REGULAR CITY COUNCIL MEETING
December 12, 2017
The regular meeting of the Fairfax City Council was held December 12, 2017, at Fairfax city
hall at 300 80th Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council
members present: JoAnn Beer, Mike Daly, Joe Kell, Nick Volk, and Marianne Wainwright.
Other city staff present: Cynthia Stimson, Chris Philipp, Kevin Stensland, Lynn Miller, and
Cathy Bayne.
City clerk/treasurer Cynthia Stimson discussed an address change in the November minutes.
Motioned by Kell, seconded by Daly to approve the consent agenda, with the address change.
Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Cathy Bayne informed the City Council the carpet is in and the library is open.
Fire Chief Mike Sankot stated they have had 220 calls so far in 2017. He thanked JoAnn for
serving on the city council and then briefly discussed his budget for FY2019.
Chris Philipp presented the Building Department Report.
Lynn Miller stated they been working on equipment maintenance and the shop.
Kevin Stensland presented information about the water and sewer bond funds plans.
JoAnn Beer reported the Parks and Beautification Committee participated in Winterfest on
December 2, will not meet in December, and that Annette McKeever will be the Parks and
Beautification Committee's contact in the future.
Mayor Frieden opened the public hearing regarding a rezoning request for 100 W Cemetery
Road at 6:25 PM. Fire Chief Mike Sankot expressed his concern for commercial development in
an area not serviced by city water. Discussion was held regarding the fact that the property
currently has two different zoning districts. This request is to make the entire property C2
Highway Commercial. No comments have been received by city hall. Mayor Frieden closed the
public hearing at 6:36 PM.
Motioned by Wainwright, seconded by Daly to introduce and approve the first reading of
ORDINANCE 64, AN ORDINANCE AMENDING THE FAIRFAX ZONING
ORDINANCE OF 2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE
OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF
FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF
CERTAIN PROPERTIES, NOW KNOWN AS: N410' SE SE NW-EX W508.73' E600'
S230' & EX W60' S244' & EX BENTON JONES & E66' S250.15' SE NE-EX RD SE 9
TWP 82 R 8, FROM 44 RS AND C-2 HIGHWAY COMMERCIAL TO ALL C-2
HIGHWAY COMMERCIAL DISTRICT. Ayes: Beer, Daly, Kell, and Wainwright. Nays:
None. Abstain: Volk. Nick Volk abstained because he lives in the area near the property.
Motion carried.
Motioned by Daly, seconded by Kell to suspend the rule requiring that an ordinance be voted
on for passage at two council meetings prior to this meeting with respect to ORDINANCE 64.
Ayes: Beer, Daly, Kell, and Wainwright. Nays: None. Abstain: Volk. Nick Volk abstained
because he lives in the area near the property. Motion carried.
Motioned by Daly, seconded by Kell to give final approval and adopt ORDINANCE 64,
AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2012, OF
THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP
AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY
DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES, NOW
KNOWN AS: N410' SE SE NW-EX W508.73' E600' S230' & EX W60' S244' & EX
BENTON JONES & E66' S250.15' SE NE-EX RD SE 9 TWP 82 R 8, FROM 44 RS AND

Ayes: Beer, Daly, Kell, and Wainwright. Nays: None. Abstain: Volk. Nick Volk abstained
because he lives in the area near the property. Motion carried.
Gary Dusil, from Benefit Solutions, presented health insurance renewal quote information.
Most of UHC's plans have been revised. To keep similar policies, the City's renewal is about
4%, including the increases based on age.
Discussion was held regarding the other employee benefit policies. The City currently uses
Principal Financial and is getting a quote for comparable policies from UHC.
Annette McKeever gave a presentation regarding the Parks and Beautification Committee's
request to designate an Off Leash Dog Park in Fairfax. Joe Kell stressed that the Committee
members need to stay involved if this is established.
Motioned by Kell, seconded by Wainwright to approve establishing an Off Leash Dog Park
in Fairfax as proposed by the Parks and Beautification Committee for placement and funding.
Ayes: Beer, Kell, and Wainwright. Nays; Daly and Volk. Motion carried.
Shane Wicks, of Hall and Hall Engineers, and Shane Schrader discussed the Heartland
Heights Second Addition Plan of Improvements.
Motioned by Beer, seconded by Volk to approve RESOLUTION 2017-105, A
RESOLUTION APPROVING THE PLAN OF IMPROVEMENTS FOR HEARTLAND
HEIGHTS SECOND ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA.
Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Mayor Frieden declared RESOLUTION 2017-105 duly adopted.
Discussion was held concerning Henry and Halle's Addition. More information will be
presented at the next meeting.
Discussion was held regarding ORDINANCE 61, AN ORDINANCE AMENDING
CHAPTER 153 —BUILDING CODE. It was decided to send this topic back to the Fairfax
Planning and Zoning Commission for further review.
Mayor Frieden opened the public hearing regarding revisions to the 2012 City of Fairfax
Zoning Code, Sections 1.05.G.A and 1.07.H.A, Permitted Principal Uses and Structures at 7:39
PM. Chris Philipp gave a brief overview of the changes. No comments have been received by
city hall. Mayor Frieden closed the public hearing at 7:40 PM.
Motioned by Daly, seconded by Beer to introduce and approve the first reading of
ORDINANCE 62, AN ORDINANCE AMENDING THE FAIRFAX ZONING CODE OF
2012, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING SECTIONS 1.05 AND 1.07
IN REFERENCE TO COMMERCIAL CONDOS. Roll call vote: Ayes: Beer, Daly, Kell,
Volk, and Wainwright. Nays: None. Motion carried.

voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE

OF FAIRFAX, IOWA, BY AMENDING SECTIONS 1.05 AND 1.07 IN REFERENCE TO
COMMERCIAL CONDOS. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright.

RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN
THE IOWA DEPARTMENT OF ADMINISTRATIVE SERVICES, STATE
ACCOUNTING ENTERPRISE, AND THE CITY OF FAIRFAX, IOWA, FOR
PARTICIPATION IN THE INCOME OFFSET PROGRAM. Roll call vote: Ayes: Beer,
Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared
RESOLUTION 2017-106 duly adopted.
Motioned by Beer, seconded by Daly to approve RESOLUTION 2017-107, A
RESOLUTION APPROVING IOWA OFFSET PROGRAM APPEAL PROCESS. Roll
call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor
Frieden declared RESOLUTION 2017-107 duly adopted.

ORDINANCE 63, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF
THE CITY OF FAIRFAX, IOWA, 2012, BY AMENDING PROVISIONS PERTAINING
TO UTILITY DEPOSITS. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright.
Nays: None. Motion carried.

on for passage at two council meetings prior to this meeting with respect to ORDINANCE 63.

Mayor Frieden opened the public hearing regarding recodification of the Fairfax Code of
Ordinances and the Fairfax Zoning Code at 7:52 PM. The city clerk/treasurer discussed the need
to recodify every five years. No comments were received at city hall. Mayor Frieden closed the
public hearing at 7:53 PM.
Motioned by Volk, seconded by Daly to introduce and approve the first reading of
ORDINANCE 01, AN ORDINANCE ADOPTING THE EXISTING FAIRFAX CODE OF
ORDINANCES, FAIRFAX ZONING CODE, AND FAIRFAX ZONING MAP OF THE
CITY OF FAIRFAX, IOWA, AS THE CODE OF ORDINANCES OF THE CITY OF
FAIRFAX, IOWA, 2017, FAIRFAX ZONING CODE 2017, AND THE FAIRFAX
ZONING MAP, 2017. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays:
None. Motion carried.

Motioned by Daly, seconded by Volk to give final approval and adopt ORDINANCE 01,
AN ORDINANCE ADOPTING THE EXISTING FAIRFAX CODE OF ORDINANCES,
FAIRFAX ZONING CODE, AND FAIRFAX ZONING MAP OF THE CITY OF
FAIRFAX, IOWA, AS THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX,
IOWA, 2017, FAIRFAX ZONING CODE 2017, AND THE FAIRFAX ZONING MAP,
2017. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion
carried.
Chris Philipp discussed the Commercial Sign Permit Application for 409 Creekside Drive.
He recommended approval.
Motioned by Beer, seconded by Volk to approve the Commercial Sign Permit Application
from Jared Tebockhorst for 409 Creekside Drive. Ayes: Beer, Daly, Kell, Volk, and
Wainwright. Motion carried.
Shane Wicks discussed the estimated costs and layout of a revised exhibit of the proposed
Bridge Replacement and Intersection Realignment of W. Cemetery Road/Highway
151/Eagleview Drive Project. The realignment is estimated at about $300,000. Larry Valvoda
and Barb Connor discussed their thoughts on the realignment. In the final design
accommodation for semi-trucks is to be considered.
A brief discussion of the FY2019 budget process was held. Estimated costs for a police
department were requested.
Linn County Deputy Yoder distributed the monthly call list.
Motioned by Kell, seconded by Daly to revise and approve RESOLUTION 2017-108, A
RESOLUTION TO APPROVE NAMING DEPOSITORIES. Roll call vote: Ayes: Beer,
Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared
RESOLUTION 2017-108 duly adopted.
Motioned by Daly, seconded by Kell to approve RESOLUTION 2017-109, A
RESOLUTION TO APPROVE THE PERSONNEL POLICY MANUAL AND JOB
DESCRIPTIONS. Roll call vote: Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Frieden declared RESOLUTION 2017-109 duly adopted.
Motioned by Kell, seconded by Volk to re-appoint Tom Nurre to the Fairfax Planning and
Zoning Commission for a term ending 12-31-2022. Ayes: Beer, Daly, Kell, Volk, and
Wainwright. Nays: None. Motion carried.
The City Council needs to fill a vacancy on the Planning and Zoning Commission and on the
Board of Adjustment. A female is wanted for both positions to keep the boards gender balanced
as required by the State of Iowa.
Motioned by Beer, seconded by Daly to approve the claims listed dated December 12, 2017,
as submitted. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Don Lacy asked questions about the IDOT's Highway Project. Barb Connor asked questions
about any plans for a trail along Highway 151.
Mayor Frieden presented JoAnn Beer with a plaque to commemorate her 20 years serving on
the Fairfax City Council. He thanked JoAnn for her work.
Mayor Frieden administered the oath of office to new City Councilmember Travis Otto.

A special city council budget meeting was scheduled for Tuesday, January 16. The Fairfax
Planning and Zoning Commission will need to meet downstairs that evening.
