REGULAR CITY COUNCIL MEETING
February 9, 2021
A regular meeting of the Fairfax City Council was held February 9, 2021. In order to help
stop the spread of the COVID-19 virus, this regular meeting of the Fairfax City Council was held
electronically. Chapter 21.8 of the Iowa Code does permit an electronic meeting where all
members participate remotely when an in-person meeting is impossible or impractical, which is
certainly true during this crisis. On March 19, 2020, Governor Reynolds issued a Proclamation
of Disaster Emergency which included a suspension of Iowa laws that would prevent the use of
electronic meetings or the limitation on the number of people present at an in-person meeting
site. Therefore, only Mayor Frieden, City Clerk/Treasurer Cynthia Stimson, and Office
Administrator Tina Rosekrans were present at Fairfax City Hall at 300 80th Street Court. The
agenda had this message posted more than 24 hours in advance to give instructions on how
others could participate in the meeting: Due to the COVID-19 crisis, the City of Fairfax will be
holding this regular city council meeting electronically via a conference call. If you would like
to participate,just before the meeting start time, you must call 425-436-6370 and enter this
access code: 759797. Only staff are allowed in City Hall.
Mayor Frieden called the meeting to order at 6:00 PM. Councilmembers present on the
telephone conference call were: Mike Daly, Kate Pacha, Nick Volk and Marianne Wainwright.
Travis Otto was absent.
Motioned by Pacha, seconded by Wainwright to approve the consent agenda. Ayes: Daly,
Pacha, Volk, and Wainwright. Nays: None. Absent: Otto.
Cathy Bayne reported the library plans to add some hours and have been busy with the food
pantry.
Mike Sankot reported operations at the fire department have been normal.
Chris Philipp reviewed his Building Department Report- discussing a dog notice,parking,
and the P&Z.
Lynn Miller reported that they have been busy with snow related tasks.
Kevin Stensland is working on paperwork for Linn County Public Health Department about
our generators and is working with a resident about water issues.
Joe Kell reviewed his Parks and Recreation Department Report discussing - applications for
the summer help,planning summer sports, Music in the Park, the Dog Park IDs, and getting
people back into our park facilities.
Mayor Frieden opened the public hearing regarding entering into a lease with the Union
Pacific Railroad at 6:11 PM. No comments had been received and none were made. Mayor
Frieden closed the public hearing at 6:12 PM.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2021-13,A
RESOLUTION ENTERING INTO A LEASE AGREEMENT WITH UNION PACIFIC
RAILROAD. Roll call vote: Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent:
Otto. Motion carried. Mayor Frieden declared RESOLUTION 2021-13 duly adopted.
Mayor Frieden opened the public hearing regarding the Max Levy for the FY22 Budget at
6:13 PM. The city clerk/treasurer explained the notice. Marianne Wainwright asked about the
ability to change the levy if needed. Mayor Frieden closed the public hearing at 6:17 PM.
Motioned by Volk, seconded by Daly to approve RESOLUTION NO. 2021-14,A
RESOLUTION APPROVING THE MAXIMUM TAX DOLLARS FROM CERTAIN
LEVIES FOR THE CITY'S PROPOSED FISCAL YEAR 2021-2022 BUDGET. Roll call
vote: Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried.
Mayor Frieden declared RESOLUTION 2021-14 duly adopted.
Mike Sankot reviewed quotes for tires for three fire trucks.
Motioned by Pacha, seconded by Daly to approve the Pomp's Tire Service, Inc. quote of
$3,222.94 per truck, for a total of$9,668.82 for three trucks. Ayes: Daly, Pacha, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried.
Discussion was held concerning the traffic study that was done for the Travero site. A future
151 turn lane will be needed. The traffic study will need to be updated at that time.

