REGULAR CITY COUNCIL MEETING
February 13, 2018
The regular meeting of the Fairfax City Council was held February 13, 2018, at Fairfax city
hall at 300 80th Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council
members present: Travis Otto, Mike Daly, Joe Kell, and Nick Volk. Absent: Wainwright.
Other city staff present: Cynthia Stimson, Chris Philipp, Lynn Miller, Kevin Stensland, Brian
Merta, and Cathy Bayne. Also present was City Attorney Graham Carl.
Motioned by Otto, seconded by Daly to go into a closed session to discuss a potential
agreement with Larry Schulte - Rust Free Auto Parts,per Iowa Code Section 21.5(1)(c), to
discuss strategy with counsel in matters that are presently in litigation or where litigation is
imminent where its disclosure would be likely to prejudice or disadvantage the position of the
governmental body in that litigation. Ayes: Otto, Daly, Kell, and Volk. Nays: None. Absent:
Marianne Wainwright. Motion carried.
City Council went into closed session. Marianne Wainwright entered at 6:03 PM.
City Council reconvened the open session and let people back in at 6:25 PM.
Motioned by Daly, seconded by Volk since the City of Fairfax has filed a citation for
municipal infractions against Larry Schulte d/b/a Rust Free Auto and the Fairfax City Council
has engaged the city attorney to negotiate an agreement, have reviewed a proposed agreement,
and instructed the city attorney to add language regarding enforcement of the agreement in the
event that the municipal infractions are not abated within the time set forth; the Fairfax City
Council will enter and does hereby authorize the Mayor and City Clerk to sign an agreement
revised as discussed if agreed to by Larry Schulte. Ayes: Otto, Daly, Kell, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Kell, seconded by Daly to approve the consent agenda. Ayes: Otto, Daly, Kell,
Volk, and Wainwright. Nays: None. Motion carried.
Jason Jacobs, with Signal 88, introduced himself.
Cathy Bayne stated the Library Board has contacted Walford. They are willing to discuss a
phase in of a larger library support payment, but they already have their budget set for FYI 9.
Fire Chief Mike Sankot reported everything is good.
Chris Philipp reported he has issued two temporary occupancy permits in Heartland Heights.
There are currently 23 residential permits issued for that area.
Lynn Miller stated everything with the maintenance department is going good.
Kevin Stensland reported that the water filter project has been completed and we received a
new water permit from the IDNR.
Shane Wicks, President of Hall and Hall Engineers, Inc., reported that Joel Gross is leaving
the firm.
William Moulder, Stephen Niebur, and Roger Sanders, all with Moulder and Associates,
LLC were present to discuss their experience with assisting communities to find key employees
such as a police chief and setting up a new department. William Moulder reviewed some of the
projected costs of a department and their potential fees. He estimated if a decision was made to
set up a department, it would take one year to implement.
Motioned by Daly, seconded by Otto to approve RESOLUTION 2018-04, A
RESOLUTION ENTERING INTO AN AGREEMENT WITH DONALD AND CAROL
LACEY. Roll call vote: Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays: None. Motion
carried. Mayor Frieden declared RESOLUTION 2018-04 duly adopted.
Motioned by Kell, seconded by Daly to approve the second reading of ORDINANCE 2, AN
ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017, OF
THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 153-BUILDING CODE.
Roll call vote: Ayes: Daly, Kell, Volk, and Wainwright. Nays: None. Abstain: Otto. Travis
Otto abstained because he may become a future owner of the type of property this code
discusses. Motion carried.
Motioned by Kell, seconded by Daly to suspend the rule requiring that an ordinance be voted
on for passage at two council meetings prior to this meeting with respect to ORDINANCE 2.
Roll call vote: Ayes: Daly, Kell, Volk, and Wainwright. Nays: None. Abstain: Otto. Travis
Otto abstained because he may become a future owner of the type of property this code
discusses. Motion carried.
Motioned by Kell, seconded by Daly to give final approval and adopt ORDINANCE 2,AN
ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017, OF
THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 153-BUILDING CODE.
Roll call vote: Ayes: Daly, Kell, Volk, and Wainwright. Nays: None. Abstain: Otto. Travis
Otto abstained because he may become a future owner of the type of property this code
discusses. Motion carried.
Zack and Justin Sobaski were present to discuss the proposed Henry and Halle's Preliminary
Plat and Conditions. Shane Wicks reviewed the documents with the City Council. Discussion
was held about developer and City of Fairfax costs. Shane Wicks was directed to make some
revisions to the conditions.
