HomeMy WebLinkAbout11/09/2016 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING November 9, 2016 The regular meeting of the Fairfax City Council was held November 9, 2016, at Fairfax city hall at 300 80th Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council members present: Mike Daly, JoAnn Beer, Joe Kell, and Nick Volk. Absent: Marianne Wainwright. Other city staff present: Cynthia Stimson, Chris Philipp, Lynn Miller, Kevin Stensland, and Cathy Bayne. Motioned by Kell, seconded by Daly to approve the consent agenda. Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. David Simmons, of Signal 88, introduced their lead officer, Gerald, and discussed their patrolling. The City will provide them with contact information for the businesses in Fairfax. They will check their schedules and make sure they rotate the hours and days. Cathy Bayne stated the Library had an open house during voting. Lynn Miller mentioned that the fire department is working on the details of the grant award. Chris Philipp announced that he has passed the first test of the commercial inspector test series of four. Lynn Miller stated they need to get rid of the old street sweeper. The City has previously advertised and didn't find anyone interested in this piece of equipment. Staff is to scrap this street sweeper. The City of Fairfax is to take bids on a John Deer tractor with a snow blower. Kevin Stensland discussed a proposal from Northway Well and Pump to acidize wells 41 and 42. They will also televise the wells. The cost for each well would be $19,885.00. This would be done using the existing budget line in the LOST Fund. Motioned by Daly, seconded by Beer to do this work when the cash flow of the LOST Fund and weather permits. Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. JoAnn Beer reported that bench orders are coming in and the Haunted Trail went well. Lynn reported that the parks have been winterized. The holiday tree was discussed. A large tree was offered as a donation. The City had too much trouble keeping a large cut tree secured in the wind. The City will plant an eight foot live tree and hope it lives in this location. Multiple smaller trees may be decorated this year. Linn County Deputy Sheriff Egli presented the list of calls. Dan Swick and Aaron Votroubek gave a presentation about South Slope. Mayor Frieden opened a public hearing regarding a rezoning request from the City of Fairfax to rezone four parcels from C-2 Highway Commercial to CN Conservation/Public Use at 6:38 PM. The City Hall did not receive any written or oral comments. No one in the audience wanted to make comments. Mayor Frieden closed the public hearing at 6:39 PM. Motioned by Daly, seconded by Volk to introduce and approve the first reading of ORDINANCE NO. 45, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Motioned by Beer seconded by Daly to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 45. Motioned by Daly, seconded by Beer to approve final passage and adoption with respect to ORDINANCE NO. 45, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden opened a public hearing regarding adopting a revised Official Zoning Map at 6:40 PM. The City Hall did not receive any written or oral comments. No one in the audience wanted to make comments. Mayor Frieden closed the public hearing at 6:44 PM. Motioned by Volk, seconded by Beer to introduce and approve the first reading of ORDINANCE NO. 46, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY ADOPTING A NEW, REVISED OFFICIAL ZONING MAP. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Motioned by Beer seconded by Daly to suspend the rule requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 46. Mayor Frieden opened a public hearing regarding a Lease-Purchase Agreement in a principal amount not to exceed $26,880 for the purpose of acquiring copiers at 6:45 PM. The City Hall did not receive any written or oral comments. No one in the audience wanted to make comments. Mayor Frieden closed the public hearing at 6:47 PM. Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2016-116,A RESOLUTION APPROVING AND AUTHORIZING A LEASE PURCHASE AGREEMENT. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2016-116 duly adopted. Discussion was held concerning a commercial building permit application for 104 Williams Blvd. from Eastern Iowa Building, Inc. for solar panels, not on a building. Chris Philipp is recommending approval. Motioned by Daly, seconded by Volk to approve the commercial building permit application as submitted. Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Discussion was held concerning a commercial building permit application for 411 Creek Side Drive from Jeff Then for a deck off the second floor living quarters. Chris Philipp is recommending approval. Motioned by Beer, seconded by Volk to approve the commercial building permit application as submitted. Ayes: Beer,Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Motioned by Volk, seconded by Beer to approve RESOLUTION NO. 2016-117,A RESOLUTION PROVIDING FOR REDUCTION OF INTEREST RATE FOR SEWER REVENUE BOND. Roll call vote: Ayes: Beer, Daly, and Volk. Nays: None. Absent: Wainwright. Abstain: Kell. Joe Kell abstained because of a possible conflict of interest due to his employment. Motion carried. Mayor Frieden declared RESOLUTION 2016-117 duly adopted. Chris Philipp discussed a graph comparing current building permit fees for area communities for a sample house. He is recommending the City of Fairfax set their fees the same as Linn County's. Motioned by Beer, seconded by Volk to approve RESOLUTION NO. 2016-118,A RESOLUTION APPROVING BUILDING PERMIT FEE SCHEDULE. Roll call vote: Ayes: Beer, Kell, and Volk. Nays: Daly. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2016-121 duly adopted. Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2016-122,A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE PAYMENT OF DEBT INTEREST AND FEES DUE DECEMBER 1, 2016 AND LOAN ADVANCE FUNDS FOR PROJECT FUNDING. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2016- 122 duly adopted. Discussion was held concerning the minimum wage action in Linn County. Mayor Frieden showed information about other town's actions and discussed enforcement if we change the ordinance. Mike Daly stated he feels the first $1.00 increase is alright, but not the future increases. He gave some statistics about the effects of raising the minimum wage. Motioned by Daly to agree with the $8.25 for 2017, but then have Fairfax pass an ordinance to limit the increase to only this one, not how Linn County's ordinance is written for 2018 and 2019. This motion died for lack of a second. It was decided to place this issue on the October 2017 agenda to review the situation at that time. Motioned by Beer, seconded by Volk to approve RESOLUTION NO. 2016-123,A RESOLUTION TO APPROVE CHANGE ORDER NO. 2 -BALANCING FROM RATHJE CONSTRUCTION, CO. FOR THE 2016 80th STREET WATER MAIN EXTENSION PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2016-123 duly adopted. Joel Gross stated that Hall and Hall Engineers has found the 2016 80th Street Water Main Extension Project has been completed with substantial conformance to the project plans and specifications and recommends that the City of Fairfax accept this project. Motioned by Beer, seconded by Volk to approve RESOLUTION NO. 2016-124,A RESOLUTION TO ACCEPT THE 2016 80TH STREET WATER MAIN EXTENSION PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2016-124 duly adopted. Motioned by Beer, seconded by Volk to approve RESOLUTION NO. 2016-125,A RESOLUTION TO APPROVE THE FINAL PAY APPLICATION FROM RATHJE CONSTRUCTION COMPANY FOR THE 2016 80TH STREET WATER MAIN EXTENSION PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2016-125 duly adopted. Shane Wicks explained the calculation of the proposed water main connection fee for the 2016 80th Street Water Main Extension Project. Motioned by Volk, seconded by Beer to approve RESOLUTION NO. 2016-126,A RESOLUTION ESTABLISHING WATER MAIN CONNECTION FEES RELATIVE TO THE 2016 80TH STREET WATER MAIN EXTENSION PROJECT. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2016-126 duly adopted. Mayor Frieden discussed the situation about the driveway slope at 223 Nickolet. He authorized the City to remove a portion of the new driveway and the homeowner had a family member re-pour that portion. The proposed reimbursement is for the concrete only at the contract price. Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2016-127,A RESOLUTION APPROVING PAYMENT FOR DRIVEWAY WORK. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Joel Gross stated that Hall and Hall Engineers has found the Phase 4 Water Main Replacement and Vanderbilt Street Paving Reconstruction Project has been completed with substantial conformance to the project plans and specifications and recommends that the City of Fairfax accept this project. The 2016 Sanitary Sewer Interceptor Main Project was discussed. The road is done, the leaks are fixed, and some incentives were paid. The mandrel test still needs to be completed. Motioned by Daly, seconded by Beer to approve RESOLUTION NO. 2016-131,A RESOLUTION TO APPROVE PAY APPLICATION NO. 4 FROM CORNERSTONE EXCAVATING, INC. Shane Wicks discussed the calculations of the sanitary sewer connection fees for the 2016 Sanitary Sewer Interceptor Main Extension Project. Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2016-132,A RESOLUTION ESTABLISHING SANITARY SEWER CONNECTION FEES RELATIVE TO THE 2016 SANITARY SEWER INTERCEPTOR MAIN EXTENSION PROJECT. Mayor Frieden declared RESOLUTION 2016-133 duly adopted. Joel Gross' recommendation concerning the traffic signage on Front Street near the new trail crossing was discussed. JoAnn Beer asked that the middle of the new trail be painted with a line. This will not happen until spring. Motioned by Daly, seconded by Beer to approve the traffic signage on Front Street near the new trail crossing as recommended by Joel Gross of Hall and Hall Engineers. Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Shane Wicks discussed Linn County's Both Street PCC Overlay Project. A suggested stop/begin spot was determined. The City will not participate in this project and Linn County will not participate in future improvements of 80th Street between this project and Highway 151. Shane will discuss the City's input with Linn County. Shane Wicks discussed the process for a Plat of Survey. Mayor Frieden can approve the Plat of Survey by letter with the condition about access. JoAnn asked if the City of Fairfax had a setback requirement on a side yard for a parking lot. She was informed no, but that Fairfax State Savings Bank and the adjoining property owner came to an agreement during the rezoning process. There will be a setback with some sort of screening, either a fence or vegetation. Chris Philipp was instructed to put the nuisance update in the packet. Mayor Frieden pointed out that serving the property owner by a Linn County Deputy worked well. Joel Gross reported that a resident gave him input that the City of Fairfax has great events. Mayor Frieden let the Council know that the auditor retired without informing the City of Fairfax, so we have sent out RFPs which they will review in December. He reported that sidewalks were discussed during a recent mayor's meeting. We should get written agreements with the properties that we have delayed required sidewalk installation. He discussed meeting with Alliant about the possible mega park project. Shane's list of discussion points is to be sent to the Council. Motioned by Daly, seconded by Volk to adjourn the meeting.
