REGULAR CITY COUNCIL MEETING
NOVEMBER 12, 2019
The regular meeting of the Fairfax City Council was held November 12, 2019, at Fairfax city
hall at 300 80' Street Court. Mayor Frieden called the meeting to order at 6:02 PM. Council
members present: Mike Daly, Joe Kell, and Marianne Wainwright. Travis Otto and Nick Volk
were absent. Other city staff present: Kevin Stensland, Lynn Miller, Chris Philipp, Cathy Bayne,
and Cynthia Stimson.
Motioned by Kell, seconded by Daly to approve the consent agenda. Ayes: Daly, Kell, and
Wainwright. Nays: None. Absent: Otto and Volk. Motion carried.
Darrell Walters, Signal 88, reported to the City Council about their patrolling.
Cathy Bayne reported they have been working on a book arrangement system and she will
forward her Annual Survey Report to city hall.
Mike Sankot reported that the fire department has had 25 emergency calls since last meeting.
Chris Philipp reviewed the building department report. The Fairfax Planning and Zoning
Commission discussed the Future Land Use Map and a rezoning request at their last meeting.
He is organizing a trail committee and requested a city council member serve as the chairperson.
Lynn Miller reported the parks buildings are closed for winter, trail repair will have to wait
until spring, and they have been working on snow issues.
Kevin Stensland discussed basin work.
Nick Volk entered the meeting at 6:12 PM.
Annette McKeever reported the Parks and Beautification Committee participated in the
Haunted Farm.
Shane Wicks reviewed timing of future bidding and discussed a meeting with the area
businesses regarding the IDOT's proposed construction schedule.
Fire Chief Mike Sankot discussed selling the 2000 Freightliner pumper/engine. He has a
department that is interested. We would not sell this until the new one is in service.
Motioned by Kell, seconded by Volk to authorize Mike Sankot to negotiate selling the 2000
Freightliner with an asking price of$60,000, with delivery to be after the new truck is in service.
Ayes: Daly, Kell, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried.
Motioned by Volk, seconded by Kell to approve RESOLUTION NO. 2019-63,A
RESOLUTION AUTHORIZING THE PURCHASE OF A 2020 PIERCE IMPEL
PUMPER FIRE TRUCK. Roll call vote: Ayes: Daly, Kell, Volk, and Wainwright. Nays:
None. Absent: Otto. Motion carried. Mayor Frieden declared RESOLUTION 2019-63 duly
adopted.
Mayor Frieden opened the public hearing regarding the Fairfax Comprehensive Plan's Future
Land Use Map at 6:21 PM. Cindy Anderson, Barb Conner, Larry Valvoda, and Diane Valdoda
discussed their opposition to this change. They mentioned safety concerns, driveway and road
entrance placement, and not wanting more commercial in this area. Mayor Frieden closed the
public hearing at 6:43 PM.
Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2019-64,A
RESOLUTION TO ADOPT A REVISED COMPREHENSIVE PLAN AND FUTURE
LAND USE MAP FOR THE CITY OF FAIRFAX. Roll call vote: Ayes: Daly, Kell, Volk,
and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Frieden declared
RESOLUTION 2019-64 duly adopted.
Mayor Frieden opened the public hearing regarding a rezoning request for 50 Stallman Drive
from 44RS to C2 at 6:44 PM. Discussion was held concerning the fill process, granting access to
the Highway 151, and flooding concerns. Justin Sobaski explained the difference between the
flood plain and the floodway. Mayor Frieden closed the public hearing at 6:52 PM.
Motioned by Daly, seconded by Kell to introduce and approve the first reading of
ORDINANCE NO. 31, AN ORDINANCE AMENDING THE FAIRFAX ZONING
ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE
OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF
FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF 50
STALLMAN DRIVE, NOW KNOWN AS: LOT 3, MCGINNESS FIRST ADDITION TO
FAIRFAX, IOWA EXCEPT THAT PART MORE PARTICULARLY DESCRIBED AS
FOLLOWS: COMMENCING AT THE CENTER OF SECTION 9-82-8, THENCE
SOUTH 02022'51" EAST ALONG THE EAST LINE OF THE SW 1/40F SAID SECTION
9, A DISTANCE OF 817.73 FEET TO THE EASTERLY CORNER OF SAID LOT 3 AND
THE POINT OF BEGINNING; THENCE SOUTH 08032'24"WEST CONTINUING
ALONG SAID EAST LINE OF SAID LOT 3,A DISTANCE OF 237.30 FEET; THENCE

Motioned by Daly, seconded by Kell to suspend the rules requiring an ordinance be voted on
for passage at two council meetings prior to this meeting with respect to ORDINANCE 31. Roll
call vote: Ayes: Daly, Kell, Volk, and Wainwright. Nays: None. Absent: Otto. Motion
carried.
