HomeMy WebLinkAbout08/13/2019 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING AUGUST 13, 2019 The regular meeting of the Fairfax City Council was held August 13, 2019, at Fairfax city hall at 300 80th Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council members present: Travis Otto, Joe Kell, and Nick Volk. Absent: Mike Daly and Marianne Wainwright. Other city staff present: Kevin Stensland, Lynn Miller, Chris Philipp, Cathy Bayne, and Cynthia Stimson. Motioned by Kell, seconded by Volk to approve the consent agenda. Ayes: Otto, Kell, and Volk. Nays: None. Absent: Daly and Wainwright. Motion carried. Linn County Deputy Speth presented the list of calls. Darrell Walters, Signal 88, reported to the City Council about their patrolling. Marianne Wainwright entered at 6:05 PM. Cathy Bayne reported they have been busy. They had good attendance at the train event. Mike Sankot stated the fire department is waiting to hear about a federal grant for a truck. Discussion was held about the warning light on the highway. Chris Philipp reviewed the building department report. Lynn Miller discussed the problem of trees in the storm sewer. The resident at 115 Highland Avenue wants to spade the trees on the street easement and move them into his property. The City will allow this, but not participate in the costs. Joe Kell asked about flags. Lynn stated they have placed a lot of playground bark. Kevin Stensland discussed a sewer backup problem at the Horizon Avenue and 1st Street area. We have jetted and sent a camera down the line. We are getting quotes for maintenance of lines. It was suggested we contact the car wash and make sure they are not sending material down the line. Kevin also discussed a graph showing water usage and showed pictures of the sewer lagoon repairs. Annette McKeever reported on their dog park IDs as well as the Movie in the Park and Mutt Meet-up events. Plans are being made for a new handicapped swing at The Complex. Kenny and Michelle Barnell were not present, so no discussion was held on their request to purchase property. Don Kleis, Prairie Road Builders, discussed the list of street maintenance work. The total estimate is $61,192.90. Travis Otto stated that the sidewalk near the Star Bar was left a mess last year. Don will see this is not done this year. Motioned by Volk, seconded by Otto to approve the list of 2019 proposed street maintenance work from Prairie Road Builders for an estimate of$61,192.90. Ayes: Otto, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Cory Stockton reviewed a front porch project they presented to the Board of Adjustment on August 7. They requested a three-foot variance of the 25-foot set-back and the right to encroach into a City of Fairfax sanitary sewer easement. Chris Philipp stated that Shane Wicks is not recommending approving the encroachment. But if the City chooses to, Shane recommends the City require the property owners to sign a Sanitary Sewer Easement Encroachment Agreement. The Board of Adjustment agreed and they granted the requested three-foot variance pending signing the agreement. The City attorney suggested a couple of revisions to the agreement and advised staff(via email before the meeting) that only the City Council has the power to allow an encroachment into an easement. The agreement has been revised as instructed. Kevin Stensland stated he does not want the City to make it a policy to allow encroachment into easements. He also stated that the line is currently in good condition and if maintenance is needed, it is possible that trenching could be used to minimize the space needed. Motioned by Otto, seconded by Wainwright to approve RESOLUTION NO. 2019-42, A RESOLUTION ENTERING INTO A SANITARY SEWER EASEMENT ENCROACHMENT AGREEMENT. Roll call vote: Ayes: Otto, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Frieden declared RESOLUTION 2019-42 duly adopted. The agreement is to be recorded against the property. Mayor Frieden opened the public hearing concerning amending the 2017 Fairfax Zoning Code at 7:00 PM. City hall has not received input. Chris Philipp explained that the amendment would add minimum off-street parking for storage buildings. The Fairfax Planning and Zoning Commission is recommending this amendment. Barb Connor asked how this would affect her property. Chris explained that these requirements would be for any new projects. Mayor Frieden closed the hearing at 7:05 PM. Motioned by Volk, seconded by Otto to introduce and approve the first reading of ORDINANCE NO. 27, AN ORDINANCE AMENDING THE FAIRFAX ZONING CODE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY MODIFYING C2 DISTRICT OFF- STREET PARKING REQUIREMENTS. Roll call vote: Ayes: Otto, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Motioned by Kell, seconded by Otto to suspend the rules requiring an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 27. Roll call vote: Ayes: Otto, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Motioned by Kell, seconded by Otto for final approval and adopting ORDINANCE NO. 27, AN ORDINANCE AMENDING THE FAIRFAX ZONING CODE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY MODIFYING C2 DISTRICT OFF-STREET PARKING REQUIREMENTS. Roll call vote: Ayes: Otto, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Frieden opened the public hearing concerning the proposed plans, specifications, form of contract, opinion of probable cost and the proposed improvements described thereby for the 2019 Fairfax Sports Complex Splash Pad Project at 7:07 PM. City hall did not receive any comments and no one present had any comments. Mayor Frieden closed the hearing at 7:08 PM. Jon Larson, Hall and Hall Engineers, Inc., informed the City Council that the we received only one bid for the splash pad construction and it was $92,000 over the estimate. The Splash Pad Committee is recommending to reject the bid and re-bid later. Jon talked to V&K about two other area splash pad projects. We will try to request bids about the same time to help contactors keep the costs down. Motioned by Kell, seconded by Volk to approve RESOLUTION NO. 2019-43,A RESOLUTION FOR THE REJECTION OF THE SPLASH PAD CONSTRUCTION BID. Roll call vote: Ayes: Otto, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Frieden declared RESOLUTION 2019-43 duly adopted. Motioned by Kell, seconded by Otto to introduce and approve the first reading of ORDINANCE NO. 28, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 69-PARKING REGULATIONS. Roll call vote: Ayes: Otto, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Motioned by Kell, seconded by Volk to approve RESOLUTION NO. 2019-45,A RESOLUTION SUPPORTING APPLICATION TO THE IOWA'S LIVING ROADWAYS COMMUNITY VISIONING—A TRANSPORTATION ENHANCEMENT PROGRAM. Roll call vote: Ayes: Otto, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Frieden declared RESOLUTION 2019-45 duly adopted. Motioned by Otto, seconded by Kell to approve RESOLUTION NO. 2019-46,A RESOLUTION APPROVING STREET FINANCE REPORT FOR FISCAL YEAR 2018- 2019. Roll call vote: Ayes: Otto, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Mayor Frieden declared RESOLUTION 2019-46 duly adopted. Motioned by Kell, seconded by Otto to approve the claims list dated August 13, 2019. Ayes: Otto, Kell, Volk, and Wainwright. Nays: None. Absent: Daly. Motion carried. Barb Conner asked about plans for the Stallman Drive area and a culvert. JoAnn Beer discussed the grant process and the water storage project. Mayor Frieden and the City Council discussed employment issues. The city clerk/treasurer gave an update about city hall staffing, discussed a possible special city council meeting later in August, and let the City Council know staff is working on budget amendment numbers.