RESOLUTION APPROVING THE DEVELOPMENT AGREEMENT FOR THE
DEVELOPMENT BY LOGISTICS PARK CEDAR RAPIDS, LLC IN PART OF THE
SOUTH HALF OF THE NORTHWEST QUARTER OF SECTION 15, & THE NORTH
HALF OF THE SOUTHWEST QUARTER OF SECTION 15, ALL IN TOWNSHIP 82
NORTH, RANGE 8 WEST OF THE 5TH P.M.,IN THE CITY OF FAIRFAX, LINN
COUNTY, IOWA. Roll call vote: Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None.
Absent: Otto. Motion carried. Mayor Frieden declared RESOLUTION 2021-15 duly adopted.
Mayor Frieden opened the public hearing concerning the 2021 Sanitary Sewer and Water
Main Extension Project at 6:23 PM. Shane Wicks and Jon Larson discussed the project.
Marianne Wainwright asked about the disincentives and replacing driveways. Mayor Frieden
closed the public hearing at 6:29 PM.
Extensive discussion was held regarding the proposed signs for the Travero site. Another
revision was suggested and will be reviewed during the March 9 meeting.
Shane Wicks discussed the water main issues at the Travero site.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2021-16,A
RESOLUTION APPROVING THE PRIVATE WATER MAIN FACILITIES & WATER
MAIN FACILITIES EASEMENT AGREEMENT FOR THE DEVELOPMENT BY
LOGISTICS PARK CEDAR RAPIDS, LLC IN PART OF THE SOUTH HALF OF THE
NORTHWEST QUARTER OF SECTION 15, & THE NORTH HALF OF THE
SOUTHWEST QUARTER OF SECTION 15,ALL IN TOWNSHIP 82 NORTH, RANGE 8
WEST OF THE 5TH P.M., IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll
call vote: Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent: Otto. Motion
carried. Mayor Frieden declared RESOLUTION 2021-16 duly adopted.
Chris Philipp asked if the City Council wants to continue free permits for Derecho repairs.
They said yes since many residents have had trouble getting contractors or getting their insurance
claims settled. The only free permits are to be for actual storm repairs, not improvements.
We still need more information concerning 267 Vanderbilt Street. If the City purchases this
property, we will look into grants for the demo costs.
We still need more information concerning 409 Vanderbilt Street. The Library Board may
go view the building. The City will need to have the library building appraised if the City
decides to move the library to another building.
Discussion was held concerning parking on 2nd Street.
Motioned by Wainwright, seconded by Volk to approve the first reading of ORDINANCE
48, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017,
OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 69-PARKING
REGULATIONS. Roll call vote: Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None.
Absent: Otto. Motion carried.
Staff was directed to send out a notice to the residents in the area to make them aware of this
possible no parking area change.
Chris Philipp discussed the proposed ordinance to amend the National Electrical Code. He
stated this change was suggested by his class instructor. Chris had asked Fire Chief Mike Sankot
about this change and Mike agreed with the proposal.
Motioned by Wainwright, seconded by Pacha to approve the first reading of ORDINANCE
49, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017,
OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 156 NATIONAL
ELECTRICAL CODE. Roll call vote: Ayes: Daly and Pacha. Nays: Volk and Wainwright.
Absent: Otto. Motion defeated.
Discussion was held concerning the speed limit on Fairfax Road along the Travero site. Staff
is suggesting a change to 35 miles an hour. This will be the speed limit during construction due
to IDOT regulations when there is work within 15 feet of the roadside. Mayor Frieden stated
that if the City changes the speed limit here, Linn County will also need to take action as half of
the street is not in Fairfax. No change will be made at this time.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2021-17,A
RESOLUTION SETTING THE TIME AND PLACE FOR A PUBLIC HEARING FOR
THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON
ADOPTING A REVISED ZONING MAP. Roll call vote: Ayes: Daly, Pacha, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Frieden declared
RESOLUTION 2021-17 duly adopted.
The lease and purchase options for the city hall building area were discussed. The City
Council feels it is better to purchase just the city hall building, while re-arranging the lot lines.
More information will be brought to the next meeting.
A brief discussion was held about community room rentals. The room will stay open for
rentals at this time.
Discussion was held about city council meeting format. Going forward we will have these
meetings in person, with social distancing. Elected officials, staff, and those on the agenda will
be assigned seats. The general public will have the remaining seats or can participate via the
conference phone call. Masks will be required in city hall.
Quotes for street maintenance work were reviewed.
Motioned by Volk, seconded by Pacha to accept the quote from Prairie Road Builders for
2021 street maintenance services. Ayes: Daly, Pacha, and Volk. Nays: None. Absent: Otto.
Abstain: Wainwright. Marianne Wainwright abstained because she works for one of the
companies that submitted a quote. Motion carried.
Quote for street sweeping were reviewed.
Motioned by Daly, seconded by Pacha to accept the quote from Kluesner Construction, Inc
for 2021 street sweeping services at$128.00 per hour. Ayes: Daly, Pacha, and Volk. Nays:
None. Absent: Otto. Abstain: Wainwright. Marianne Wainwright abstained because she
works for one of the companies that submitted a quote. Motion carried.
Lynn Miller discussed the quotes for a new mower. He is recommending the Toro from
Wade's.
Motioned by Volk, seconded by Pacha to accept the quote of$8,400.00 with a trade-in of our
old mower from Wade's for a Toro 6000 Series mower as specified in the quote. Ayes: Daly,
Pacha, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried.
Kevin Stensland stated that there is a Kirkwood intern who would like to do their internship
with Fairfax this summer. Kevin is recommending we do this again.
Motioned by Daly, seconded by Pacha to approve hiring a 2021 summer intern from
Kirkwood for water and sewer systems at minimum wage. Ayes: Daly, Pacha, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried.
Discussion was held concerning the proposed resolution with the employee compensation
changes the Library Board has approved. The city clerk/treasurer informed the City Council that
the Library Board has authority over the library employees' compensation. The resolution is to
give staff authority to write the checks.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2021-18, A
RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES. Roll call vote: Ayes:
Pacha, Volk, and Wainwright. Nays: Daly. Absent: Otto. Motion carried. Mayor Frieden
declared RESOLUTION 2021-18 duly adopted.
Jon Larson discussed the Kleiman Pay App 410.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2021-19,A
RESOLUTION TO APPROVE PAY APPLICATION NO. 10 FROM KLEIMAN
CONSTRUCTION, INC. FOR THE 2020 PUMP HOUSE AND SITE IMPROVEMENTS
PROJECT. Roll call vote: Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent:
Otto. Motion carried. Mayor Frieden declared RESOLUTION 2021-19 duly adopted.
Jon Larson discussed the Preload Pay App 410. The next one should be the final one.
Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2021-20,A
RESOLUTION TO APPROVE PAY APPLICATION NO. 10 FROM PRELOAD, LLC
FOR THE 2020 AT-GRADE WATER STORAGE TANK IMPROVEMENTS PROJECT.
Roll call vote: Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent: Otto. Motion
carried. Mayor Frieden declared RESOLUTION 2021-20 duly adopted.
Shane Wicks discussed the 2021 Prairie Avenue Re-Construction Project. The engineer's
estimate of probable cost is $420,000.

