REGULAR CITY COUNCIL MEETING
November 14, 2017
The regular meeting of the Fairfax City Council was held November 14, 2017, at Fairfax city
hall at 300 80th Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council
members present: JoAnn Beer, Mike Daly, Nick Volk, and Marianne Wainwright. Joe Kell was
absent. Other city staff present: Cynthia Stimson, Chris Philipp, Kevin Stensland, Lynn Miller,
and Cathy Bayne.
Motioned by Daly, seconded by Beer to approve the consent agenda. Ayes: Beer, Daly,
Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried.
David Simmons, with Signal 88, discussed several issues including vehicles, an open door,
and vandalism.
Cathy Bayne informed the City Council they have been working on the library building and
are currently closed for carpet installation.
Fire Chief Mike Sankot stated they have had 205 calls so far in 2017. ISO recently did a
review for Fairfax's insurance rating.
Chris Philipp presented the Building Department Report. He discussed setting up the
commercial and rental property fire inspection program as well as the Rust Free procedure.
Lynn Miller stated they have the salt and sand ready for streets and will be putting up the
holiday decorations this week.
Kevin Stensland reviewed a well flows report. He asked for City Council permission to send
Mike Rammelsberg to his Water I—Treatment training.
Motioned by Wainwright, seconded by Volk to send Mike Rammelsberg to Water I—
Treatment training at Kirkwood. Ayes: Beer, Daly, Volk, and Wainwright. Nays: None.
Absent: Kell. Motion carried.
JoAnn Beer reported the Parks and Beautification Committee held a candidates forum,
participated in the Haunted Trail, will participate in Winterfest on December 2, and have been
working on the dog park issue.
Discussion was held concerning the two building plans for 510 Church Street.
Motioned by Daly, seconded by Wainwright to approve RESOLUTION 2017-95, A
RESOLUTION TO CONSIDER PLAN TO BE PRESENTED TO LINN COUNTY
BOARD OF SUPERVISORS REGARDING TAX LIEN AT 510 CHURCH STREET with
the Costigan Construction plan the one to present. Roll call vote: Ayes: Daly, Volk, and
Wainwright. Nays: Beer. Absent: Kell. Motion carried. Mayor Frieden declared
RESOLUTION 2017-95 duly adopted.
Annette McKeever gave a presentation from the Off Leash Dog Park Committee, a
subcommittee of the Fairfax Parks and Beautification Committee. Shannon Day, from K9 Cola,
gave information about their process. Annette stated that the Parks and Beautification
Committee would like the City Council to approve use of 1.5 acres at The Complex for an off
leash dog park. They propose to use $5,000 from the Parks and Beautification Committee's
savings account and $20,000 of the net farm profits to fund the initial costs of this project. The
net farm profits have always been used for park projects. Discussion was held about their
proposal, the parks budget, and future park needs.
Motioned by Wainwright, seconded by Beer to approve use of 1.5 acres at The Complex for
an off leash dog park using $5,000 from the Parks and Beautification Committee's savings
account and $20,000 of the net farm profits to fund the initial costs of this project. Ayes: Beer
and Wainwright. Nays: Daly and Volk. Absent: Kell. The motion was defeated.
Mike Daly, who voted with the prevailing side, asked that this issue be reconsidered in
December before a full council.
Chris Philipp recommended approval of the commercial building permit from K & B Ag
Supply at 701 Williams Blvd. He stated this is an office space addition and not big enough to
require storm water plans.
Motioned by Wainwright, seconded by Volk to approve the commercial building permit from
K&B Ag Supply at 701 Williams Blvd. as submitted. Ayes: Beer, Daly, Volk, and Wainwright.
Nays: None. Absent: Kell. Motion carried.
Discussion was held about the possibility of not having city council review commercial
building permits. The City Council did not wish to enact this change at this time.
Shane Wicks discussed the new proposed layout of Prairie Creek Estates 9th Addition. This
is being recommended with the condition that the driveway for Lot 3 stays entirely out of the
concrete boxout for the storm sewer intake located along the north side of Ridge View Drive.
Motioned by Daly, seconded by Volk to approve the new site plan of Prairie Creek Estates

Mike Sankot requested that the City change the address numbers of two residences in Prairie
Creek Estates 7th Addition to make it easier to locate in an emergency. Chris Mottinger
discussed the costs involved to do this. He asked that if the City requires this change, the City
reimburse all parties for any costs involved to make the change. Gayla Foubert, 295 Ridge
View Drive, is a resident of one of the properties. She asked that the City not make this change
and if they do, to delay it until next summer. She hopes to be moved by that time.
Motioned by Wainwright, seconded by Volk to table this issue until July of 2018. Ayes:
Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried.
Shane Wicks discussed the status of the public improvements in Heartland Heights. The
development agreement tied unlimited number of building permits to the acceptance of the
public improvements. The developers are asking for that clause to be rewritten so that the City
of Fairfax would hold payment of participation costs until all of the public improvements are
completed next spring and to lower the Letter of Credit for the public improvements. Only
minor issues remain to be completed.
Motioned by Wainwright, seconded by Daly to approve RESOLUTION 2017-96, A
RESOLUTION ACCEPTING THE PUBLIC IMPROVEMENTS TO HEARTLAND
HEIGHTS FIRST ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA.
Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion
carried. Mayor Frieden declared RESOLUTION 2017-96 duly adopted.
Motioned by Wainwright, seconded by Daly to approve RESOLUTION 2017-97, A
RESOLUTION ACCEPTING A MODIFIED LETTER OF CREDIT FOR THE PUBLIC
IMPROVEMENTS IN HEARTLAND HEIGHTS 1ST ADDITION. Roll call vote: Ayes:
Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried. Mayor
Frieden declared RESOLUTION 2017-97 duly adopted.
