REGULAR CITY COUNCIL MEETING
AUGUST 18, 2020
A regular meeting of the Fairfax City Council was held August 18, 2020. In order to help
stop the spread of the COVID-19 virus, this special meeting of the Fairfax City Council was held
electronically. Chapter 21.8 of the Iowa Code does permit an electronic meeting where all
members participate remotely when an in-person meeting is impossible or impractical, which is
certainly true during this crisis. On March 19, 2020, Governor Reynolds issued a Proclamation
of Disaster Emergency which included a suspension of Iowa laws that would prevent the use of
electronic meetings or the limitation on the number of people present at an in-person meeting
site. Therefore, only Mayor Frieden and City Clerk/Treasurer Cynthia Stimson were present at
Fairfax City Hall at 300 80th Street Court. The agenda had this message posted more than 24
hours in advance to give instructions on how others could participate in the meeting: Due to the
COVID-19 crisis, the City of Fairfax will be holding this regular city council meeting
electronically via a conference call. If you would like to participate,just before the meeting start
time, you must call 425-436-6370 and enter this access code: 759797. Only staff are allowed in
City Hall.
Mayor Frieden called the meeting to order at 6:00 PM. Councilmembers present on the
telephone conference call were: Travis Otto, Mike Daly, Kate Pacha, Nick Volk, and Marianne
Wainwright.
Motioned by Daly, seconded by Pacha to approve agenda after removal of item 47; hearing
with Jay Hopkins regarding 522 Williams Blvd unfinished detached garage due to pending
litigation. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motioned carried.
Motioned by Daly, seconded by Pacha to approve the consent agenda. Ayes: Otto, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried.
The Linn County Sheriff's Department has submitted a written report.
Signal 88 has been doing extra patrol for storage units and on main roads due to damage
from storm.
Library submitted a written report.
Fire Chief Mike Sankot reported they need to purchase new vent fan and new SCBA bottles.
Also, many calls coming in due to storm.
Building department report is in the packet.
Maintenance Supervisor Lynn Miller reported the storage tank is in good condition and they
have been very busy cleaning up after the storm.
Kevin Stensland reported we lost one generator. Ace Electric to replace it at a cost of
approximately, $21,000.00. We have breakdown coverage for this.
Motioned by Pacha, seconded by Daly to approve the quote from Ace Electric of$20,950 for
the purchase of a new generator. Ayes: Otto, Daly, Pacha, Volk and Wainwright. Nays: None.
Motion carried.
Joe Kell reported 12 trees were lost due to storm, but facilities are in good condition with
only minimal damage. There have been many volunteers helping. The adjuster will take a tour of
the grounds.
Shane Wicks did not have reports ready due to power outage from the storm.
Mayor Frieden called Public Hearing to order at 6:14 pm regarding rezoning request from
Logistics Park CR, LLC. There was one letter and one phone call against rezoning. Closed
hearing at 6:15 pm.
Motioned by Daly, seconded by Pacha to approve the introduction and first reading of
ORDINANCE NO. 46, AN ORDINANCE AMENDING THE 2017 FAIRFAX ZONING
CODE AND OFFICIAL ZONING MAP. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Otto to approve to suspend the rules requiring an ordinance
be voted on for passage at two council meetings prior to this meeting with respect to
ORDINANCE NO. 46. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried.
Motioned by Daly, seconded by Pacha for final passage and adopt ORDINANCE NO. 46,
AN ORDINANCE AMENDING 2017 FAIRFAX ZONING CODE AND OFFICIAL
ZONING MAP. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None.
Motion carried.
Motioned by Wainwright, seconded by Pacha to approve RESOLUTION NO. 2020-64, A
RESOLUTION APPROVING THE SITE PLAN OF IMPROVEMENTS, DRAINAGE
REPORT, AND SITE LIGHTING PLAN FOR THE PROPOSED IMPROVEMENTS
FOR ALLIANT ENERGY TRANSPORTATION (AET) IN THE CITY OF FAIRFAX,
LINN COUNTY, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright.
Nays: None. Motion carried. Mayor Frieden declared RESOLUTION NO. 2020-64 duly
adopted.
Discussion was held about Fairfax establishing regulations about lighting. Nick Volk will
serve on a committee to look into this topic.
Shane Wicks asked that the Site Plan Development Agreement for the AET Project be
discussed at the September meeting.
Motioned by Otto, seconded by Pacha to approve the commercial building permit application
for 2020 Lefebure Road Logistic Park CR, LLC, owner. Permit was received from Ryan
Companies. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None.
Motion carried.
Lynn Miller discussed parking on Front Street. This is an emergency route and with the
storm it proves that putting parking on this street would be dangerous. Michelle Barnell thanked
us for our time and consideration of this matter.
Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2020-65,A
RESOLUTION TO APPROVE THE BUILDING VALUATION POLICY. Roll call vote:
Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden
declared RESOLUTION 2020-65 duly adopted.
Motioned by Volk, seconded by Pacha to approve the first reading of ORDINANCE NO.
45, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017,
OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 156 NATIONAL
ELECTRICAL CODE. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried.
Motioned by Volk, seconded by Daly to approve to suspend the rules requiring an ordinance
be voted on for passage at two council meetings prior to this meeting with respect to
ORDINANCE NO. 45. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried.
Motioned by Volk, seconded by Daly for final passage and adopt with respect
ORDINANCE NO. 45, AN ORDINANCE AMENDING THE FAIRFAX CODE OF
ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING
CHAPTER 156 NATIONAL ELECTRICAL CODE. Roll call vote: Ayes: Otto, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Chris Philipp recommended approval of the Sign Permit Application for 4 Seasons Golf for
114 Williams Blvd.
Motioned by Otto, seconded by Pacha to approve the Sign Permit Application for 4 Season
Golf for 114 Williams Blvd. Roll call vote: Ayes: Otto, Daly, Pacha, Volk and Wainwright.
Nays: None. Motion carried.
Chris Philipp recommended waiving building permit fees for storm repair work.

