REGULAR CITY COUNCIL MEETING
September 12, 2017
The regular meeting of the Fairfax City Council was held September 12, 2017, at Fairfax city
hall at 300 80'h Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council
members present: JoAnn Beer, Joe Kell, Nick Volk, and Marianne Wainwright. Mike Daly was
absent. Other city staff present: Cynthia Stimson, Brian Merta, and Kevin Stensland. Chris
Philipp entered later.
Motioned by Kell, seconded by Volk to approve the consent agenda, with the August 8,
2017, city council minutes as amended. Ayes: Beer, Kell, Volk, and Wainwright. Nays: None.
Absent: Daly. Motion carried.
Linn County Deputy Stephens presented the list of calls. Vehicles stolen were discussed.
David Simmons, with Signal 88, noted parking violations. He was instructed to keep these in
the report, but not start their tickets. Activity at the quarry was discussed. This is a private area
and he was instructed not to patrol this activity. An open fire at the Fairfax Greenhouse was
discussed. They were instructed to report such things.
Fire Chief Mike Sankot discussed using a building on the other side of the creek from the fire
station during the IDOT bridge projects to store some equipment. The building will need some
upgrades. He is to write up a proposal with the property owner.
Brian Merta reported that the street repairs are completed and the tree and stump near
Reynolds Street have been removed. They have been working on street signs, painted the
pavilions and old concession stand and are working on Fetter Field.
Kevin Stensland reported that they are reconditioning well 43 today, it will be televised
tomorrow. The lift station pump will be installed tomorrow. They have completed the hydrant
flushing, installed the generator at the pump house, and installed some of the Storz fittings. The
IDNR did an inspection, which went well. The initial tests for lead and copper were over the
allowable limit, but we are in the process of getting one of the samples thrown out due to the
collection manner.
JoAnn Beer reported the Fairfax Lions Club is planning a service project for the parks and
the parks brochure needs to be updated.
Motioned by Wainwright, seconded by Kell to officially name the park on Driftwood Lane
Driftwood Park. Ayes: Beer, Kell, Volk, and Wainwright. Nays: None. Absent: Daly.
Motion carried.
Tim Smith, with Lucky's discussed his application for a Class C Liquor License.
Motioned by Kell, seconded by Volk to approve the new application for a Class C Liquor
License, Sunday Sales, and Outdoor Service at Lucky's in Fairfax. Ayes: Beer, Kell, Volk, and
Wainwright. Nays: None. Absent: Daly. Motion carried.
Discussion was held about Jacob Hargrafen's bill. No action was taken.
Zach Sobaski discussed EIB's future plans for their commercial property. Chris Philipp's
building department report was reviewed. Some of their proposed plans go against the building
code and would require changes to the Fairfax Zoning Code. The need for fire protection in the
area was stressed by Fire Chief Mike Sankot. Needed public improvements were discussed. The
Fairfax Planning and Zoning Commission can place the topic of commercial condos on their next
agenda.
Lots 91 and 92 in Heartland Heights First Addition were discussed. Shane wicks
recommends to release these two lots from the requirement to hold them for possible water
detention. Because of the progress being made on the plans for the pond, he feels these two lots
should be allowed to have building permits issued.
Motioned by Kell, seconded by Volk to release Lots 91 and 92 in Heartland Heights First
Addition for issuance of building permits. Ayes: Beer, Kell, Volk, and Wainwright. Nays:
None. Absent: Daly. Motion carried.
Shane Wicks discussed his recommendation for a revised Preliminary Plat for Heartland
Heights. The developers would like to plat the Second Addition before submitting a revised
preliminary Plat. Shane Wicks feels this would be acceptable since this Second Addition
includes only ten lots in addition from the original layout of the First Addition. Some Beverly
Road improvements will need to be moved to the Third Addition.
Motioned by Wainwright seconded by Kell to allow Heartland Heights Second Addition to
be platted before the revised Preliminary Plat is finalized, realizing some of the Development
Agreement conditions will need to be changed. The Second Addition will have the rest of the
original First Addition plus 10 additional lots. Ayes: Beer, Kell, Volk, and Wainwright. Nays:
None. Absent: Daly. Motion carried.
Ed Birch, EB Solutions, Inc., and Shane Wicks discussed possible plans for plantings in and
around the pond and trail in Heartland Heights. Linn County has funding for pollinators. It was
stressed that it is important to address the sediment correctly from the beginning.
Shane Wicks gave an update about the 2017 80th Street Water Main Extension Project. It
was installed quickly and the project is done.
Motioned by Wainwright, seconded by Beer to approve RESOLUTION 2017-76, A
RESOLUTION TO APPROVE CHANGE ORDER NO. 3 FROM SCHRADER
EXCAVATING AND GRADING CO. FOR THE 2017 801h STREET WATER MAIN
EXTENSION PROJECT IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call
vote: Ayes: Beer, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried.
Mayor Frieden declared RESOLUTION 2017-76 duly adopted.
Motioned by Beer, seconded by Kell to approve RESOLUTION 2017-77, A
RESOLUTION TO APPROVE PAY APPLICATION NO. 1 FROM SCHRADER
EXCAVATING AND GRADING CO. FOR THE 2017 80TH STREET WATER MAIN
EXTENSION PROJECT IN FAIRFAX IOWA. Roll call vote: Ayes: Beer, Kell, Volk, and
Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Frieden declared
RESOLUTION 2017-77 duly adopted.