Motioned by Wainwright, seconded by Daly to approve RESOLUTION 2017-98, A
RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING
CONCERNING AMENDING THE 2012 FAIRFAX ZONING CODE OF THE CITY OF
FAIRFAX. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent:
Kell. Motion carried. Mayor Frieden declared RESOLUTION 2017-98 duly adopted.
Chris Philipp discussed the proposed changes to the Fairfax Building Code. The amendment
will change the deck footing requirements and add information about commercial condos.
Motioned by Wainwright, seconded by Daly to introduce and approve the first reading of
ORDINANCE 61, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 153-BUILDING CODE. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright.
Nays: None. Absent: Kell. Motion carried.
Zach and Justin Sobaski discussed their plans for Henry and Halle's Preliminary Plat and
possible city participation. They were directed to continue to work with the City of Fairfax to
get a development agreement that is acceptable to both sides for consideration.
Residents discussed fireworks, both pro and against.
Motioned by Volk, seconded by Daly to introduce and approve the first reading of
ORDINANCE 59, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY ADDING CHAPTER
119, FIREWORKS AND REPEALING SECTION 41.12. Roll call vote: Ayes: Beer, Daly,
Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried.
Motioned by Daly, seconded by Volk to suspend the rule requiring that an ordinance be
voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE
59. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell.
Motion carried.
Motioned by Daly, seconded by Volk to give final approval to ORDINANCE 59, AN
ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2012, OF
THE CITY OF FAIRFAX, IOWA, BY ADDING CHAPTER 119, FIREWORKS AND
REPEALING SECTION 41.12. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright.
Nays: None. Absent: Kell. Motion carried.
Motioned by Beer, seconded by Daly to approve RESOLUTION 2017-99, A
RESOLUTION SETTING FEE FOR FIREWORKS VENDOR SITE INSPECTION. Roll
call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion
carried. Mayor Frieden declared RESOLUTION 2017-99 duly adopted.
Motioned by Beer, seconded by Wainwright to approve RESOLUTION 2017-100, A
RESOLUTION IN SUPPORT OF THE FEDERAL HISTORIC TAX CREDIT
PROGRAM. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent:
Kell. Motion carried. Mayor Frieden declared RESOLUTION 2017-100 duly adopted.
Barb Conner, 101 Williams Blvd., gave a presentation about the IDOT's future construction
project. She requested the City to ask the IDOT to remove the pedestrian sidewalks on the
bridges and to stop any plans to make a trail between the bridges along Highway 151.
Discussion was held about the City's plans and the IDOT's process.
Shane Wicks discussed the West Cemetery Road/Eagleview Drive/Highway 151 intersection
realignment.
Motioned by Daly, seconded by Volk to direct Hall and Hall Engineers, Inc., to submit this
realignment plan to the IDOT for their consideration during design of their construction project
of Highway 151. Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell.
Motion carried.
Shane Wicks briefly discussed the water study preliminary report process.
Shane Wicks discussed information from ITC about their transmission lines. It was the
consensus that the City would prefer the poles 20 feet off the right of way line.

RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING
CONCERNING UPDATING 2012 FAIRFAX ZONING CODE FOR THE CITY OF
FAIRFAX. Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent:
Kell. Motion carried. Mayor Frieden declared RESOLUTION 2017-101 duly adopted.
The city clerk/treasurer discussed the proposed TIF Certification forms.
Motioned by Beer, seconded by Daly to approve RESOLUTION 2017-102, A
RESOLUTION APPROVING THE TIF CERTIFICATION FORMS. Roll call vote: Ayes:
Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried. Mayor
Frieden declared RESOLUTION 2017-102 duly adopted.
The city clerk/treasurer discussed the proposed transfers.
Motioned by Beer, seconded by Daly to approve RESOLUTION 2017-103, A
RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE PAYMENT
OF DEBT INTEREST AND FEES DUE DECEMBER 1, 2017 AND PROJECT COSTS.
Roll call vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion
carried. Mayor Frieden declared RESOLUTION 2017-103 duly adopted.
The city clerk/treasurer announced that if anyone has questions about the annual report, to
give her a call or stop by.
Motioned by Beer, seconded by Daly to accept the Annual Financial Report for FY2017.
Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried.
Discussion was held concerning the Income Offset Program. Staff was directed to draft the
needed ordinance changes to raise the required deposit if new residents do not want to supply
their social security number and a resolution to participate.
Motioned by Beer, seconded by Volk to approve RESOLUTION 2017-104, A
RESOLUTION AUTHORIZING AND DIRECTING THE CITY CLERK/TREASURER
TO WRITE-OFF CERTAIN UTILITY ACCOUNTS AS UNCOLLECTIBLE. Roll call
vote: Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried.
Mayor Frieden declared RESOLUTION 2017-104 duly adopted.
Motioned by Wainwright, seconded by Beer to approve the claims listed dated November 14,
2017, as submitted. Ayes: Beer, Daly, Volk, and Wainwright. Nays: None. Absent: Kell.
Motion carried.
Mike Daly asked about a payment arrangement for an insurance policy. The city
clerk/treasurer informed him that the first payment was made via debit card and reoccurring
payments are set up to happen the last business day of the month.
Nick Volk asked if the City requires LED street lights. The street lights in Heartland Heights
belong to Linn County REC and they do not currently install LED street lights.
Mayor Frieden informed the City Council that the City met again with the City of Cedar
Rapids, with no progress being made on the 28E Annexation Agreement negotiations.
The city clerk/treasurer wished everyone a Happy Thanksgiving.