The Real Estate Purchase Agreement with Fidelitas Lodge No. 364 was not ready for
discussion at this time.

RESOLUTION OUTLINING FAIRFAX'S SUPPORT OF THE OUTDOOR WARNING
SIREN SYSTEM. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Frieden declared RESOLUTION 2020-66 duly adopted.

RESOLUTION TO APPROVE PAY APPLICATION NO. 4 FROM PEAK
CONSTRUCTION GROUP, INC. FOR THE FAIRFAX SPORTS COMPLEX SPLASH
PAD PROJECT. Roll call vote: Ayes: Otto, Volk, and Wainwright. Nays: Daly and Pacha.
Motion carried. Mayor Frieden declared RESOLUTION 2020-67 duly adopted.

RESOLUTION TO APPROVE PAY APPLICATION NO. 4 FROM KLEIMAN
CONSTRUCTION, INC. FOR THE 2020 PUMP HOUSE AND SITE IMPROVEMENTS
PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None.
Motion carried. Mayor Frieden declared RESOLUTION 2020-68 duly adopted.

RESOLUTION TO APPROVE PAY APPLICATION NO. 4 FROM PRELOAD, LLC
FOR THE 2020 AT-GRADE WATER STORAGE TANK IMPROVEMENTS PROJECT.
Roll call vote: Ayes: Otto, Daly, Pacha, Volk and Wainwright. Nays: None. Motioned carried.
Mayor Frieden declared RESOLUTION 2020-69 duly adopted.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2020-70, A
RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES. Roll call vote: Ayes:
Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden
declared RESOLUTION 2020-70 duly adopted.
Motioned by Otto, seconded by Volk to approve RESOLUTION NO. 2020-71, SETTING
DATE FOR PUBLIC HEARING ON 2020 AMENDMENT TO URBAN RENEWAL
PLAN FOR FAIRFAX URBAN RENEWAL AREA. Ayes: Otto, Daly, Pacha, Volk and
Wainwright. Nays: None. Motioned carried. Mayor Frieden declared RESOLUTION 2020-71
duly adopted.
The clerk reviewed information about future projects and bonding.
The clerk discussed two quotes for a sound system and camera system for city hall.
Motioned by Otto, seconded by Wainwright to leave the community room closed to renters
in September. Ayes: Otto, Volk,and Wainwright. Nays: Daly and Pacha. Motion carried.
Motioned by Otto, seconded by Daly to approve RESOLUTION NO. 2020-72,A
RESOLUTION REQUESTING REIMBURSEMENT FROM THE IOWA COVID-19
GOVERNMENT RELIEF FUND. Ayes: Otto, Daly, Pacha,Volk,and Wainwright. Nays:
None. Motion carried.
The clerk discussed the use of dumpsters from Republic Services in City Hall parking lot.
These are to be used for building materials ONLY at this time. At a later date we will use them
for other items (Amnesty Day items). Mayor Frieden has hired Brian Beatty to help with clean
up from the storm. Marianne Wainwright stated no individual burning to be allowed.
Motioned by Otto, seconded by Daly to approve the claims list dated August 18, 2020.
Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Mayor, Bernie Frieden commented on how hard our employees are working due to the storm
and covid. Everyone is doing a phenomenal job.
The city clerk stated she has been cross training Tina the past few weeks.
Motioned by Pacha, seconded by Volk to adjourn the meeting. Ayes: Otto,Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion carried.
Mayor Frieden adjourned the meeting at approximately 7:26 PM.