Motioned by Daly, seconded by Kell for final approval and adopting ORDINANCE NO.
31, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF
THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP

Kevin Stensland and Mayor Frieden discussed the process to develop the Source Water
Protection Plan and the Emergency Response Plan for the Fairfax Water System. Staff and a
committee has worked on this project for almost a year.
Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2019-65,A
RESOLUTION APPROVING THE SOURCE WATER PROTECTION PLAN FOR THE
CITY OF FAIRFAX. Roll call vote: Ayes: Daly, Kell, Volk, and Wainwright. Nays: None.
Absent: Otto. Motion carried. Mayor Frieden declared RESOLUTION 2019-65 duly adopted.
Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2019-66,A
RESOLUTION APPROVING THE EMERGENCY RESPONSE PLAN FOR THE CITY
OF FAIRFAX DRINKING WATER SYSTEM. Roll call vote: Ayes: Daly, Kell, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Frieden declared
RESOLUTION 2019-66 duly adopted.
Discussion was held regarding the agenda process resolution. Business owners and property
owners are to be added to the first item.
Motioned by Wainwright, seconded by Daly to approve RESOLUTION NO. 2019-67, A
RESOLUTION FORMALIZING THE CURRENT CITY COUNCIL PROCEDURES
FOR AGENDA AND MEETINGS. Roll call vote: Ayes: Daly, Kell, Volk, and Wainwright.
Nays: None. Absent: Otto. Motion carried. Mayor Frieden declared RESOLUTION 2019-67
duly adopted.
Motioned by Wainwright, seconded by Daly to approve RESOLUTION NO. 2019-68, A
RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR THE PAYMENT
OF DEBT INTEREST AND FEES DUE DECEMBER 1, 2019. Roll call vote: Ayes: Daly,
Kell, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Frieden
declared RESOLUTION 2019-68 duly adopted.
Motioned by Daly, seconded by Kell to approve RESOLUTION NO. 2019-69,A
RESOLUTION TO FIX A DATE FOR PUBLIC HEARING ON A LOAN AGREEMENT
IN A PRINCIPAL AMOUNT NOT TO EXCEED $1,300,000. Roll call vote: Ayes: Daly,
Kell, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Frieden
declared RESOLUTION 2019-69 duly adopted.
Loan information provided by Speer Financial was discussed.
A report from the hiring committee concerning the new Parks and Recreation Director was
discussed. The committee is recommending the City hire Joe Kell, Jr. at$19.50 an hour as the
new Parks and Recreation Director.
Motioned by Daly, seconded by Volk to hire Joe Kell, Jr. as Fairfax's new Parks and
Recreation Director at$19.50 an hour, starting November 18, 2019. Ayes: Daly, Volk, and
Wainwright. Nays: None. Absent: Otto. Abstain: Joe Kell abstained because he is the person
becoming an employee. Motion carried.
A couple of the claims were discussed.
Motioned by Daly, seconded by Kell to approve the claims list dated November 12, 2019.
Ayes: Daly, Kell, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried.
Mike Daly thanked Joe Kell for his service on the city council and presented him with a
plaque from the City of Fairfax.
Mayor Frieden stated the elections are completed and we will get back to work as usual.
City Clerk/Treasurer Cynthia Stimson reported that she and Mayor Frieden met with
councilmember elect Kate Pacha this morning and gave her lots of information. Mayor Frieden
introduced her to the councilmembers. Cynthia also stated she will be on vacation from
November 15 —25.
Motioned by Daly, seconded by Volk to adjourn the meeting. Ayes: Daly, Kell, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried.
Mayor Frieden adjourned the meeting at 7:21 PM.
