Home My WebLink About03-14-2017 Council MinutesCITY OF FAIRFAX REGULAR CITY COUNCIL MEETING March 14, 2017 The regular meeting of the Fairfax City Council was held March 14, 2017, at Fairfax city hall at 300 80"' Street Court. Mayor Frieden called the meeting to order at 6:02 PM. Council members present: JoAnn Beer, Mike Daly, and Joe Kell. Nick Volk and Marianne Wainwright were absent. Other city staff present: Cynthia Stimson, Lynn Miller, Kevin Stensland, and Cathy Bayne. Mayor Frieden stated not all of the financial reports for February are ready. Motioned by Beer, seconded by Daly to approve the consent agenda. Ayes: Beer, Daly, and Kell. Nays: None. Absent: Volk and Wainwright. Motion carried. Nick Volk entered at 6:04 PM. David Simmons, with Signal 88, reported that he is monitoring Facebook posts, doing house checks, and still needs to schedule a meeting with staff to review areas. Cathy Bayne reported the spring break activities have had a huge participation, with over 100 people each day. She inforined the City Council that the libraries in Fairfax, Ely, and Swisher have been working together on activities and planning. June 9 will be Fairfax day at the ballpark with the CR Kernels. Fire Chief Mike Sankot reported it has been a slow month for the fire department. Lynn Miller reported that the maintenance department has been working on street signs and painting city hall. Joe Kell informed Lynn that FYSA will have a work day at the parks onApril 1 and the Easter Egg Dash on April 8, both of which need the restrooms working. Kevin Stensland reported that the wastewater plant is working well and we are getting great water from the water filtration. The City sent a lead and copper survey to residential property in the older section of Fairfax. Information will be used to select testing locations and compile information for the IDNR. A Linn County Deputy entered and distributed the list of calls. Annette McKeever gave the Parks and Beautification Committee's report. She stated the Easter Egg Dash is April 8, the park bench program is popular, and they are working on dog park specifics. They have received 90 positive comments about this project. Charlie Garwood reviewed the City's insurance renewal quote. Motioned by Volk, seconded by Beer to approve RESOLUTION NO. 2017-05 A RESOLUTION AUTHORIZING COMMERCIAL INSURANCE COVERAGE FOR THE CITY OF FAIRFAX. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2017-05 duly adopted. Mayor Frieden opened the public hearing regarding the budget for fiscal year 2017-2018 at 6:19 PM. No written or oral comments have been received at city hall. No one in the audience had comments. Mayor Frieden closed the public hearing at 6:20 PM. Motioned by Daly, seconded by Kell to approve RESOLUTION NO. 2017-06 A RESOLUTION APPROVING CITY OF FAIRFAX'S ANNUAL BUDGET FOR FISCAL YEAR 2017-2018. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2017-06 duly adopted. Discussion was held about the proposed 90 day agreement with Signal 88 for patrolling. The end date is to be corrected in the agreement to June 30, 2017. The amount is to be corrected in the resolution to $25.38. Motioned by Daly, seconded by Beer to approve RESOLUTION NO. 2017-07 A RESOLUTION ENTERING INTO A SECURITY PATROL AGREEMENT WITH SIGNAL 88 SECURITY. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2017-07 duly adopted. No one was present to discuss USA Days. Shane Wicks stated that the documents for Heartland Heights Development are ready and he discussed the process. Motioned by Volk, seconded by Beer to approve RESOLUTION NO. 2017-08 A RESOLUTION ESTABLISHING HOW WATER MAIN CONNECTION FEES RELATIVE TO THE HEARTLAND HEIGHTS DEVELOPMENT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA ARE TO BE DETERMINED. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2017-08 duly adopted. Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2017-09 A RESOLUTION ESTABLISHING HOW SANITARY SEWER CONNECTION FEES RELATIVE TO THE HEARTLAND HEIGHTS DEVELOPMENT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA ARE DETERMINED. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2017-09 duly adopted. Motioned by Daly, seconded by Kell to approve RESOLUTION NO. 2017-10 A RESOLUTION TO ENTER INTO AN AGREEMENT WITH LKJ ENTERPRISES, LLC FOR CONNECTION TO THE CITY OF FAIRFAX'S SANITARY SEWER SYSTEM. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2017-10 duly adopted. Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2017-11 A RESOLUTION APPROVING THE FINAL PLAT, DEVELOPMENT AGREEMENT, AND ASSOCIATED OFF-SITE EASEMENTS FOR HEARTLAND HEIGHTS FIRST ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2017-11 duly adopted. The Sobaski Real Estate Site Plan of Improvements and Site Plan Conditions Agreement was briefly discussed. They have signed the document. Shane Wicks, city engineer is not recommending approval. Motioned by Kell, seconded by Daly to approve RESOLUTION NO. 2017-12 A RESOLUTION TO ENTER INTO A SITE PLAN CONDITIONS AGREEMENT FOR LOT 2 OF JAMES KURTZ'S SECOND ADDITION TO FAIRFAX, IOWA, AND FOR PARCEL A, PLAT OF SURVEY NO 2111 WITH SOBASKI REAL ESTATE, LLC. Chris Philipp's recommendation to approve the interior commercial building pen -nit application for 825 Eagleview Drive and 826 Eagleview Drive was reviewed. Motioned by Kell, seconded by Daly to approve an interior commercial building permit application for 825 Eagleview Drive and an interior commercial building pen -nit application for 826 Eagleview Drive. Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Information from Speer Financial was reviewed concerning the next bond. Some projects were removed from the funding list due to timing and amount. Fire Chief Mike Sankot asked about a training building addition at the current fire station. Site restrictions, alternate locations, cost, and timing were discussed. Motioned by Beer, seconded by Volk to approve RESOLUTION NO. 2017-13 A RESOLUTION SETTING THE DATE FOR A PUBLIC HEARING ON 2017 AMENDMENT TO URBAN RENEWAL PLAN FOR FAIRFAX URBAN RENEWAL AREA. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2017-13 duly adopted. Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2017-14 A RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING CONCERNING AMENDING PART OF THE FAIRFAX ZONING CODE 2012 FOR THE CITY OF FAIRFAX. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2017-14 duly adopted. Shane Wicks discussed the process to redesign the West Cemetery and Eagleview intersection. Designing now will benefit timing with the IDOT road project and get this in place before the City designs the replacement of the West Cemetery Bridge. But, to implement the redesign will involve obtaining property. No one made a motion to proceed with this project. Motioned by Daly, seconded by Kell to approve RESOLUTION NO. 2017-15 A RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF FAIRFAX AND HALL AND HALL ENGINEERS, INC. The city clerk/treasurer reviewed the proposed changes to the personnel policy manual. Motioned by Beer, seconded by Daly to approve RESOLUTION NO. 2017-18 A RESOLUTION TO APPROVE THE PERSONNEL POLICY MANUAL. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Motioned by Beer, seconded by Volk to approve RESOLUTION NO. 2017-19 A RESOLUTION APPROVING THE CONTRACT FOR LAW ENFORCEMENT SERVICE WITH LINN COUNTY AND THE LINN COUNTY SHERIFF'S DEPARTMENT FOR FISCAL YEAR 2017-2018 BUDGET. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2017-19 duly adopted. Motioned by Volk, seconded by Kell to approve RESOLUTION NO. 2017-20, A RESOLUTION APPROVING A SHARED COUNTY AND CITY PROJECT 28E AGREEMENT WITH LINN COUNTY FOR 80TH STREET. Roll call vote: Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2017-20 duly adopted. Discussion was held about water and sewer system certifications. Mayor Frieden suggested a table of pay increases that would be tied to an employee receiving a specific certification. Joe Kell suggested adding that an employee would require city council approval before starting to train and test for a new certification. Mike Daly suggested one change to the proposed table of pay increases tied to certifications. Dave Yanecek is to receive a $3.00 an hour raise for his certifications. Lynn Miller and Brian Merta are to receive a 50 cents an hour raise for their new Wastewater Grade 1 certifications. Motioned by Daly, seconded by Kell to approve RESOLUTION NO. 2017-21, A RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES as amended during this discussion. Discussion was held concerning a quote from Midwest Janitorial for cleaning the city hall. More quotes are to be obtained. Tom Arp stated that enforcement is needed on West Cemetery Road. There are a few frequent speed limit violators. He thanked the Council for requesting more quotes for cleaning and discussed city purchasing. He was encouraged to view the council packet online. The City will soon start to bill city locations for sewer service. Motioned by Daly, seconded by Kell to approve the claims list dated March 14, 2017. Ayes: Beer, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden announced that negotiations with the City of Cedar Rapids have stopped. Mike Daly will not be at the April meeting.
