HomeMy WebLinkAbout03-09-2021 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING March 9, 2021 A regular meeting of the Fairfax City Council was held March 9, 2021. Due to COVID-19, this meeting was held with social distancing. Elected officials, staff, and those on the agenda were admitted first with assigned tables. Masks were required. This message was posted on the agenda: If you would like to participate via a conference call, at least 10 minutes before the meeting start time, you must call 425-436-6370 and enter this access code: 759797. Mayor Frieden called the meeting to order at 6:00 PM. Council members present were: Travis Otto, Mike Daly, Kate Pacha, Nick Volk and Marianne Wainwright. Motioned by Wainwright, seconded by Otto to approve the consent agenda. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Linn County Deputy Sheriff presented the list of calls. He mentioned he found someone doing donuts in the grass on park ground. Staff will check for damage. Darrell Walters, with Signal 88, discussed skateboarders riding on the splash pad. Cathy Bayne asked City Council to review her Library Report in the packet. Mike Sankot reported there was a fire on Sunflower and the fire department will not be doing fireworks this year. Chris Philipp reviewed his report. The Vanderbilt Street issue may end up at the attorney. The dog owner has been served. Lynn Miller reported the maintenance department has been working on finishing the Derecho clean-up and repairs. The shop addition has been started. Kevin Stensland stated that they did not have ice in the water tower this winter. He reviewed graphs showing water usage and water loss. Fairfax's loss average is lower than the national average. Joe Kell stated there have been many sports sign-ups, the hiring process is going great, training has begun, he is hoping to have water to the dog park soon, and is working on getting more people to the dog park. The Easter Egg Dash is March 27. Mayor Frieden opened the public hearing regarding a revised official Zoning Map at 6:27 PM. No comments had been received by the city clerk's office. No one wanted to make comments now. Mayor Frieden closed the hearing at 6:28 PM. Motioned by Pacha, seconded by Daly to introduce and approve the first reading of ORDINANCE 51, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADOPTING A NEW, REVISED OFFICIAL ZONING MAP. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Pacha to suspend the rules requiring an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 51. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Pacha to give final adoption to ORDINANCE 51, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADOPTING A NEW, REVISED OFFICIAL ZONING MAP. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden opened the public hearing regarding the FY22 Budget at 6:29 PM. No comments had been received by the city clerk's office. The city clerk/treasurer reviewed some budget highlights. Mayor Frieden closed the hearing at 6:32 PM. Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2021-28, A RESOLUTION APPROVING CITY OF FAIRFAX'S ANNUAL BUDGET FOR FISCAL YEAR 2021-2022. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-28 duly adopted. Mayor Frieden opened the public hearing regarding the 2021 Prairie Avenue Re- Construction Project at 6:33 PM. No comments had been received by the city clerk's office. Discussion was held about concrete verses asphalt and timing of street closures. Mayor Frieden closed the hearing at 6:44 PM. The bids received were discussed. Hall and Hall Engineers, Inc. is recommending accepting the bid from Eastern Iowa Excavating for $373,087.50. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2021-29,A RESOLUTION FOR THE AWARD OF THE PRAIRIE AVENUE PAVEMENT RECONSTRUCTION PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-29 duly adopted. Mayor Frieden opened the public hearing regarding the 2021 Fairfax Complex Parking Lot Improvements Project at 6:45 PM. No comments had been received by the city clerk's office. Discussion was held about timing of work. Mayor Frieden closed the hearing at 6:46 PM. The bids received were discussed. Hall and Hall Engineers, Inc. is recommending accepting the bid from Dave Schmitt Construction Co. for $222,265.00 which includes the base bid plus the alternate. Motioned by Wainwright, seconded by Otto to approve RESOLUTION NO. 2021-30, A RESOLUTION FOR THE AWARD OF THE 2021 FAIRFAX COMPLEX PARKING LOT IMPROVEMENTS PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-30 duly adopted. Discussion was held regarding the new sign designs from Travero. Motioned by Otto, seconded by Volk to approve the Commercial Sign Permit Application from Travero, using the newly submitted sign designs. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Charlie Garwood, with Wilson-Hite Insurance, reviewed the insurance renewal amounts. Property added, workers comp modification rate, the Derecho, and vehicles added all contributed to the increase. Motioned by Volk, seconded by Daly to approve RESOLUTION NO. 2021-31,A RESOLUTION AUTHORIZING COMMERCIAL INSURANCE COVERAGE FOR THE CITY OF FAIRFAX. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-31 duly adopted. Judith Heisler, 7201 Williams Blvd., asked the City Council to allow her to opt out of the City's single-family residential solid waste collection system. She stated she takes her garbage elsewhere. Melody Vance stated her mother will not be able to put the carts at the end of her drive in the winter. The City Council asked about the process and amount owed. It was the consensus that she will be required to participate like other single-family residences. Ed Faber and JoAnn Beer gave a presentation about the Fairfax Visioning Committee Report. Signage, trails, and street improvements were discussed. Discussion was held about the proposed ordinance to make one side of Second Street no parking. Many residents responded with their input. No further action was taken on this proposed ordinance. At the next meeting, staff will present an ordinance to allow some parking on Ridgeview Drive. Motioned by Wainwright, seconded by Volk to introduce and approve the first reading of ORDINANCE 52, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 106, COLLECTION OF SOLID WASTE. Chris Philipp briefly discussed the proposed commercial buildings at 76 Williams Blvd., this is where Ornamental Concrete was located. They are being built by Eastern Iowa Building, Inc. Motioned by Daly, seconded by Volk to approve the Commercial Building Application from E. A. Investments Properties, LLC/MECO, LLC for building 41 at 76 Williams Blvd. