SPECIAL CITY COUNCIL MEETING
November 19, 2018
The special meeting of the Fairfax City Council was held November 19, 2018, at Fairfax city
hall at 300 80' Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council
members present: Travis Otto, Mike Daly, Joe Kell, Nick Volk, and Marianne Wainwright.
Other city staff present: Cynthia Stimson. Also present were City Engineer Shane Wicks and
City Attorney Randy Scholar.
Motioned by Kell, seconded by Daly to approve the consent agenda. Ayes: Otto, Daly, Kell,
Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Kell, seconded by Daly to go into closed session per Iowa Code Section 21.5 c.,
to discuss strategy with counsel in matters that are presently in litigation or where litigation is
imminent where its disclosure would be likely to prejudice or disadvantage the position of the
governmental body in that litigation. This is regarding a lawsuit filed against the IDOT about
their highway project. Roll call vote: Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays:
None. Motion carried.
The City Council went into closed session.
Motioned by Daly, seconded by Volk to go back into open session at 7:22 PM. Roll call
vote: Ayes: Otto, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried.
Mayor Frieden showed documentation about a nuisance action and discussed meeting rules
to improve the process for input from residents.
Motioned by Daly, seconded by Kell to adjourn the meeting. Ayes: Otto, Daly, Kell, Volk
and Wainwright. Nays: None. Motion carried.
Mayor Frieden adjourned the meeting at approximately 7:29 PM.
