Frieden declared RESOLUTION 2016-41 duly adopted. Discussion was held about some of the invoices. Motioned by Beer, seconded by Daly to approve the claims list dated May 10, 2016. Ayes: . Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. JoAnn Beer asked if the quarry association has been contacted about pumping on the street. Mike Daly will get the contact information. Discussion was held about trail damage from contractors at Sobaski's new house. They will be contacted. Motioned by Kell, seconded by Daly to adjourn the meeting.
