HomeMy WebLinkAbout10/09/2018 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING October 9, 2018 The regular meeting of the Fairfax City Council was held October 9, 2018, at Fairfax city hall at 300 80'h Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council members present: Travis Otto, Mike Daly, Joe Kell, Nick Volk, and Marianne Wainwright. Other city staff present: Cynthia Stimson, Chris Philipp, Lynn Miller, and Cathy Bayne. Motioned by Kell, seconded by Otto to approve the consent agenda. Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Jason Jacob, Signal 88, reported to the City Council about their patrolling. He discussed egging, suspicious vehicles, having a car towed, and how they do their report entries. Cathy Bayne reported that about half of the replacement windows are installed at the library. She stated they have been busy and they are discussing property purchase. Lynn Miller reported that the fire department is on storm watch. Chris Philipp reviewed the building department's report. Lynn Miller informed the council that he and Kim submitted a grant request, the flushing is completed, and they are working on winterizing. Half of the salt order is here and the fencing is being installed. JoAnn Beer reported the Parks and Beautification Committee will have a station at the Haunted Farm event on October 20 and they have been working on updating the parks brochure. She asked about overnight parking in the parks and about the shelter for the dog park. Discussion was held about the request from Regis and Barbara Arp for reimbursement for mower deck damage. He was able to find a used deck for $750.00 plus $70.00 in parts. Motioned by Otto, seconded by Kell to pay Regis and Barbara Arp $250.00 towards their costs for the mower deck damage. Ayes: Otto, Kell, Volk, and Wainwright. Nays: Daly. Motion carried. Tom and Pat Arp discussed parking on West Cemetery Road. They would like the City to consider allowing a couple of spaces on the north side of the road, after the hill. They suggested lowering the speed to 25 miles an hour to shorten the required no parking length after the hill. Maggie Burger, Speer Financial, introduced John Murphy and presented Fairfax's annual TIF Report. Motioned by Otto, seconded by Volk to accept RESOLUTION NO. 2018-69, A RESOLUTION APPROVING THE TIF CERTIFICATION FORMS. Roll call vote: Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2018-69 duly adopted. Motioned by Kell, seconded by Daly to approve the Commercial Sign Permit Application from Dugout Sports, LLC, at 814 Eagleview Drive, in Fairfax. Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Brian and Vickie Kindl discussed their request to have chickens at 220 Southview Road, in Fairfax. This is a 44-RS zoned property. They stated that many communities allow chickens, they make less noise than dogs. They asked for either a variance for their property or to re-write the ordinance to allow chickens on larger residential lots. Motioned by Daly, seconded by Wainwright to have staff draft an ordinance revision for consideration at the next meeting. Ayes: Daly, Volk, and Wainwright. Nays: Otto and Kell. Motion carried. Jon Larson, Hall and Hall Engineers, stated they recommend accepting the public improvements to Heartland Heights Second Addition with the stipulations noted in the resolution. Motioned by Otto, seconded by Kell to accept RESOLUTION NO. 2018-70, A RESOLUTION ACCEPTING THE PUBLIC IMPROVEMENTS TO HEARTLAND HEIGHTS SECOND ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2018-70 duly adopted. Motioned by Volk, seconded by Kell to accept RESOLUTION NO. 2018-71, A RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF FAIRFAX AND HALL AND HALL ENGINEERS, INC. Roll call vote: Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2018-71 duly adopted. Motioned by Kell, seconded by Otto to accept RESOLUTION NO. 2018-72, A RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF FAIRFAX AND HALL AND HALL ENGINEERS, INC. Roll call vote: Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2018-72 duly adopted. Motioned by Kell, seconded by Daly to introduce and approve the first reading of ORDINANCE 14, AN ORDINANCE AMENDING THE FAIRFAX ZONING CODE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 69 PARKING REGULATIONS as amended. Roll call vote: Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Motioned by Kell, seconded by Daly to suspend the rules requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 14. Roll call vote: Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Motioned by Kell, seconded by Daly to approve final passage and adoption of ORDINANCE 14, AN ORDINANCE AMENDING THE FAIRFAX ZONING CODE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 69 PARKING REGULATIONS as amended. Roll call vote: Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Motioned by Wainwright, seconded by Otto to approve the 2018 Water System Report. Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Discussion was held regarding the speed bump on Church Street. This will not be removed but modified later to make it a speed hump. Discussion was held about the proposed review fees. This resolution is to be revised and considered next month. Discussion was held about the proposed revisions to the Zoning Code. Both PDs and District Overlays were reviewed. Members of the Fairfax Planning and Zoning gave input about their recommendation to approve both of these ordinances. Motioned by Daly, seconded by Volk to approve the second reading of ORDINANCE 11, AN ORDINANCE AMENDING THE FAIRFAX ZONING CODE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADDING PLANNED DEVELOPMENT ZONING DISTRICT. Roll call vote: Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Motioned by Kell, seconded by Daly to suspend the rules requiring that an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 11. Roll call vote: Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Discussion was held regarding the certifications for Chris Philipp. Motioned by Otto, seconded by Kell to approve the schedule of hourly increases for certification for the Building Administrator Chris Philipp as presented. Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Motioned by Otto, seconded by Daly to accept RESOLUTION NO. 2018-73,A RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES. Roll call vote: Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2018-73 duly adopted. Discussion was held about participating with other area towns in NIXLE. The expense will come from the city hall software budget. The expenses estimate was reviewed. Motioned by Wainwright, seconded by Otto to approve participating in NIXLE subject to the first year costs not to exceed the high estimate of$1.14 per capita. Ayes: Otto, Volk and Wainwright. Nays: Daly and Kell. Motion carried. Motioned by Daly, seconded by Otto to accept RESOLUTION NO. 2018-74,A RESOLUTION TO ACCEPT AN AUDIT PROPOSAL FOR FY19, FY20 AND FY21. Roll call vote: Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2018-74 duly adopted. Discussion was held regarding the request from a resident to have a flag outside at Fairfax City Hall. The cost will be over $5,000 and the City does not own the property. No action will be taken at this time. Motioned by Daly, seconded by Kell to approve the claims list dated October 9, 2018. Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Mayor Frieden stated that the City will hear soon about MPO's action on our trail project. He informed everyone that a retirement party was held on Friday for Dave Yanecek. Cynthia Stimson mentioned Kathy will be attending IMFOA this month. Travis Otto asked about a notation in the engineer's report. He also stated that residents should be encouraged to call Linn County Sheriff when they see something illegal. It was suggested to put an article in the FACTS about this. Motioned by Volk, seconded by Daly to adjourn the meeting. Ayes: Otto, Daly, Kell, Volk and Wainwright. Nays: None. Motion carried. Mayor Frieden adjourned the meeting at approximately 9:03 PM.