Motioned by Volk, seconded by Kell to approve RESOLUTION 2017-78, A
RESOLUTION TO APPROVE CHANGE ORDER NO. 4 -BALANCING FROM
CORNERSTONE EXCAVATING, INC. FOR THE 2016 SANITARY SEWER
INTERCEPTOR MAIN EXTENSION PROJECT IN THE CITY OF FAIRFAX,
LINN COUNTY, IOWA. Roll call vote: Ayes: Beer, Kell, Volk, and Wainwright. Nays:
None. Absent: Daly. Motion carried. Mayor Frieden declared RESOLUTION 2017-78 duly
adopted.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION 2017-79, A
RESOLUTION ENTERING INTO A POST—ACCEPTANCE AGREEMENT FOR THE
2016 SANITARY SEWER INTERCEPTOR MAIN EXTENSION CONTRACT WITH
CORNERSTONE EXCAVATING, INC. Roll call vote: Ayes: Beer, Kell, Volk, and
Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Frieden declared
RESOLUTION 2017-79 duly adopted.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION 2017-80, A
RESOLUTION TO APPROVE PAY APPLICATION NO. 5 (FINAL) FROM
CORNERSTONE EXCAVATING, INC. FOR THE 2016 SANITARY SEWER MAIN
EXTENSION PROJECT IN FAIRFAX IOWA. Roll call vote: Ayes: Beer, Kell, Volk, and
Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Frieden declared
RESOLUTION 2017-80 duly adopted.
Chris Philipp informed the City Council that the City has purchased one of the tax
certificates for 510 Church Street. There will be different plans submitted to the City to build a
house at this location. The City will pick a plan to present to Linn County when we request they
release their portion of the existing tax certificate. Hopefully, these plans will be ready to review
during the next meeting.
Motioned by Kell, seconded by Volk to approve RESOLUTION 2017-81, A
RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING
CONCERNING THE CITY OF FAIRFAX ACQUIRING THE LOT AT 510 CHURCH
STREET AND SELLING THIS LOT FOR DEVELOPMENT. Roll call vote: Ayes: Beer,
Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Frieden
declared RESOLUTION 2017-81 duly adopted.
Discussion was held about the proposed revisions to Chapter 65 of the Fairfax Code.
Motioned by Wainwright, seconded by Beer to introduce and approve the first reading of
ORDINANCE NO. 57, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 65 STOP OR YIELD REQUIRED REGULATIONS. Roll call vote: Ayes: Beer,
Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried.
Motioned by Kell, seconded by Beer to suspend the rule requiring that an ordinance be voted
on for passage at two council meetings prior to this meeting with respect to ORDINANCE 57.
Roll call vote: Ayes: Beer, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion
carried.
Motioned by Beer, seconded by Kell to approve final passage and adoption with respect to
ORDINANCE NO. 57, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 65 STOP OR YIELD REQUIRED REGULATIONS. Roll call vote: Ayes: Beer,
Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried.

vote: Ayes: Beer, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried.
Mayor Frieden declared RESOLUTION 2017-84 duly adopted.
Motioned by Kell, seconded by Beer to approve RESOLUTION 2017-85, A RESOLUTION
APPROVING ANNUAL URBAN RENEWAL REPORT FOR FISCAL YEAR 2016-2017.
Roll call vote: Ayes: Beer, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion
carried. Mayor Frieden declared RESOLUTION 2017-85 duly adopted.
Motioned by Kell, seconded by Beer to approve RESOLUTION 2017-86, A RESOLUTION
AUTHORIZING TRANSFERS. Roll call vote: Ayes: Beer, Kell, Volk, and Wainwright. Nays:
None. Absent: Daly. Motion carried. Mayor Frieden declared RESOLUTION 2017-86 duly
adopted.
Discussion was held concerning the reimbursement of class tuition to Kim Donaldson for
Municipal Professional's Institute this summer in Ames.
Motioned by Kell, seconded by Volk to approve the reimbursement of $540.00 to Kim
Donaldson for class tuition for training. Ayes: Beer, Kell, Volk, and Wainwright. Nays: None.
Absent: Daly. Motion carried.
Discussion was held about Kim's recommended hourly wage.
Motioned by Kell, seconded by Beer to approve RESOLUTION 2017-87, A RESOLUTION
APPROVING WAGES FOR CITY EMPLOYEES. Roll call vote: Ayes: Beer, Kell, Volk,
and Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Frieden declared
RESOLUTION 2017-87 duly adopted.
Discussion was held about the concept of an employee choosing the HSA health insurance
option and having the premium difference deposited into their HSA account.
Motioned by Wainwright, seconded by Kell for the City of Fairfax to deposit the premium
difference of Kim's HSA health insurance policy into her HSA account. The City will modify the
personnel policy to be clear about this option in the near future. Ayes: Beer, Kell, Volk, and
Wainwright. Nays: None. Absent: Daly. Motion carried.
City clerk/treasurer Cynthia Stimson gave an update about the City's taxable valuation. Linn
County Auditor's Office included the ground which was annexed in May of 2016 in the taxable
valuations as of January 1, 2016, without notifying the City. Adjustments were needed to some
tax bills for the implementation schedule of city taxes for properties which existed at the time of
the annexation. Stacey Law, Deputy Linn County Auditor, was present to answer any questions.
Motioned by Beer, seconded by Volk to approve the claims list dated September 12, 2017.
Ayes: Beer, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried.
Don Lacy asked about water to the other side of Highway 151. Plans were discussed.
Mayor Frieden let the City Council know that the City has sent a proposal to the City of
Cedar Rapids and they are reviewing.
The city clerk/treasurer informed the City Council that she, Mayor Frieden, and Chris Philipp
will be attending the Iowa League of Cities Annual Conference in Davenport at the end of
September.

Wainwright. Nays: None. Absent: Daly. Motion carried.
