HomeMy WebLinkAbout04-13-2021 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING April 13, 2021 A regular meeting of the Fairfax City Council was held April 13, 2021. Due to COVID-19, this meeting was held with social distancing. Elected officials, staff, and those on the agenda were admitted first with assigned tables. Masks were required. This message was posted on the agenda: If you would like to participate via a conference call, at least 10 minutes before the meeting start time, you must call 425-436-6370 and enter this access code: 759797. If you are having difficulty connecting to the meeting you can: 1. Send a text message to the conference dial-in number. Text"Help" to receive a text message with a temporary backup number. Mayor Frieden called the meeting to order at 6:00 PM. Council members present were: Mike Daly, Kate Pacha, Nick Volk and Marianne Wainwright. Travis Otto was on the conference call. Motioned by Daly, seconded by Pacha to approve the consent agenda. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. The report from the Linn County Deputy Sheriff's department was in the packet. Marianne Wainwright stated that the civil items should not be listed on our municipal hours. Darrell Walters, with Signal 88, asked if anyone had questions. None were asked. Cathy Bayne state the Fairfax Public Library is back to normal hours and asked the Council to review her Library Report in the packet. Brian Merta reported the fire department has had 60 calls this year, they are back to in-person training, and they should receive their side-by-side next month. Chris Philipp reviewed his Building Department report. Kate Pacha asked about the status of the burned apartment building. The owner has sent notices he wants to start demolition soon. Lynn Miller reported the maintenance department has been working on finishing the Derecho clean-up, EIB has made repairs, the stumps are to be ground this week, and the flag poles are in. He reported that the City has received two tree grants. One is for $10,000 and the other for $3,200. Some of the trees are already planted. We will hold an event later for grant recognition. Kevin Stensland reported they have a valve installed in the water tower, the IDNR will be evaluating Well 42, and they will be flushing after the tower comes back online. Joe Kell reviewed his Parks and Recreation Department report. He has been working on registrations and getting ready for a busy season. The Pooch Parties start April 14 and an opening ceremony for the splash pad will be held May 29. Mayor Frieden read the Monarch Proclamation. Mayor Frieden opened the public hearing regarding amending the Fairfax Urban Renewal Plan at 6:15 PM. City hall had received a letter from JoAnn Beer, which was included in the packet. JoAnn Beer asked questions about including the purchase of one of the properties. Mayor Frieden closed the public hearing at 6:22 PM. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2021-42,A RESOLUTION TO APPROVE 2021 URBAN RENEWAL PLAN AMENDMENT FOR THE FAIRFAX URBAN RENEWAL AREA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021- 42 duly adopted. Mayor Frieden opened the public hearing regarding vacation of an easement at Lot 7 Schuetzle First Addition at 6:23 PM. No comments were received or made. Mayor Frieden closed the public hearing at 6:24 PM. Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2021-43, A RESOLUTION APPROVING THE VACATION OF A PORTION OF THE 10' WIDE UTILITY EASEMENT LOCATED ALONG THE EASTERLY CORNER OF LOT 7, SCHUETZLE FIRST ADDITION TO FAIRFAX, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-43 duly adopted. Randy Kremer and Craig Kluesner discussed the street work from 2020. They offered to re- do some areas for a discounted price of$1.00 a square yard in 2021. Motioned by Daly, seconded by Pacha to approve their quote of$1.00 a square yard for the areas that need to be re-done from 2020. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2021-44, A RESOLUTION APPROVING A PUBLIC UTILITY EASEMENT ALONG THE EASTERLY CORNER OF LOT 7, SCHUETZLE FIRST ADDITION TO FAIRFAX, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-44 duly adopted. Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2021-45, A RESOLUTION APPROVING A SANITARY SEWER FACILITIES EASEMENT IN THE EASTERLY CORNER OF LOT 7, SCHUETZLE FIRST ADDITION TO FAIRFAX, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-45 duly adopted. Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2021-46, A RESOLUTION APPROVING A WATER MAIN FACILITIES EASEMENT ON PROPERTY OWNED BY ITC MIDWEST LLC, LOCATED IN THE S.W. 1/40F THE N.W. 1/40F SECTION 15, TOWNSHIP 82 NORTH, RANGE 8 WEST OF THE FIFTH P.M. IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-46 duly adopted. Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2021-47, A RESOLUTION APPROVING SANITARY SEWER AND WATER MAIN FACILITIES EASEMENTS ALONG THE NORTH PROPERTY LINE AND THE SOUTHERLY PROPERTY LINE OF LOT 4, KURTZ'S FIRST ADDITION TO FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-47 duly adopted. Chris Philipp reviewed the proposed new no parking areas on Ridge View Drive. Motioned by Wainwright, seconded by Daly to introduce and approve the first reading of ORDINANCE 55, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 69-PARKING REGULATIONS. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Chris Philipp and Shane Wicks discussed the City's code requirement that all subdivisions will have city water and sewer. They asked the City Council to develop a policy of not accepting subdivision submittals without this requirement being met. They do not want the City to spend money and time to review a submittal that is not drafted according to the subdivision regulations. Motioned by Wainwright, seconded by Volk to table this discussion until the May meeting and delay the review of the submission on 50 Stallman Drive until after this discussion. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. FOR THE 2020 PUMP HOUSE AND SITE IMPROVEMENTS PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-51 duly adopted. Lynn Miller discussed the recommendation to hire two part-time seasonal employees. Motioned by Pacha, seconded by Volk to hire Dustin Ashmore and Jade Eiselstein as part- time seasonal maintenance department employees at$14.00 an hour. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden reviewed the recommendation to re-post the full-time Public Works I position. Motioned by Wainwright, seconded by Pacha to re-post the full-time Public Works I position locally for the required ten days and have a recommendation ready for the May meeting. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Kevin Stensland reviewed the recommendation to hire a Kirkwood intern for the water/sewer department. Motioned by Wainwright, seconded by Volk to hire Taylor Shelfo as a water/sewer intern from Kirkwood for 192 hours at$7.25 an hour. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motioned by Volk, seconded by Daly to approve RESOLUTION NO. 2021-53,A RESOLUTION SETTING TIME AND PLACE FOR AN APPEAL HEARING AT THE REQUEST OF JAY HOPKINS CONCERNING HIS NOTICE OF VIOLATION DATED MARCH 16, 2021. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-53 duly adopted. Motioned by Otto, seconded by Daly to approve RESOLUTION NO. 2021-54,A RESOLUTION TO FIX A DATE FOR A PUBLIC HEARING ON A LEASE-PURCHASE AGREEMENT IN A PRINCIPAL AMOUNT NOT EXCEEDING $85,350 FOR THE PURPOSE OF ACQUIRING AN EXCAVATOR. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-54 duly adopted. Motioned by Pacha, seconded by Otto to approve RESOLUTION NO. 2021-55,A RESOLUTION TO FIX A DATE FOR A PUBLIC HEARING ON A LEASE-PURCHASE AGREEMENT IN A PRINCIPAL AMOUNT NOT EXCEEDING $67,900 FOR THE PURPOSE OF ACQUIRING A SKID LOADER. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-55 duly adopted. Motioned by Otto, seconded by Wainwright to approve RESOLUTION NO. 2021-56, A RESOLUTION TO FIX A DATE FOR A PUBLIC HEARING ON GENERAL OBLIGATION URBAN RENEWAL MUNICIPAL BUILDINGS LOAN AGREEMENT IN AN AMOUNT NOT TO EXCEED $1,400,000. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-56 duly adopted. Motioned by Otto, seconded by Pacha to approve RESOLUTION NO. 2021-57,A RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF SOLICITING WRITTEN AND ORAL COMMENTS ON THE CITY'S PROPOSED AMENDMENT TO THE FISCAL YEAR 2020-2021 BUDGET. Shane Wicks discussed proposed plans to add more lights to our trails and determine how much power will be needed at The Complex. Linn County Deputy Sheriff entered at 7:38 PM. No one had any issues to discuss with him and the monthly report was in the packet. Motioned by Daly, seconded by Pacha to approve the claims list dated April 13, 2021. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. JoAnn Beer reviewed several topics with the City Council. Mayor Frieden informed the City Council that he and the city clerk/treasurer met with Ron Corbet from the Cedar Rapids Metro Economic Alliance. They will be organizing a campaign to support extending the Local Option Sales and Services Tax, which will be on the November ballot. The city clerk/treasurer let the City Council know that she has requested a quote for new iPads and reminded everyone that the FY20 Audit Report was in the packet and is on the website. Marianne Wainwright asked about the timing of the IDOT project and our Prairie Avenue project. Nick Volk asked if there was any update on the Census information. As far as we know, this information will not be released until September. Motioned by Daly, seconded by Pacha to adjourn the meeting. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None.
