SPECIAL CITY COUNCIL MEETING
May 30, 2017
The special meeting of the Fairfax City Council was held May 30, 2017, at Fairfax city hall
at 300 80"' Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council
members present: JoAnn Beer, Mike Daly, Joe Kell, Nick Volk, and Marianne Wainwright.
Other city staff present: Cynthia Stimson, Cathy Bayne, and Mike Sankot.
Motioned by Daly, seconded by Volk to approve the consent agenda. Ayes: Beer, Daly,
Kell, Volk, and Wainwright. Nays: None. Motion carried.
Larry Burger, with Speer Financial, discussed the bids received for the $955,000 Corporate
Purpose and Refunding Bonds Series 2017. The bids received were as follows:

Larry recommended the City of Fairfax accept the bid from United Banker's Bank,
Bloomington, MN, for 2.1556% for a bond issue of $949,747.50 with discount.
Motioned by Beer, seconded by Kell to approve RESOLUTION NO. 2017-48, A
RESOLUTION AWARDING SALE OF GENERAL OBLIGATION CORPORATE
PURPOSE AND REFUNDING BONDS, SERIES 2017 AND AUTHORIZING
REDEMPTION OF OUTSTANDING BONDS. Roll call vote: Ayes: Beer, Daly, Kell, Volk,
and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2017-
48 duly adopted.
Discussion was held on the proposed revisions to the electric code.
Motioned by Volk, seconded by Daly to introduce and approve the first reading of
ORDINANCE NO. 55, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 156 NATIONAL ELECTRIC CODE. Ayes: Beer, Daly, Kell, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Beer to suspend the rule requiring that an ordinance be voted
on for passage at two council meetings prior to this meeting with respect to ORDINANCE 55.
Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Volk to approve final passage and adoption with respect to
ORDINANCE NO. 55, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 156 NATIONAL ELECTRIC CODE. Ayes: Beer, Daly, Kell, Volk, and
Wainwright. Nays: None. Motion carried.
Mayor Frieden and Joe Kell met with the USA Days Committee to discuss details of the
celebration activities. They will have security at the dance each night, each end manned,
pedestrians needing through will be given an escort through the fenced area, the fencing will be
removed during the day on Saturday, and the Ferris wheel will be placed in the grass. Mike
Sankot suggested the City be more involved with the Committee's early planning next year.
Discussion was held about the new fireworks regulations. Due to the timing that the new law
goes into effect, the City of Fairfax will not be taking any action at this time. It was suggested
the City send a mailer out to residents highlighting the law's details. This issue will be reviewed
after July 8, when the first sale and use period ends. Based on what happens, Fairfax may take
action before the next sale and use period begins.
Motioned by Volk, seconded by Beer to adjourn the meeting. Ayes: Beer, Daly, Kell, Volk,
and Wainwright. Nays: None. Motion carried.
Mayor Frieden adjourned the meeting at approximately 6:45 PM.