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Daly, seconded by Pacha to approve the Commercial Building Application from E. A. Investments Properties, LLC/MECO, LLC for building 42 at 76 Williams Blvd. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Chris Philipp discussed the building plan for 70 Williams Blvd. This replaces a building destroyed during the Derecho. They were given a variance; they will be using the same concrete. Motioned by Volk, seconded by Pacha to approve the Commercial Building Application from Michael and Deanna Heintz for 70 Williams Blvd. Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Abstain: Wainwright. Marianne Wainwright abstained because the property is owned by family. Motion carried. Motioned Volk, seconded by Otto to approve the Commercial Sign Permit Application from Casey's at 65 Williams Blvd. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Volk, seconded by Pacha to approve RESOLUTION NO. 2021-33,A RESOLUTION ENTERING INTO A 28E AGREEMENT FOR BUILDING OFFICIAL INSPECTIONS WITH THE CITY OF ATKINS. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-33 duly adopted. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2021-34,A RESOLUTION SETTING A PUBLIC HEARING FOR THE VACATION OF A PORTION OF AN EXISTING 10' WIDE UTILITY EASEMENT LOCATED ALONG THE EASTERLY CORNER OF LOT 7, SCHUETZLE FIRST ADDITION TO FAIRFAX, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-34 duly adopted. Motioned by Wainwright, seconded by Daly to approve RESOLUTION NO. 2021-35, A RESOLUTION TO APPROVE PAY APPLICATION NO. 11 FROM KLEIMAN CONSTRUCTION, INC. FOR THE 2020 PUMP HOUSE AND SITE IMPROVEMENTS PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-35 duly adopted. Motioned by Otto, seconded by Daly to approve RESOLUTION NO. 2021-36,A RESOLUTION APPROVING THE CONTRACT FOR LAW ENFORCEMENT SERVICE WITH LINN COUNTY AND THE LINN COUNTY SHERIFF'S DEPARTMENT FOR FISCAL YEAR 2021-2022 BUDGET. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-36 duly adopted. Motioned by Daly, seconded by Pacha to donate $500.00 to the Linn County Freedom Rock project. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Joe Kell explained that he has received a request from the Men's 16" Tournament to allow them to bring in a beer vendor truck to sell beer during their tournament. The City Council does not want to allow this activity. Joe Kell reviewed the hiring process for the part-time park employees. He has started training. Tracking duties was discussed. Motioned by Wainwright, seconded by Otto to approve RESOLUTION NO. 2021-37, A RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-37 duly adopted. Joe Kell discussed the Dog Park Fees list. Motioned by Wainwright, seconded by Otto to approve RESOLUTION NO. 2021-38, A RESOLUTION ESTABLISHING THE PROCESS AND FEES ASSOCIATED WITH THE FAIRFAX OFF-LEASH DOG PARK. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021- 38 duly adopted. Lynn Miller reviewed the library roofing and windows quotes. No action will be taken concerning the windows. Motioned by Wainwright, seconded by Daly to accept the library roofing quote of $21,300.00 from DeNeve Construction, Inc. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Discussion was held regarding certification raise schedule for the Parks and Recreation Director. No action was taken. Cynthia Stimson discussed changes made to the job descriptions to require two years of working with the City of Fairfax after a certification or reimbursement for education costs will be required. Motioned by Wainwright, seconded by Pacha to approve RESOLUTION NO. 2021-39, A RESOLUTION TO APPROVE THE PERSONNEL POLICY MANUAL AND JOB DESCRIPTIONS. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-39 duly adopted. Motioned by Wainwright, seconded by Daly to approve RESOLUTION NO. 2021-40, A RESOLUTION APPROVING PURCHASE OF REAL ESTATE LEGALLY DESCRIBED AS LOT 97, HEARTLAND HEIGHTS FIRST ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-40 duly adopted. No update was available about 409 Vanderbilt Street. The Library Board will tour the building on Friday. Bond repayment schedules and the action schedule were reviewed. The City will use the 15- year repayment plan and discuss if we should remove the $100,000. Currently the owner of 267 Vanderbilt Street does not want to sell the property. It was stated that staff is working with the property owners of the city hall property and our attorney to draft a purchase agreement. Motioned by Volk, seconded by Wainwright to approve RESOLUTION NO. 2021-41, A RESOLUTION SETTING DATE FOR PUBLIC HEARING ON 2021 AMENDMENT TO URBAN RENEWAL PLAN FOR FAIRFAX URBAN RENEWAL AREA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-41 duly adopted. Motioned by Daly, seconded by Wainwright to have the City of Fairfax sponsor the City- Wide Garage Sale Day on May 15, 2021. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Volk, seconded by Pacha to have the City of Fairfax sponsor a City-Wide Clean-up Day in June of 2021. The exact date and location are to be determined. Motioned by Volk, seconded by Pacha to have the paperwork drafted to enter into a 3-year lease for a new mini-excavator as recommended by the maintenance department. Motioned by Pacha, seconded by Daly to have the paperwork drafted to enter into a 3-year lease for a new skid loader as recommended by the maintenance department. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. JoAnn Beer reviewed several topics with the City Council. Nick Volk asked about the status of the burned apartment building. They have been given a 90-day notice for a dangerous building. Motioned by Daly, seconded by Pacha to adjourn the meeting. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
