REGULAR CITY COUNCIL MEETING
FEBRUARY 18, 2020
The regular meeting of the Fairfax City Council was held February 18, 2020, at Fairfax city
hall at 300 80' Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council
members present: Mike Daly, Kate Pacha, Nick Volk, and Marianne Wainwright. Travis Otto
was present via a speaker phone. Other city staff present: Lynn Miller, Kevin Stensland, Chris
Philipp, Cathy Bayne, and Cynthia Stimson.
Motioned by Wainwright, seconded by Volk to approve the consent agenda. Ayes: Daly,
Volk, Wainwright, and Otto. Nays: Pacha. Motion carried.
Darrell Walters, Signal 88, mentioned a street light that is out. Mike Daly asked it he ever
gets guff from citizens. Darrell said no and usually the only time he talks to residents is to ask
them to leave a park after hours.
Cathy Bayne stated the Fairfax Public Library hosted master gardeners and a ghost
presentation.
Lynn Miller informed the City Council the fire department has opened up station 43 and they
had a fire near Walford with a fatality.
Chris Philipp reviewed the building department report.
Lynn Miller reported they have been working on equipment maintenance, have a good
supply of salt and sand, and they are getting ready for the highway project.
JoAnn Beer asked about a permit notice in the newspaper. Shane Wicks informed her it was
probably general permit 42 for the water storage project.
Mayor Frieden opened the public hearing regarding the maximum tax dollars from certain
levies for the FY21 budget at 6:10 PM. The city clerk discussed the notice and levy amount,
which is staying at$8.10. Mayor Frieden closed the public hearing at 6:12 PM.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2020-12,A
RESOLUTION APPROVING THE MAXIMUM TAX DOLLARS FROM CERTAIN
LEVIES FOR THE CITY'S PROPOSED FISCAL YEAR 2020-2021 BUDGET. Roll call
vote: Ayes: Daly, Pacha, Volk, Wainwright, and Otto. Nays: None. Motion carried. Mayor
Frieden declared RESOLUTION 2020-12 duly adopted.
Discussion was held regarding the Splash Pad Project. The city clerk let the Council know
that she contacted the features company. If the City cancelled their order they would have to pay
$96,312 for the work already completed. Kate Pacha stated she received a threat about her vote
on this project. Mike Daly asked for Council opinions. Marianne Wainwright stated the large
recreational projects for the City are expensive and that it would be wrong not to move forward.
Nick Volk stated that the City has been talking about putting in a splash pad for a decade. Travis
Otto stated we should move forward and citizens want the splash pad.
Motioned by Volk, seconded by Wainwright to approve RESOLUTION NO. 2020-13, A
RESOLUTION FOR THE AWARD OF THE SPLASH PAD CONSTRUCTION BID. Roll
call vote: Ayes: Volk, Wainwright, and Otto. Nays: Daly and Pacha. Motion carried. Mayor
Frieden declared RESOLUTION 2020-13 duly adopted.
Cindy Anderson discussed her opinion about the process.
Mayor Frieden opened a public hearing regarding the proposed plans, specifications, form of
contract, and opinion of probable costs at$1,110,000.00 for the 2020 At-Grade Water Storage
Tank Improvements Project at 6:27 PM. No one had any comments. Mayor Frieden closed the
public hearing at 6:28 PM.
Jon Larson, Hall and Hall Engineers, reviewed the two bids received for the 2020 At-Grade
Water Storage Tank Improvements Project and recommended the City accept the base bid of
$1,103,500.00 from Preload, LLC and reject their alternate bid.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2020-14,A
RESOLUTION FOR THE AWARD OF THE 2020 AT-GRADE WATER STORAGE
TANK IMPROVEMENTS PROJECT. Roll call vote: Ayes: Daly, Pacha, Volk, Wainwright,
and Otto. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2020-14 duly
adopted.
It was agreed upon to hold a special city council meeting on March 24 to allow enough time
between meetings for the bidding process for the Pump House & Site Improvements Project.
Motioned by Wainwright, seconded by Daly to approve RESOLUTION NO. 2020-15, A
RESOLUTION SETTING A PUBLIC HEARING FOR PLANS, SPECIFICATIONS,
FORM OF CONTRACT, AND OPINION OF PROBABLE COST FOR
CONSTRUCTION OF THE 2020 PUMP HOUSE & SITE IMPROVEMENTS PROJECT.
Roll call vote: Ayes: Daly, Pacha, Volk, Wainwright, and Otto. Nays: None. Motion carried.
Mayor Frieden declared RESOLUTION 2020-15 duly adopted.
