REGULAR CITY COUNCIL MEETING
JANUARY 14, 2020
The regular meeting of the Fairfax City Council was held January 14, 2020, at Fairfax city
hall at 300 80' Street Court. Mayor Frieden called the meeting to order at 6:01 PM. Council
members present: Travis Otto, Mike Daly, Kate Pacha, and Marianne Wainwright. Absent:
Nick Volk. Other city staff present: Kevin Stensland, Brian Merta, Chris Philipp, Joe Kell,
Cathy Bayne, and Cynthia Stimson.
Motioned by Wainwright, seconded by Otto to approve the consent agenda. Ayes: Otto,
Daly, Pacha, and Wainwright. Absent: Nick Volk. Motion carried.
Linn County Deputy Sheriff Speth presented the list of calls. Discussion was held about
observations and the Casey's location.
Darrell Walters, Signal 88, stated he has talked with the Casey's staff. He has informed
people in the parks that dogs must be on a leash.
Cathy Bayne stated the Fairfax Public Library had a good December with activities and
support. They are having discussions with the property owners next door about purchasing the
property.
Mike Sankot reported the new truck has been ordered, Walford has agreed to increase their
support for five years during the debt payments, the department had more calls in 2019 than
previous years, and they have all but the vehicles at the temporary station three location.
Chris Philipp reviewed the building department report. The Fairfax Planning and Zoning
Commission is working on the Future Land Use Map and the Comprehensive Plan. There were
dog incidents in December.
Brian Merta reported that Lynn Miller was hurt on the job on Monday and that the new truck
should be ready this week.
Kevin Stensland discussed a testing violation notification. They have taken steps to ensure
this will not happen again. Public notice will be in the February FACTS.
Motioned by Wainwright, seconded by Otto to approve Mike Rammelsberg to continue his
certification training to complete Water Distribution Grade 1 and Brian Merta to continue to
complete his Wastewater Grade 3. Ayes: Otto, Daly, Pacha, and Wainwright. Nays: None.
Absent: Volk. Motion carried.
Joe Kell discussed he has our first signed contract for a partner event in April, he is working
on the advertising banners, youth sports signups have begun online, and the trail committee met
on January 8.
Maggie Burger and Jon Murphy, from Speer Financial, were present to discuss the City's
bond sale today. Seven bids were received as follows:

$20,147.50, making the total $1,290,147.50.
Motioned by Daly, seconded by Otto to approve RESOLUTION NO. 2020-01,A
RESOLUTION AWARDING SALE OF GENERAL OBLIGATION CORPORATE
PURPOSE BONDS, SERIES 2020. Roll call vote: Ayes: Otto, Daly, Pacha, and Wainwright.
Nays: None. Absent: Volk. Motion carried. Mayor Frieden declared RESOLUTION 2020-01
duly adopted.
Shane Wicks discussed and recommended approval of the final plat for Stallman's Third
Addition to Linn County.
Motioned by Wainwright, seconded by Daly to approve RESOLUTION NO. 2020-02, A
RESOLUTION TO APPROVE THE FINAL PLAT FOR STALLMAN'S THIRD
ADDITION TO LINN COUNTY, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, and
Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor Frieden declared
RESOLUTION 2020-02 duly adopted.
Mayor Frieden opened the public hearing regarding Fairfax Sports Complex Splash Pad
Project's proposed plans, specifications, form of contract, opinion of probable cost and the
proposed improvements at 6:23 PM. JoAnn Beer asked about the budget, design, other uses of
the money, and donations. Cynthia Stimson discussed the bonding purpose limitations and
sources from money on hand for the amount over the bonding amount. Discussion was held that
The Complex is a destination park, the current designed splash pad will compliment this, and
these types of amenities draw people to Fairfax. Mayor Frieden closed the public hearing at 6:39
PM.
Two splash pad construction bids were received as follows:
Peak Construction Group, Inc. Base Bid: $331,007.04 Alternates: $31,841.60
Boomerang Corp. Base Bid: $342,559.00 Alternates: $30,700.00
Hall and Hall Engineers, Inc. is recommending approval of the base bid of$331,007.04 from
Peak Construction and having the city staff complete the alternate work.
Motioned by Otto, seconded by Wainwright to approve RESOLUTION NO. 2020-03, A
RESOLUTION FOR THE AWARD OF THE SPLASH PAD CONSTRUCTION BID. Roll
call vote: Ayes: Otto and Wainwright. Nays: Daly and Pacha. Absent: Volk. Motion
defeated. Mayor Frieden declared RESOLUTION 2020-03 defeated.
Motioned by Otto, seconded by Daly to approve RESOLUTION NO. 2020-04,A
RESOLUTION SETTING A PUBLIC HEARING FOR PLANS, SPECIFICATIONS,
FORM OF CONTRACT, AND OPINION OF PROBABLE COST FOR
CONSTRUCTION OF THE 2020 AT-GRADE WATER STORAGE TANK
IMPROVEMENTS. Roll call vote: Ayes: Otto, Daly, Pacha, and Wainwright. Nays: None.