Motioned by Daly, seconded by Volk to approve RESOLUTION 2018-05, A
RESOLUTION APPROVING THE PRELIMINARY PLAT AND PRELIMINARY PLAT
CONDITIONS OF HENRY AND HALLE'S ADDITION IN THE CITY OF FAIRFAX,
LINN COUNTY, IOWA. Roll call vote: Ayes: Daly, Kell, Volk, and Wainwright. Nays:
None. Abstain: Otto. Travis Otto abstained because he may become a future owner of one or
more of these units. Motion carried. Mayor Frieden declared RESOLUTION 2018-05 duly
adopted.
A Linn County Deputy presented the list of calls. Illegal parking was discussed. The deputy
encouraged anyone to call them to report illegal parking when they notice the vehicles.
The Commercial Building Permit Application from Sobaski Real Estate was discussed. This
is for only a shell building at this time. Chris Philipp recommends approval and authorize the
building department to hold the permit until the issues with the plan are resolved.
Motioned by Volk, seconded by Wainwright to approve the site plan and Commercial
Building Permit Application from Sobaski Real Estate for Lot 5 in Henry & Halle's Addition but
for the Fairfax Building Department to hold the permit until the issues with the plan are resolved
to the City's satisfaction. Ayes: Daly, Kell, Volk, and Wainwright. Nays: None. Abstain:
Otto. Travis Otto abstained because he may become a future owner of one or more of these
units. Motion carried.
Motioned by Kell, seconded by Otto to approve RESOLUTION 2018-06, A
RESOLUTION APPROVING THE PRIVATE STORM WATER DETENTION POND
AT LOT 2 OF KARAL'S SECOND ADDITION (21 WILLIAMS BOULEVARD). Roll call
vote: Ayes: Otto, Kell, Volk, and Wainwright. Nays: None. Abstain: Daly. Mike Daly
abstained because he works for Waln Repair and Collision Center. Motion carried. Mayor
Frieden declared RESOLUTION 2018-06 duly adopted.
Motioned by Wainwright, seconded by Kell to approve RESOLUTION 2018-07, A
RESOLUTION APPROVING P.O.S. NO. 2234 PART OF THE SOUTH 1/2 OF THE SW
1/4, SECTION 4, T82N, R8W IN THE CITY OF FAIRFAX, LINN CONTY, IOWA. Roll
call vote: Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor
Frieden declared RESOLUTION 2018-07 duly adopted.
Motioned by Kell, seconded by Volk to approve RESOLUTION 2018-08, A
RESOLUTION APPROVING THE FINAL PLAT AND DEVELOPMENT AGREEMENT
FOR PRAIRIE CREEK ESTATES NINTH ADDITION, A RE-PLAT OF LOTS 3, 4, 5, 6,
AND 7 OF PRAIRIE CREEK ESTATES EIGHTH ADDITION TO FAIRFAX, LINN
COUNTY, IOWA. Roll call vote: Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Frieden declared RESOLUTION 2018-08 duly adopted.
Discussion was held regarding the Commercial Sign Permit Application to move the
Sankot's Garage/Star Bar sign back because of the highway project. Cindy Anderson lives next
door and she expressed concern about the light pollution and sign placement. It was suggested
the people involved meet to discuss a compromise. No action was taken on the application.
Joe Kell asked that the council members review the FYSA information in the packet.
Discussion was held concerning several topics relating to the IDOT's bridge projects. The
City Council directed Shane Wicks to relay their selections about walls enhancements and
aesthetics and to ask that the Church Street intersection not be closed from May 1 to August 15,
2019. More information is needed about the City's participation items.
Motioned by Kell, seconded by Daly to send the Solid Waste Collection Contractor RFP to
be due back by April 5, 2018. Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays: None.
Motion carried.
Motioned by Kell, seconded by Volk to approve RESOLUTION 2018-09, A
RESOLUTION SETTING THE PROCEDURE AND CHARGES FOR A SPECIAL CITY
COUNCIL MEETING. Roll call vote: Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Frieden declared RESOLUTION 2018-09 duly adopted.
Motioned by Wainwright, seconded by Kell to approve RESOLUTION 2018-10, A
RESOLUTION AUTHORIZING TRANSFERS. Roll call vote: Ayes: Otto, Daly, Kell,
Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION
2018-10 duly adopted.
Discussion was held regarding the FY19 budget worksheet. Utility rates, CIP list, and the
LOST Fund balance were reviewed.