Mayor Frieden reported the hiring committee's recommendation for the full-time Public
Works I position is to hire Brandon Lefebure at$18.00 per hour.
Motioned by Wainwright, seconded by Daly to hire Brandon Lefebure for the full-time
Public Works I position at$18.00 per hour. Ayes: Daly, Pacha, Volk, Wainwright, and Otto.
Nays: None. Motion carried.
Discussion was held regarding the Park and Recreation Director's 90-day review. Mayor
Frieden discussed the accomplishments made during this time and recommended the City
Council raise his hourly rate from $19.50 to $20.00.
Motioned by Volk, seconded by Wainwright to increase Joe Kell's hourly rate to $20.00 an
hour. Ayes: Volk, Wainwright, and Otto. Nays: Daly and Pacha. Motion carried.
Motioned by Volk, seconded by Daly to approve RESOLUTION NO. 2020-16,A
RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES. Roll call vote: Ayes:
Daly, Pacha, Volk, Wainwright, and Otto. Nays: None. Motion carried. Mayor Frieden
declared RESOLUTION 2020-16 duly adopted.
Jon Larson discussed changes in the trail plans.
Motioned by Pacha, seconded by Volk to approve RESOLUTION NO. 2020-17,A
RESOLUTION AUTHORIZING APPLICATION TO CORRIDOR METROPOLITAN
PLANNING ORGANIZATION FOR ADDITIONAL REGIONAL TRANSPORTATION
FUNDS AND COMMITTING TO PROVIDE ADDITIONAL LOCAL MATCHING
FUNDS CONTINGENT UPON AWARD AND ACCEPTANCE OF TRANSPORTATION
GRANT FUNDS. Roll call vote: Ayes: Daly, Pacha, Volk, Wainwright, and Otto. Nays:
None. Motion carried. Mayor Frieden declared RESOLUTION 2020-17 duly adopted.
Shane Wicks discussed the sewer easement needed on the Bellon-Africa Family Farms
property in conjunction with the IDOT's highway project.
Motioned by Wainwright, seconded by Daly to approve RESOLUTION NO. 2020-18, A
RESOLUTION APPROVING THE BELLON-AFRICA FAMILY FARMS L.C.
SANITARY SEWER FACILITIES EASEMENT AGREEMENT IN THE CITY OF
FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Daly, Pacha, Volk, Wainwright,
and Otto. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2020-18 duly
adopted.
Shane Wicks recommended the City Council approve the Heartland Heights Pond
Improvements with the conditions listed in the resolution.
Motioned by Volk, seconded by Pacha to approve RESOLUTION NO. 2020-19,A
RESOLUTION APPROVING THE PLAN OF IMPROVEMENTS AND DRAINAGE
REPORT FOR THE PROPOSED IMPROVEMENTS FOR HEARTLAND HEIGHTS
BASIN AREAS TO THE CITY OF FAIRFAX,LINN COUNTY, IOWA. Roll call vote:
Ayes: Daly, Pacha, Volk, Wainwright, and Otto. Nays: None. Motion carried. Mayor Frieden
declared RESOLUTION 2020-19 duly adopted.
Jon Larson stated that the ordinance is for amendments to the SUDAS standards. It was
explained these are standards for public improvements.
Motioned by Wainwright, seconded by Volk to introduce and approve the first reading of
ORDINANCE NO. 34, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 164, DESIGN AND SPECIFICATION STANDARDS FOR ALL PUBLIC
IMPROVEMENTS. Roll call vote: Ayes: Daly,Pacha, Volk, Wainwright, and Otto. Nays:
None. Motion carried.
Travis Otto stated he needed to hang up the phone and leave the meeting at 6:57 PM.
Motioned by Daly, seconded by Pacha to suspend the rules requiring an ordinance be voted
on for passage at two council meetings prior to this meeting with respect to ORDINANCE 34.
Roll call vote: Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent: Otto. Motion
carried.
Motioned by Daly, seconded by Pacha for final approval and adopting ORDINANCE NO.
34, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017,
OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 164, DESIGN AND
SPECIFICATION STANDARDS FOR ALL PUBLIC IMPROVEMENTS. Roll call vote:
Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried.
Lynn Miller and Mayor Frieden discussed the stop signs in the ordinance are possible areas
where a stop sign may be needed due to the highway project detour.
Motioned by Volk, seconded by Wainwright to introduce and approve the first reading of
ORDINANCE NO. 35, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 65 STOP OR YIELD REQUIRED REGULATIONS. Roll call vote: Ayes:
Daly, Pacha, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried.
