SPECIAL CITY COUNCIL MEETING
October 22, 2019
The special meeting of the Fairfax City Council was held Tuesday, October 22, 2019, at
Fairfax city hall at 300 80'h Street Court. Mayor Frieden called the meeting to order at 6:00 PM.
Council members present: Travis Otto, Mike Daly, Joe Kell, and Nick Volk. Absent: Marianne
Wainwright. Other city staff present: Cynthia Stimson and Kevin Stensland. Also present were
Maggie Burger, Speer Financial, and Shane Wicks, Hall and Hall Engineers, Inc.
Motioned by Volk, seconded by Daly to approve the consent agenda. Ayes: Otto, Daly,
Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried.
Mayor Frieden opened the public hearing regarding a FY20 budget amendment. City
Clerk/Treasurer Cynthia Stimson reviewed the budget amendment report. No other comments
were received. Mayor Frieden closed the public hearing at 6:07.
Motioned by Volk, seconded by Otto to approve RESOLUTION NO. 2019-57,A CITY
BUDGET AMENDMENT AND CERTIFICATION RESOLUTION—FY 2020 —
AMENDMENT #1. Roll call vote: Ayes: Otto, Daly, Kell, and Volk. Nays: None. Absent:
Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2019-57 duly adopted.
Fire Chief Mike Sankot discussed the quote for a fire truck. Three payment options were
reviewed. He discussed Walford's support. JoAnn Beer asked why the fire department needs
this truck. Chief Sankot explained that the truck it will be replacing will be 20 years old in
January. The NFPA recommends departments keep their lead trucks no older than 20 years.
More information is needed about timing,price changes, and support.
Extensive discussion was held regarding financing for the design and construction costs of
the Water Storage Project. The City has received approval for a SRF $291,000 planning and
design loan and a SRF loan for all of the construction costs except for those associated with a
size increase over 250,000 gallons. This additional cost is estimated at$150,000. The SRF
construction loan is for 2.0% for 20 years. A water debt service fee will be started to make the
loan payment. It is estimated to be $15.00 - $17.00 per month, per user. A revised estimate will
be made. It was stressed that all utility rates should be reviewed annually to ensure they are at
the proper level to cover loan obligations and expenses.
JoAnn Beer asked why the City is considering the 20-year term for the SRF loan. She stated
that the City usually does a shorter term. It was pointed out that the current sewer revenue loan
is 20 years and that if the term is shortened, the water debt service fee will need to be much
higher per user, per month. The longer term allows the costs to be spread over more years and
users.
Planned participation costs in Heartland Heights were reviewed and this additional $205,000
should be added to the planned bond.
Motioned by Kell, seconded by Daly to approve RESOLUTION NO. 2019-58,A
RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING
CONCERNING STATE REVOLVING FUND FINANCING AND THE RESULTS OF
THE ENVIRONMENTAL REVIEW. Roll call vote: Ayes: Otto, Daly, Kell, and Volk.
Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION
2019-58 duly adopted.
Maggie Burger reviewed Speer Financial's Annual TIF Report for Fairfax.
Motioned by Daly, seconded by Kell to approve RESOLUTION NO. 2019-59,A
RESOLUTION APPROVING ANNUAL URBAN RENEWAL REPORT FOR FISCAL
YEAR 2018-2019. Roll call vote: Ayes: Otto, Daly, Kell, and Volk. Nays: None. Absent:
Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2019-59 duly adopted.
Discussion was held regarding the Annual TIF Certification. It was recommended to raise
the amounts to $1,055,000 and $120,000.
Motioned by Volk, seconded by Kell to approve RESOLUTION NO. 2019-60,A
RESOLUTION APPROVING THE TIF CERTIFICATION FORMS with the forms
showing the revised numbers. Roll call vote: Ayes: Otto, Daly, Kell, and Volk. Nays: None.
Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2019-60 duly
adopted.
The Annual Financial Report for FY19 was reviewed.
Motioned by Kell, seconded by Otto to introduce and approve the first reading of
ORDINANCE NO. 29, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 17, COUNCIL. Roll call vote: Ayes: Otto and Kell. Nays: Daly and Volk.
Absent: Wainwright. Motion defeated.
Motioned by Kell, seconded by Daly to introduce and approve the first reading of
ORDINANCE NO. 30, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 15, MAYOR. Roll call vote: Ayes: Otto, Daly, Kell, and Volk. Nays: None.
Absent: Wainwright. Motion carried.
Motioned by Kell, seconded by Daly to suspend the rules requiring an ordinance be voted on
for passage at two council meetings prior to this meeting with respect to ORDINANCE 30. Roll
call vote: Roll call vote: Ayes: Otto, Daly, Kell, and Volk. Nays: None. Absent: Wainwright.
Motion carried.
Motioned by Daly, seconded by Kell for final approval and adopting ORDINANCE NO. 30,
AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017, OF
THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 15, MAYOR. Roll call
vote: Ayes: Otto, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried.
The resolution regarding the special meeting fees was not needed since the council pay was
not changed.
JoAnn Beer asked why the Parks and Recreation Director's position was advertised before a
job description was drafted. It was pointed out that the job description was approved as part of
the council packet for the Parks and Recreation Director's position topic during the October 8
meeting, which was before advertising for the position.
Motioned by Daly, seconded by Otto to approve RESOLUTION NO. 2019-61,A
RESOLUTION TO APPROVE THE PARKS AND RECREATION DIRECTOR'S JOB
DESCRIPTION. Roll call vote: Ayes: Otto, Daly, and Volk. Nays: None. Absent:
Wainwright. Abstain: Kell. Joe Kell abstained because he has applied for the position. Motion
carried. Mayor Frieden declared RESOLUTION 2019-61 duly adopted.
Motioned by Daly, seconded by Kell to approve RESOLUTION NO. 2019-62, A
RESOLUTION TO APPROVE THE PERSONNEL POLICY MANUAL. Roll call vote:
Ayes: Otto, Daly, Kell, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor
Frieden declared RESOLUTION 2019-62 duly adopted.
Marc Magers, a member of the Fairfax Fire and Rescue Department, thanked the current
council and mayor for their continued support of the fire department.
Motioned by Kell, seconded by Volk to adjourn the meeting. Ayes: Otto, Daly, Kell, and
Volk. Nays: None. Absent: Wainwright. Motion carried.
Mayor Frieden adjourned the meeting at approximately 7:57 PM.
