SPECIAL CITY COUNCIL MEETING
October 10, 2019
The special meeting of the Fairfax City Council was held Thursday, October 10, 2019, at
Fairfax city hall at 300 80"' Street Court. Mayor Frieden called the meeting to order at 6:01 PM.
Council members present: Mike Daly, Travis Otto, and Marianne Wainwright. Absent: Joe
Kell and Nick Volk. Other city staff present: Cynthia Stimson and Chris Philipp. Also present
were City Attorneys Randal Scholer and Crystal Pound.
Motioned by Daly, seconded by Otto to go into closed session per Iowa Code Chapter 21,
Section 5 c. "To discuss strategy with counsel in matters that are presently in litigation or where
litigation is imminent where its disclosure would be likely to prejudice or disadvantage the
position of the governmental body in that litigation." Roll call vote: Ayes: Daly, Otto, and
Wainwright. Nays: None. Absent: Kell and Volk. Motion carried.
There was no one else at the meeting, so no one was asked to leave or come back into the
meeting.
Motioned by Daly, seconded by Otto to reconvene the open session. Roll call vote: Ayes:
Daly, Otto, and Wainwright. Nays: none. Absent: Kell and Volk. Motion carried.
Motioned by Daly, seconded by Wainwright to accept the offer extended by Barb Conner's
attorney to remove all livestock except the current horse (Scout) within 30 days. The agreement
will have a stated date. Roll call vote: Ayes: Otto, Daly, and Wainwright. Nays: None.
Absent: Kell and Volk. Motion carried.
Motioned by Daly, seconded by Wainwright to adjourn the meeting. Ayes: Daly, Otto, and
Wainwright. Nays: None. Absent: Kell and Volk. Motion carried.
Mayor Frieden adjourned the meeting at approximately 6:40 PM.