Motioned by Volk, seconded by Daly to approve RESOLUTION 2018-11, A
RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE
PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S
PROPOSED FISCAL YEAR 2018-2019 BUDGET. Roll call vote: Ayes: Otto, Daly, Kell,
Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION
2018-11 duly adopted.
Motioned by Volk, seconded by Daly to approve RESOLUTION 2018-12, A
RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE
PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S
PROPOSED AMENDMENT TO THE FISCAL YEAR 2017-2018 BUDGET. Roll call
vote: Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Mayor
Frieden declared RESOLUTION 2018-12 duly adopted.
Motioned by Otto, seconded by Daly to approve the quote for a mower from The Sled Shed,
Inc. for $12,147.00. Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays: None. Motion
carried.
Motioned by Volk, seconded by Otto to approve the estimate of$11,788.20 from Kluesner
Construction, Inc. for asphalt overlay work on some streets in Fairfax. It will be noted that the
City would like this work completed by May 15. Ayes: Otto, Daly, Kell, Volk, and Wainwright.
Nays: None. Motion carried.
Joe Kell stepped out of the meeting.
Motioned by Daly, seconded by Volk to introduce and approve the first reading of
ORDINANCE 3, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 69 PARKING REGULATIONS. Roll call vote: Ayes: Otto, Daly, Volk, and
Wainwright. Nays: None. Absent: Kell. Motion carried.
Motioned by Daly, seconded by Volk to suspend the rule requiring that an ordinance be
voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE
3. Roll call vote: Ayes: Otto, Daly, Volk, and Wainwright. Nays: None. Absent: Kell.
Motion carried.
Motioned by Daly, seconded by Volk to give final approval and adopt ORDINANCE 3,AN
ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017, OF
THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 69 PARKING
REGULATIONS. Roll call vote: Ayes: Otto, Daly, Volk, and Wainwright. Nays: None.
Absent: Kell. Motion carried.
Mayor Frieden discussed the Snow Emergency procedure. It was suggested that the City
place notices on the vehicles as soon as possible.
Motioned by Kell, seconded by Daly to approve RESOLUTION 2018-13, A
RESOLUTION SETTING FEES FOR BUILDING DEMOLITION INSPECTIONS AND
UTITITY DISCONNECTIONS. Roll call vote: Ayes: Otto, Daly, Kell, Volk, and
Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2018-13
duly adopted.
Discussion was held about appointing someone to serve on the Fairfax Planning and Zoning
Commission.
Motioned by Wainwright, seconded by Daly to appoint Steve Huber to the Fairfax Planning
and Zoning Commission to complete a term that ends December 31, 2020. Ayes: Otto, Daly,
Kell, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Wainwright, seconded by Kell for the City of Fairfax to sponsor a city-wide
garage sale day on Saturday, May 19, 2018. The City will charge $5.00 per registered sale for
help cover costs. Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Kell, seconded by Otto for the City of Fairfax to sponsor a city-wide clean-up
day on Saturday, June 2, 2018. The City will need to check about a site. The time will be 7:00
AM— 10:00 AM. Johnson County Refuse will be helping in the same manner as other years.
The City will check about maybe adding shredding. Ayes: Otto, Daly, Kell, Volk, and
Wainwright. Nays: None. Motion carried.
Commercial weed spraying was discussed and the estimate from CRL Lawn Care reviewed.
Motioned by Kell, seconded by Otto to approve the estimate of$21,500.00 from CRL Lawn
Care for commercial spraying in 2018. Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays:
None. Motion carried.
Motioned by Wainwright, seconded by Daly to approve the claims list dated February 13,
2018, as presented. Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays: None. Motion
carried.
Cathy Bayne asked what the Fairfax Public Library is to do for parking during a snow
emergency. She was told vehicles can come back on the street after the street has been plowed
and the snow has stopped.
Mayor Frieden reminded members of the MLA Part 3 in Iowa City on April 7. He
announced that Kevin Stensland has been named the 2017 Community Operator of the Year
from Iowa Rural Water Association.
The city clerk/treasurer stated that the auditors are here this and next week. She will not be
at the March 13 meeting. Kim Donaldson will do the meeting. Nick Volk and Travis Otto both
stated they will not be at the March 13 meeting. It was discussed if the meeting needs to be
moved. We must have a quorum to approve the budget. The other three members assured
everyone that all three would be present for a quorum.
Motioned by Daly, seconded by Kell to adjourn the meeting. Ayes: Otto, Daly, Kell, Volk,
and Wainwright. Nays: None. Motion carried.
