REGULAR CITY COUNCIL MEETING
January 9, 2018
The regular meeting of the Fairfax City Council was held January 9, 2018, at Fairfax city hall
at 300 80th Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council
members present: Travis Otto, Mike Daly, Joe Kell, Nick Volk, and Marianne Wainwright.
Other city staff present: Cynthia Stimson, Chris Philipp, Lynn Miller, Brian Merta, and Cathy
Bayne.
Motioned by Kell, seconded by Daly to approve the consent agenda. Ayes: Otto, Daly, Kell,
Volk, and Wainwright. Nays: None. Motion carried.
David Simmons, Signal 88, stated they have added the Heartland Heights area to their
patrolling routes. Lynn Miller informed them that there have been vehicles doing donuts in the
park parking lots.
Cathy Bayne thanked the City Council for funding the library building updates and invited
everyone to stop in and view the improvements and changes.
Fire Chief Mike Sankot stated they had 222 calls in 2017 and they currently have 51
members.
Chris Philipp presented pictures of Rust Free. It is past their time deadline to clean up the
property. Legal action is the next step.
Lynn Miller stated the holiday decorations are down and the snow events went well. He also
informed the City Council that we did not have any freeze issues.
Annette McKeever presented the Parks and Beautification Committee's list of projects for
budget consideration.
Mayor Frieden read a Proclamation making Fairfax a Purple Heart City.
Gary Dusil presented information about the healthcare insurance renewal options. He also
presented a quote to move the other employee benefit policies to UHC, rather than Principal
Financial. The annual cost savings to bundle all of the policies with UHC is $3,583.80.
Motioned by Daly, seconded by Volk to approve the healthcare insurance policies renewals
as presented with the City continuing to pay 100% of the platinum premium for the full-time
employees. Also to move the life, AD&D, short term disability, dental, and vision policies to
UnitedHealthcare, with the City continuing to pay 100% of the premiums for the full-time
employees. Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Kell, seconded by Volk to approve RESOLUTION 2018-01, A
RESOLUTION TO CONSIDER PLAN TO BE PRESENTED TO LINN COUNTY
BOARD OF SUPERVISORS REGARDING TAX LIEN AT 510 CHURCH STREET. Roll
call vote: Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor
Frieden declared RESOLUTION 2018-01 duly adopted.
Discussion was held regarding the proposed amendment to Fairfax's building code. Size of
commercial condos, as well as use and occupancy specifications were modified.
Joe Kell left the meeting at 6:47 PM.
Motioned by Daly, seconded by Otto to introduce and approve the first reading of
ORDINANCE 2, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 153-BUILDING CODE, as amended. Roll call vote: Ayes: Otto, Daly, Volk, and
Wainwright. Nays: None. Absent: Kell. Motion carried.
Motioned by Wainwright, seconded by Daly to appoint Randy Scholer, Simmons Perrine
Moyer Bergman PLC, as the city attorney. Ayes: Otto, Daly, Volk, and Wainwright. Nays:
None. Absent: Kell. Motion carried.
Motioned by Daly, seconded by Volk to approve the results of the election of fire chief by
the Fairfax Fire and Rescue Department and appoint Mike Sankot, as the fire chief. Ayes: Otto,
Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried.
Motioned by Daly, seconded by Otto to appoint Cynthia Stimson, as the city clerk/treasurer.
Ayes: Otto, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried.
Mike Sankot took the oath of office as fire chief.
Cynthia Stimson took the oath of office as city clerk/treasurer.
Mayor Frieden appointed Marianne Wainwright as Mayor Pro Tempore.
Motioned by Daly, seconded by Volk to authorize the following list of people on all City of
Fairfax bank accounts. Any withdrawal requires a signature from any two of the following
people: Mayor Burnell Frieden, Mayor Pro Tempore Marianne Wainwright, City
Clerk/Treasurer Cynthia Stimson, Deputy City ClerkâUtilities Kathy Everett, and Deputy City
Clerk/Treasurer Kim Donaldson. Ayes: Otto, Daly, Volk, and Wainwright. Nays: None.
Absent: Kell. Motion carried.
Fire Chief Sankot reviewed changes to the Fairfax Fire and Rescue Department's Bylaws.
Motioned by Volk, seconded by Otto to approve RESOLUTION 2018-02, A
RESOLUTION TO APPROVE FAIRFAX FIRE DEPARTMENT'S BYLAWS. Roll call
vote: Ayes: Otto, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion carried.
Mayor Frieden declared RESOLUTION 2018-02 duly adopted.
Motioned by Wainwright, seconded by Daly to appoint Gib Boxa to the Fairfax Planning and
Zoning Commission for a term ending 12-31-2022. Ayes: Otto, Daly, Volk, and Wainwright.
Nays: None. Absent: Kell. Motion carried.
Extensive discussion was held regarding employee compensation. During 2018 the City
Council wants to work on establishing a wage range structure. This should consider cost of
living adjustments, certifications, years of service, and merit raises. Certification requests were
reviewed.
Motioned by Otto to give the non-library and non-fire department employees a 2.75%
increase in wages with no additional current amounts for certifications. This motion died for
lack of a second. Otto rescinded the motion.
Motioned by Wainwright, seconded by Volk to give the non-library and non-fire department
employees a 2.5% increase in wages and an additional 50 cents an hour to Cynthia Stimson for
her CMC Certification. Ayes: Otto, Volk, and Wainwright. Nays: Daly. Absent: Kell.
Motion carried.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION 2018-03, A
RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES. Roll call vote: Ayes:
Otto, Volk, and Wainwright. Nays: Daly. Absent: Kell. Motion carried. Mayor Frieden
declared RESOLUTION 2018-03 duly adopted.
Motioned by Otto, seconded by Daly to approve the claims listed dated January 9, 2018, as
submitted. Ayes: Otto, Daly, Volk, and Wainwright. Nays: None. Absent: Kell. Motion
carried.
Mayor Frieden stated he has a consulting firm coming to the February meeting to make a
presentation on costs of establishing a police force. He also discussed the current negotiations
with the City of Cedar Rapids regarding revising the 28E about annexation area.
Cynthia Stimson reminded the City Council about Legislative Day on February 6, Part II of
MLA, and the special budget meeting January 16.
Motioned by Daly, seconded by Volk to adjourn the meeting. Ayes: Otto,Daly, Volk, and
Wainwright. Nays: None. Absent: Kell. Motion carried.
Mayor Frieden adjourned the meeting at 8:3.3 PM.