Absent: Volk. Motion carried. Mayor Frieden declared RESOLUTION 2020-04 duly adopted.
Joe Kell discussed the 2020 Rental Agreement and Use Guidelines for Fairfax City Park
Field.
Motioned by Otto, seconded by Daly to approve RESOLUTION NO. 2020-05,A
RESOLUTION TO APPROVE CITY OF FAIRFAX PARKS FORMS. Roll call vote:
Ayes: Otto, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor
Frieden declared RESOLUTION 2020-05 duly adopted.
Discussion was held regarding the proposed Partnership Agreement with FYSA. What roles
the FYSA and City will have were reviewed.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2020-06,A
RESOLUTION ENTERING INTO A PARTNERSHIP AGREEMENT WITH THE
FAIRFAX YOUTH SPORTS ASSOCIATION. Roll call vote: Ayes: Otto, Daly, Pacha, and
Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor Frieden declared
RESOLUTION 2020-06 duly adopted.
Motioned by Daly, seconded by Otto to approve RESOLUTION NO. 2020-07,A
RESOLUTION TO APPROVE THE HIRING PROCESS POLICY. Roll call vote: Ayes:
Otto, Daly, and Pacha. Nays: None. Absent: Volk and Wainwright. Motion carried. Mayor
Frieden declared RESOLUTION 2020-07 duly adopted.
Motioned by Otto, seconded by Daly to approve the Concession Stand Worker I and Stand
manager job descriptions and information sheets. Ayes: Otto, Daly, and Pacha. Nays: None.
Absent: Volk and Wainwright. Motion carried.
Motioned by Daly, seconded by Wainwright to introduce and approve the first reading of
ORDINANCE NO. 32, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 7, FISCAL MANAGEMENT. Roll call vote: Ayes: Otto, Daly, Pacha, and
Wainwright. Nays: None. Absent: Volk. Motion carried.
Motioned by Daly, seconded by Otto to suspend the rules requiring an ordinance be voted on
for passage at two council meetings prior to this meeting with respect to ORDINANCE 32. Roll
call vote: Ayes: Otto, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion
carried.
Motioned by Daly, seconded by Otto for final approval and adopting ORDINANCE NO. 32,
AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017, OF
THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 7, FISCAL
MANAGEMENT. Roll call vote: Ayes: Otto, Daly, Pacha, and Wainwright. Nays: None.
Absent: Volk. Motion carried.
Motioned by Wainwright, seconded by Daly to introduce and approve the first reading of
ORDINANCE NO. 33, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY CREATING
CHAPTER 164, DESIGN AND SPECIFICATION STANDARDS FOR ALL PUBLIC
IMPROVEMENTS. Roll call vote: Ayes: Otto, Daly, Pacha, and Wainwright. Nays: None.
Absent: Volk. Motion carried.
Motioned by Daly, seconded by Wainwright to suspend the rules requiring an ordinance be
voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE
33. Roll call vote: Ayes: Otto, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk.
Motion carried.
Motioned by Daly, seconded by Wainwright for final approval and adopting ORDINANCE
NO. 33, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF
2017, OF THE CITY OF FAIRFAX, IOWA, BY CREATING CHAPTER 164, DESIGN
AND SPECIFICATION STANDARDS FOR ALL PUBLIC IMPROVEMENTS. Roll call
vote: Ayes: Otto, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried.
Motioned by Otto, seconded by Pacha to approve RESOLUTION NO. 2020-08,A
RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES. Roll call vote: Ayes:
Otto, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried. Mayor
Frieden declared RESOLUTION 2020-08 duly adopted.
Motioned by Wainwright, seconded by Otto to approve RESOLUTION NO. 2020-09, A
RESOLUTION AUTHORIZING THE EXECUTION OF AN INTERGOVERNMENTAL
(28E) AGREEMENT BETWEEN THE CITY OF FAIRFAX AND CITY OF WALFORD
FOR FIRE PROTECTION. Roll call vote: Ayes: Otto, Daly, Pacha, and Wainwright. Nays:
None. Absent: Volk. Motion carried. Mayor Frieden declared RESOLUTION 2020-09 duly
adopted.
The budget process for FY21 was discussed.
Motioned by Daly, seconded by Pacha to approve the claims list dated January 14, 2020.
Ayes: Otto, Daly, Pacha, and Wainwright. Nays: None. Absent: Volk. Motion carried.
The city clerk stated the Visioning Committee will meet February 11, February 18 is the date
of the regular meeting, the auditors are gone and it went well, and we received 14 applications
for the maintenance position. It was discussed that for the bidding on the water storage project,
we will have the regular March meeting on the 10`x' and a special on March 24.
Motioned by Daly, seconded by Pacha to adjourn the meeting. Ayes: Otto, Daly, Pacha, and
Wainwright. Nays: None. Absent: Volk. Motion carried.
Mayor Frieden adjourned the meeting at 7:37 PM.
