REGULAR CITY COUNCIL MEETING
APRIL 9, 2019
The regular meeting of the Fairfax City Council was held April 9, 2019, at Fairfax city hall at
300 80'h Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council members
present: Mike Daly, Joe Kell, Nick Volk, and Marianne Wainwright. Travis Otto was absent.
Other city staff present: Chris Philipp, Kevin Stensland, Brian Merta, Cathy Bayne and Cynthia
Stimson.
Motioned by Kell, seconded by Volk to approve the consent agenda. Ayes: Daly, Kell, Volk,
and Wainwright. Nays: None. Absent: Otto. Motion carried.
Darrell Walters, Signal 88, reported to the City Council about their patrolling.
Cathy Bayne reported they were busy with spring break activities.
Fire Chief Mike Sankot reported they have had 69 calls this year. He discussed a request to
burn off a ditch area. This request is to be placed on the special meeting's agenda. The Fire
Department will be helping with the Easter Egg Dash.
Chris Philipp reviewed the building department's report. He will work on a revision of the
burn ordinance. He will revise the building code chapter to require concrete front steps. He
reported that the Planning and Zoning Commission's recommendation is to annex Bellon farm
ground that is currently not in the City, as soon as possible. Improvements at two nuisance
properties were discussed.
Brian Merta reported they received their new truck, have been working on fixing areas
damaged by the snow plows, street boils, a sewer basin, and the dog park pavilion. The parks are
open. The street sweeper has started work.
Kevin Stensland informed the City Council that Brian Merta has passed his Grade II tests and
Tyler Bauer his Grade I waste water. The City's EPA testing for the second quarter went well.
The basin has been cleaned out. The UV samples look good. They will be flushing as soon as
the street sweeping is completed. He mentioned that Alliant's contractor damaged some city
infrastructure. He will work to do repairs to a property that needs their water off for some
plumbing work this week. Then he will need to make a list of all of the damage done by the
contractor and get them back to make repairs.
Annette McKeever reported for the Parks and Beautification Committee the City has issued
30 dog park IDs in 2019. They will be helping with the Easter Egg Dash. The Fairfax Lion's
Club will be donating towards the Movie in the Park and wants to help re-establish the horse
shoe pits at Prairie Creek Park.
Jon Larson, Hall and Hall Engineers, Inc., discussed the splash pad process. Stakes at The
Complex were discussed.
Motioned by Daly, seconded by Wainwright to approve RESOLUTION NO. 2019-19, A
RESOLUTION ADOPTING THE LINN COUNTY MULTI-JURISDICTIONAL
HAZARD MITIGATION PLAN 2019. Roll call vote: Ayes: Daly, Kell, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Frieden declared
RESOLUTION 2019-19 duly adopted.
Paul Mallie discussed the route of the proposed Fairfax Lion's Club 5K and Fun Run on
Saturday, June 22. No streets will be closed. No permanent paint will be used.
Motioned by Kell, seconded by Daly to allow the Fairfax Lion's Club to hold their 5K and
Fun Run in Fairfax on Saturday, June 22, using the discussed route. Ayes: Daly, Kell, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried.
Patrick Slater discussed a ditch burn request. This will be on the next agenda for approval.
Motioned by Kell, seconded by Daly to donate $3,750.00 to the USA Day Committee for
2019. Ayes: Daly, Kell, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried.
A long discussion was held concerning a proposed chicken ordinance. George and Allison
Boren, Barb Connor, Cindy Anderson, Jay Hopkins, and JoAnn Beer spoke in favor of the
proposal. The City Council suggested the following revisions: an annual fee of$10.00 will be
required, chickens will be allowed in any zoning district in the core district of Fairfax, properties
less than an acre may have up to six chickens, properties one to two acres may have up to 12
chickens, and properties over two acres may have up to 24 chickens. A revised document, in
ordinance format, will be presented at the May 14 city council meeting. The abatement notice
deadline of May 1 will be extended until such time as a final decision is made about this
proposed ordinance.
JoAnn Beer asked the City Council to not approve the sewer rate increase ordinance.
Motioned by Kell, seconded by Volk to approve the second reading of ORDINANCE 18,
AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017, OF
THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 99, SEWER SERVICE
CHARGES. Roll call vote: Ayes: Kell, Volk, and Wainwright. Nays: Daly. Absent: Otto.
Motion carried.
It was decided not to waive any readings this evening. This ordinance will be on the next
agenda, for final approval.
JoAnn Beer asked the City Council to not approve the solid waste rate increase ordinance.
Discussion was held about the solid waste fee ordinance. Additional data will be presented at
the next meeting.
Motioned by Volk, seconded by Daly to approve RESOLUTION NO. 2019-20,A
RESOLUTION TO FIX A DATE FOR A PUBLIC HEARING ON PROPOSAL TO
ENTER INTO A WATER REVENUE LOAN AND DISBURSEMENT AGREEMENT
AND TO BORROW MONEY THEREUNDER IN A PRINCIPAL AMOUNT NOT TO
EXCEED $291,000. Roll call vote: Ayes: Daly, Kell, Volk, and Wainwright. Nays: None.
Absent: Otto. Motion carried. Mayor Frieden declared RESOLUTION 2019-20 duly adopted.
Motioned by Kell, seconded by Volk to approve RESOLUTION NO. 2019-21,A
RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR
THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON
VACATING A TELEPHONE EASEMENT. Roll call vote: Ayes: Daly, Kell, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Frieden declared
RESOLUTION 2019-21 duly adopted.
Motioned by Daly, seconded by Kell to approve RESOLUTION NO. 2019-22,A
RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR
THE PURPOSE OF ADJUSTMENT OF DRAINAGE EASEMENT WIDTH. Roll call
vote: Ayes: Daly, Kell, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried.
Mayor Frieden declared RESOLUTION 2019-22 duly adopted.
Motioned by Wainwright, seconded by Daly to authorize Kim Donaldson to attend the
Municipal Professional's Institute and Kathy Everett to attend the Municipal Professionals
Academy. Ayes: Daly, Kell, Volk, and Wainwright. Nays: None. Absent: Otto. Motion
carried.
Motioned by Kell, seconded by Daly to approve the claims list dated April 9, 2019. Ayes:
Daly, Kell, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried.
JoAnn Beer requested the City purchase a sound system to have microphones at the council
tables and she thanked elected officials and staff for discussing the proposed ordinances with her.
Cindy Anderson asked about the deadline for the chicken abatement notice.
Joe Kell announced that this is the last year he and his wife Brenda will be in charge of
FYSA.
Mayor Frieden reported that he and Cynthia Stimson attended an Employment Conference.
He also discussed and showed the information on the front page of the April FACTS, showing
Fairfax was listed the best town to live in Iowa in the 1,000—5,000 population category by
HomeSnacks.net.
City clerk/treasurer Cynthia Stimson outlined the splash pad timeline.
Motioned by Daly, seconded by Kell to adjourn the meeting. Ayes: Daly, Kell, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried.
Mayor Frieden adjourned the meeting at approximately 8:28 PM.
