HomeMy WebLinkAbout05/31/2016 Council Minutes CITY OF FAIRFAX SPECIAL CITY COUNCIL MEETING May 31, 2016 The special meeting of the Fairfax City Council was held May 31, 2016, at Fairfax city hall. Mayor Pro Tempore Wainwright called the meeting to order at 6:02 PM. Council members present: JoAnn Beer, Mike Daly, Joe Kell, and Marianne Wainwright. Nick Volk was absent. Other city staff present: Cynthia Stimson, Cathy Bayne, Lynn Miller, Dave Yanecek, and Kevin Stensland. Motioned by Kell, seconded by Daly to approve the consent agenda. Ayes: Beer, Daly, Kell, and Wainwright. Nays: None. Absent: Volk. Motion carried. Discussion was held concerning the Commercial Sign Permit Application from Media Quest Signs for Diamond Limousine, at 407 E Southview Road in Fairfax. Building Inspector Dave Yanecek stated that two business identification signs are allowed on one C-2 property. They currently have two signs. If this new one is to be placed, one of the other signs will need to be removed. No other issues were found with this application. Motioned by Beer, seconded by Kell to approve the Commercial Sign Permit Application from Media Quest Signs for Diamond Limousine, at 407 E Southview Road for an electronic message sign to be placed on a building, if one of the existing signs are removed as required by code. Ayes: Beer, Daly, Kell, and Wainwright. Nays: None. Absent: Volk. Motion carried. Motioned by Kell, seconded by Daly to approve RESOLUTION NO. 2016-43,A RESOLUTION APPROVING THE PRELIMINARY PLAT FOR HEARTLAND HEIGHTS SUBDIVISION. Roll call vote: Ayes: Beer, Daly, Kell, and Wainwright. Nays: none. Absent: Volk. Motion carried. Mayor Pro Tempore Wainwright declared RESOLUTION 2016-43 duly adopted. Motioned by Beer, seconded by Daly to suspend the rule requiring that an ordinance be voted on for passage at two council meeting prior to this meeting with respect to ORDINANCE 37. Roll call vote: Beer, Daly, Kell, and Wainwright. Nays: None. Absent: Volk. Motion carried. Nick Volk entered the meeting at 6:12 PM. Motioned by Beer, seconded by Daly to approve final passage and adoption with respect to ORDINANCE 37 AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY,WHICH HAS BEEN RECENTLY ANNEXED INTO THE CITY OF FAIRFAX AND PLANNED FOR DEVELOPMENT AS REQUESTED BY OWNERS GORDON AND SHIRLEY SEVIG AND BRUCE SEVIG. Roll call vote: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Beer, seconded by Kell to approve RESOLUTION NO. 2016-44,A RESOLUTION TO PROCEED WITH THE INITIAL PHASE OF THE GRADING AND EROSION CONTROL IMPROVEMENTS TO HEARTLAND HEIGHTS FIRST ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: none. Motion carried. Mayor Pro Tempore Wainwright declared RESOLUTION 2016-44 duly adopted. Bids received on May 12, 2016, for the 2016 801' Street Water Main Extension Project were reviewed. Hall and Hall Engineers, Inc. is recommending approval of the lowest responsible bid, from Rathje Construction Company for $323,871.00. Motioned by Volk, seconded by Kell to approve RESOLUTION NO. 2016-45,A RESOLUTION APPROVING AND MAKING AWARD OF CONTRACT FOR THE 2016 80TH STREET WATER MAIN EXTENSION PROJECT. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: none. Motion carried. Mayor Pro Tempore Wainwright declared RESOLUTION 2016-45 duly adopted. Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2016-46,A RESOLUTION APPROVING A TEMPORARY CONSTRUCTION EASEMENT PURCHASE AGREEMENT BETWEEN THE CITY OF FAIRFAX AND WILLIAM E. BOLAND, JR. AND VERNA BOLAND FOR VACANT GROUND LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF HIGHWAY 151 AND 80TH STREET. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: none. Motion carried. Mayor Pro Tempore Wainwright declared RESOLUTION 2016-46 duly adopted. Bids received on May 12, 2016, for the 2016 Sanitary Sewer Interceptor Main Extension Project were reviewed. Hall and Hall Engineers, Inc. is recommending approval of the lowest responsible bid, from Cornerstone Excavating, Inc. for $902,615.30. Motioned by Beer, seconded by Kell to approve RESOLUTION NO. 2016-47,A RESOLUTION APPROVING AND MAKING AWARD OF CONTRACT FOR THE 2016 SANITARY SEWER INTERCEPTOR MAIN EXTENSION PROJECT. Motioned by Kell, seconded by Volk to approve RESOLUTION NO. 2016-48,A RESOLUTION APPROVING A TEMPORARY CONSTRUCTION EASEMENT PURCHASE AGREEMENT BETWEEN THE CITY OF FAIRFAX AND THOMAS J. ARP AND PATRICIA A. ARP FOR VACANT GROUND LOCATED AT THE NORTHWEST CORNER OF LOT 3,ARP'S MEADOWS FIRST ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Mayor Pro Tempore Wainwright declared RESOLUTION 2016-53 duly adopted. Shane Wicks informed the Council about the contractor finding a four inch water main along Vanderbilt. Staff is recommending replacing the four inch main with eight inch main. Motioned by Beer, seconded by Volk to approve RESOLUTION NO. 2016-54,A RESOLUTION TO APPROVE CHANGE ORDER NO. 2 FROM RATHJE CONSTRUCTION, CO. FOR THE PHASE 4 WATER MAIN AND VANDERBILT PAVEMENT RECONSTRUCTION PROJECT IN THE CITY OF FAIRFAX,LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: none.