RESOLUTION TO FILE THE PLANS & SPECIFICATIONS AND OPINION OF
PROBABLE COST FOR THE CONSTRUCTION OF THE PRAIRIE AVENUE
PAVEMENT RECONSTRUCTION PROJECT. Roll call vote: Ayes: Daly, Pacha, Volk,
and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Frieden declared
RESOLUTION 2021-21 duly adopted.

The plans for the 2021 Fairfax Complex Parking Lot Improvements Project were reviewed.
Drainage was discussed. The engineer's estimate of probable cost is $260,000.

RESOLUTION TO FILE THE PLANS & SPECIFICATIONS AND OPINION OF
PROBABLE COST FOR THE CONSTRUCTION OF THE 2021 COMPLEX PARKING
LOT IMPROVEMENT PROJECT. Roll call vote: Ayes: Daly, Pacha, Volk, and
Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Frieden declared
RESOLUTION 2021-23 duly adopted.

declared RESOLUTION 2021-24 duly adopted.
Joe Kell discussed the spraying quotes. He is recommending the City accept the quote from
CRL Lawn Care.
Motioned by Daly, seconded by Pacha to accept the quote of$23,900.00 if paid by April 1,
2021, from CRL Lawn Care. Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent:
Otto. Motion carried.
Discussion was held concerning dust control. The City does not currently have any
regulations about dust control on private property. Hall and Hall Engineers, Inc., is
recommending approval of the Site Lighting Plan, site Development Plan of Improvements, and
the Drainage Report for 76 Williams Blvd., with conditions as noted in their recommendation
and in the resolution.

RESOLUTION APPROVING THE SITE PLAN OF IMPROVEMENTS, DRAINAGE
REPORT, AND THE SITE LIGHTING PLAN FOR THE PROPOSED
IMPROVEMENTS AT 76 WILLIAMS BLVD. IN THE CITY OF FAIRFAX, LINN
COUNTY, IOWA. Roll call vote: Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None.
Absent: Otto. Motion carried. Mayor Frieden declared RESOLUTION 2021-25 duly adopted.
Revised CIP lists were reviewed. Three items on the 1-year list, not currently budgeted, will
be added to the FY22 budget, using existing bond funds.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2021-26, A
RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE
PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S
PROPOSED FISCAL YEAR 2021-2022 BUDGET. Roll call vote: Ayes: Daly, Pacha, Volk,
and Wainwright. Nays: None. Absent: Otto. Motion carried. Mayor Frieden declared
RESOLUTION 2021-26 duly adopted.
Cynthia Stimson discussed the proposed FY22 budget. Some of the park projects will be
moved to the LOST Fund to help the General Fund's projected ending balance. The city hall
costs (leasing or purchasing) will still come out of the LOST Fund.
Motioned by Pacha, seconded by Daly to approve the claims list dated February 9, 2021.
Ayes: Daly, Pacha, Volk, and Wainwright. Nays: None. Absent: Otto. Motion carried.
Mayor Frieden informed the City Council that Mike Rammelsberg has given his two-week's
notice. He asked for volunteers to serve on a hiring committee. Kate Pacha volunteered.
The city clerk/treasurer apologized for getting the budget spreadsheets in the packet late. She
missed two days of work last week due to the weather. The audit is completed and we are to
have the report before the March 31, 2021 deadline.

Wainwright. Nays: None. Absent: Otto. Motion carried.