Motioned by Daly, seconded by Pacha to suspend the rules requiring an ordinance be voted

35, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017,
OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 65 STOP OR YIELD
REQUIRED REGULATIONS. Roll call vote: Ayes: Daly, Pacha, Volk, and Wainwright.
Nays: None. Absent: Otto. Motion carried.
The city clerk explained the transfer resolution is for the new bond funds.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2020-20, A
RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FOR $1,270,000 GO
BOND, SERIES 2020. Roll call vote: Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None.
Absent: Otto. Motion carried. Mayor Frieden declared RESOLUTION 2020-20 duly adopted.
Cynthia Stimson discussed her request to attend the IIMC Annual Conference in St. Louis.
Motioned by Volk, seconded by Wainwright to approve sending Cynthia Stimson to the
IIMC Annual Conference in St. Louis in May of 2020. Ayes: Daly, Pacha, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried.
Cynthia Stimson gave a brief description of the information about a Point of Sale system in
the concession stands and Joe Kell's recommendation.
Motioned by Volk, seconded by Wainwright to approve purchasing three RBS POS cash
registers for $775.00 each. Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent:
Otto. Motion carried.
Lynn Miller discussed the three quotes for a mower. He is recommending the Toro 6000
Series from Wade's for $10,715.22 after trade-in and with the listed options.
Motioned by Daly, seconded by Pacha to purchase the Toro 6000 Series mower from Wade's
for $10,715.22 after trade-in and with the listed options. Ayes: Daly, Pacha, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried.
Lynn Miller discussed the three quotes for a trailer. He is recommending the H & H trailer
from Patten Equipment for $5,726.00 with the listed options.
Motioned by Daly, seconded by Volk to purchase the H&H trailer from Patten Equipment for
$5,726.00 with the listed options. Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None.
Absent: Otto. Motion carried.
Discussion was held concerning seasonal mowing help.
Motioned by Volk, seconded by Pacha to allow staff to advertise if needed for seasonal
mowing help without a hiring committee process. Ayes: Daly, Pacha, Volk, and Wainwright.
Nays: None. Absent: Otto. Motion carried.
A report of costs from the 2019 City-Wide Clean-up Day was reviewed.
Motioned by Daly, seconded by Pacha to hold a 2020 City-Wide Clean-up Day on Saturday,
June 6, 2020. Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent: Otto. Motion
carried.
Information about the City-Wide Garage Sale Day was reviewed.
Motioned by Daly, seconded by Volk for the City to organize a 2020 City-Wide Garage Sale
Day on May 16, 2020, with the registration fee to stay at$5.00. Ayes: Daly, Pacha, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried.
The city clerk reviewed the FY20 budget amendment report and the proposed FY21 budget.
Council gave direction for projects and some utility rates.
Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2020-21,A
RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE
PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S
PROPOSED FISCAL YEAR 2020-2021 BUDGET. Roll call vote: Ayes: Daly, Pacha, Volk,
and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Frieden declared
RESOLUTION 2020-21 duly adopted.
Mayor Frieden thanked the audience for coming to the meeting and stated he hoped they
come to future meetings, but if they were here due to the Facebook post by JoAnn Beer, he let
them know her post was completely wrong. At no time has staff or he recommended hiring a
fourth city hall clerk and the agenda did not state such an intent. Kim Donaldson has resigned
due to personal reasons and the City needs to fill her position. We are suggesting to advertise for
an office assistant. Cynthia Stimson discussed the timing and suggested the hiring committee's
recommendation be considered at the March 24 special meeting. Kate Pacha will serve on the
committee.
Motioned by Daly, seconded by Wainwright to advertise for an office assistant to fill the staff
vacancy. Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent: Otto. Motion
carried.
Nick Volk asked about the replacement time for the UV lamps. Kevin explained about three
years. Kate Pacha asked why Cynthia Stimson is being paid from the Road Use Fund. Cynthia
stated that she processes the bills, payroll, budget, and reporting for the Road Use Fund.
Marianne Wainwright added that the city hall staff divide their time based on their duties in all
areas.
Motioned by Wainwright, seconded by Volk to approve the claims list dated February 18,
2020. Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried.
Linn County Supervisor Brent Oleson presented the Linn County Budget Report. Jarden
Kelly with Linn County Secondary Roads discussed some of their projects.
JoAnn Beer stated she will correct her Facebook post and thanked the City Council for
compromising on the utility rate recommendations.
Mayor Frieden stated that information about possible growth will be delayed a month due to
soil testing.
Motioned by Daly, seconded by Pacha to adjourn the meeting. Ayes: Daly, Pacha, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried.
