REGULAR CITY COUNCIL MEETING
MARCH 10, 2020
The regular meeting of the Fairfax City Council was held March 10, 2020, at Fairfax city hall
at 300 80'h Street Court. Mayor Frieden called the meeting to order at 6:00 PM. Council
members present: Travis Otto, Mike Daly, Kate Pacha, Nick Volk, and Marianne Wainwright.
Other city staff present: Lynn Miller, Kevin Stensland, Chris Philipp, Cathy Bayne, and Cynthia
Stimson.
Nick Volk asked about the variance granted by the Board of Adjustment. Chris Philipp
discussed the fence/wall.
Motioned by Daly, seconded by Pacha to approve the consent agenda. Ayes: Otto, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Linn County Deputy Speth presented the list of calls. Speeding on Vanderbilt was discussed.
Darrell Walters, Signal 88, mentioned that sometimes he reminds residents to have their dog
on a leash in our regular parks.
Cathy Bayne stated the Fairfax Public Library is working on their summer programming.
They have a negotiated price for the building and need to get paperwork completed.
Fire Chief Mike Sankot discussed fireworks and the new truck.
Chris Philipp reviewed the building department report.
Lynn Miller reported they have been putting up street signage and the new mower was
delivered today.
Kevin Stensland informed the City Council that he has set up a meter testing station, the UV
system is up and running, and he is helping other communities with their systems.
Joe Kell discussed the Parks Department has been getting ready for summer, the Trail
Committee will not meet until May, and the USA Days kid parade. He let the City Council
know that he received a Fellowship Grant to attend the Parks Conference March 23 —26 in
Cedar Rapids, so the City will have no costs.
Shane Wicks stated we will be receiving bids on March 17 and taking action on these during
the special meeting on March 24.
Joe Horaney gave an update about the Solid Waste Agency.
Charlie Garwood, Wilson-Hite Insurance, presented information about the City's insurance
renewal.
Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2020-22,A
RESOLUTION AUTHORIZING COMMERCIAL INSURANCE COVERAGE FOR THE
CITY OF FAIRFAX. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Frieden declared RESOLUTION 2020-22 duly adopted.
Mayor Frieden opened the public hearing regarding the FY21 budget at 6:31 PM. No
comments have been received or were made. Mayor Frieden closed the public hearing at 6:32
PM.
Motioned by Volk, seconded by Pacha to approve RESOLUTION NO. 2020-23,A
RESOLUTION APPROVING CITY OF FAIRFAX'S ANNUAL BUDGET FOR FISCAL
YEAR 2020-2021. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Frieden declared RESOLUTION 2020-23 duly adopted.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2020-24,A
RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE
PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S
PROPOSED AMENDMENT TO THE FISCAL YEAR 2019-2020 BUDGET. Roll call
vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor
Frieden declared RESOLUTION 2020-24 duly adopted.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2020-25,A
RESOLUTION APPROVING THE CONTRACT FOR LAW ENFORCEMENT
SERVICE WITH LINN COUNTY AND THE LINN COUNTY SHERIFF'S
DEPARTMENT FOR FISCAL YEAR 2020-2021 BUDGET. Roll call vote: Ayes: Otto,
Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared
RESOLUTION 2020-25 duly adopted.
Motioned by Wainwright, seconded by Daly to approve RESOLUTION NO. 2020-26, A
RESOLUTION TO APPROVE THE PURCHASING POLICY. Roll call vote: Ayes: Otto,
Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared
RESOLUTION 2020-26 duly adopted.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2020-27, A
RESOLUTION APPROVING FIREWORKS PERMIT FOR THE FAIRFAX FIRE AND
RESCUE DEPARTMENT. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright.
Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2020-27 duly adopted.
Discussion was held regarding the embargo process, buses, speed bumps, and speeding.
Motioned by Volk, seconded by Otto to approve RESOLUTION NO. 2020-28,A
RESOLUTION TO AUTORIZE EMBARGO TO BE PLACED ON CERTAIN CITY OF
FAIRFAX STREETS. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Frieden declared RESOLUTION 2020-28 duly adopted.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2020-29, A
RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING
CONCERNING ADOPTING AN UPDATED FUTURE LAND USE MAP AS PART OF
THE FAIRFAX COMPREHENSIVE PLAN FOR THE CITY OF FAIRFAX. Roll call
vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor
Frieden declared RESOLUTION 2020-29 duly adopted.
Motioned by Wainwright, seconded by Pacha to introduce and approve the first reading of
ORDINANCE NO. 36, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADDING CHAPTER
23 PARKS AND BEAUTIFICATION BOARD. Roll call vote: Ayes: Otto, Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Wainwright, seconded by Daly to suspend the rules requiring an ordinance be
voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE
36. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion
carried.
Motioned by Wainwright, seconded by Daly for final approval and adopting ORDINANCE
NO. 36, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF
2017, OF THE CITY OF FAIRFAX, IOWA, BY ADDING CHAPTER 23 PARKS AND
BEAUTIFICATION BOARD. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.

ORDINANCE NO. 37, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 17, COUNCIL. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright.
Nays: None. Motion carried.

39, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017,
OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 106, COLLECTION
OF SOLID WASTE. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried.

ORDINANCE NO. 40, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 99, SEWER SERVICE CHARGES. Roll call vote: Ayes: Otto, Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion carried.

voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE

Motioned by Daly, seconded by Pacha for final approval and adopting ORDINANCE NO.
40, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017,
OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 99, SEWER
SERVICE CHARGES. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried.
Discussion was held regarding quotes for street sweeping.
Motioned by Wainwright, seconded by Volk to accept the quote for street sweeping from
Kluesner Construction, Inc. for$122.00 per hour. Ayes: Otto, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Volk, seconded by Daly to accept the quote for spraying from CRL Lawn Care
Landscaping for $22,000.00. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None.
Motion carried.
Nick Volk asked about the business refunds listed. Joe Kell explained it was for a price
difference for the park banners.
Motioned by Daly, seconded by Pacha to approve the claims list dated March 10, 2020.
Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Trent Rosekrans discussed traffic problems. Mayor Frieden informed everyone that he has
been in contact with the Linn County Sheriff s Department.
Barb Conner asked about comments made by an IDOT employee and an agreement with the
IDOT. She is to talk to the IDOT about her concerns.
The city clerk reminded everyone about the Visioning Focus Groups on April 18, Republic
Services will be making a recycling presentation during the special meeting on March 24, we
received 21 applications and have three interviews scheduled, and that the auditor's office is
trying to finalize their audit report by the March 31, 2020, deadline.
