CITY OF FAIRFAX
REGULAR CITY COUNCIL MEETING
September 14, 2021
A regular meeting of the Fairfax City Council was held September 14, 2021. Mayor Frieden
called the meeting to order at 6:00 PM. Council members present were: Mike Daly, Kate Pacha,
Nick Volk, and Marianne Wainwright. Travis Otto was on the conference call.
This meeting was held with social distancing and masks required due to the raise in the
COVID-19 cases in Linn County.
Motioned by Daly, seconded by Pacha to approve the consent agenda. Ayes: Otto, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried.
The Linn County Deputy’s report was reviewed.
Darrell Walters, with Signal 88, asked for any questions. He was thanked for helping with a
room rental problem.
Cathy Bayne reported the library building has gutter covers installed. They will be adding
some morning hours.
Brian Merta stated the fire department has been doing hose testing.
Chris Philipp reviewed his building department report. Travero has been issued a temporary
occupancy certificate.
Lynn Miller reported they have been getting projects completed before winter.
Kevin Stensland informed the City Council that he is interested in submitting a bid for lab
equipment from the City of Walford, flushing is done, wells are running about 10 hours a day,
and he is working through a valve problem.
Joe Kell reviewed his parks and recreation report. We had a Cub Scout rocket launch event
with over 80 rockets, a cigar appreciation event that raised funds for the Veterans’ Memorial,
and have a music event scheduled for September 18. He is working with a resident to have free
little libraries in the parks.
Maggie Burger, with Speer Financial, reviewed their annual TIF Report.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2021-101
A RESOLUTION TO APPROVE PLAT OF SURVEY NO. 2565. Roll call vote: Ayes:
Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden
declared RESOLUTION 2021-101 duly adopted.
Mayor Frieden opened the public hearing regarding Robert and Lois Boland’s rezoning
request at 6:27 PM. No comments had been received at city hall nor from anyone during the
meeting. Mayor Frieden closed the public hearing at 6:28 PM.
Motioned by Daly, seconded by Pacha to introduce and approve the first reading of
ORDINANCE 60, AN ORDINANCE AMENDING THE FAIRFAX ZONING
ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE
OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF
FAIRFAX, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried.
Motioned by Daly, seconded by Wainwright to suspend the rules requiring an ordinance be
voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE
60. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion
carried.
Motioned by Daly, seconded by Wainwright to approve final passage and adoption with
respect to ORDINANCE 60, AN ORDINANCE AMENDING THE FAIRFAX ZONING
ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE
OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF
FAIRFAX, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried.
Discussion was held regarding water usage at 328 Burger Lane. Two of their three bills have
been high. City staff viewed the meter not working properly.
Motioned by Daly, seconded by Pacha to adjust the two high bills to minimum bills, like the
other bill, for Tom Hansen at 328 Burger Lane, due to the fact we do not have confidence the
meter was working properly. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None.
Motion carried.
Motioned by Daly, seconded by Volk to approve the second reading of ORDINANCE 59,
AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF
THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP
AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA, BY
DESIGNATING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES, NOW
KNOWN AS: FROM C-2 HIGHWAY COMMERCIAL DISTRICT TO CN:
CONSERVATION/PUBLIC USE DISTRICT. Roll call vote: Ayes: Otto, Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Wainwright to suspend the rules requiring an ordinance be

OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF
FAIRFAX, IOWA, BY DESIGNATING THE ZONING CLASSIFICATION OF
CERTAIN PROPERTIES, NOW KNOWN AS: FROM C-2 HIGHWAY COMMERCIAL
DISTRICT TO CN: CONSERVATION/PUBLIC USE DISTRICT. Roll call vote: Ayes:
Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Otto, seconded by Daly to approve RESOLUTION NO. 2021-102
A RESOLUTION APPROVING THE PRELIMINARY PLAT FOR THE LEXI, ADDY &
PRESLEY’S ADDITION IN FAIRFAX, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION
2021-102 duly adopted.
Motioned by Pacha, seconded by Wainwright to approve the Commercial Sign Permit
th
Application from Regent Investment for 324 80 Street Court. Ayes: Otto, Daly, Pacha, Volk,
and Wainwright. Nays: None. Motion carried.
Joe Kell stated two people applied for the Parks and Beautification Board vacancy. The
Board and Joe are recommending appointing Phil Hartgrave.
Motioned by Wainwright, seconded by Otto to appoint Phil Hartgrave to the Parks and
Beautification Board to fill a vacancy. This term ends December 31, 2023. Ayes: Otto, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Joe Kell discussed the conceptual drawing of residents’ plans for the new park in Heartland
Heights.
Motioned by Wainwright, seconded by Volk to send this project to Hall and Hall Engineers
for design. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Lynn Miller reviewed quotes for a new maintenance department truck.
Motioned by Volk, seconded by Wainwright to approve the truck quote from McGrath Ford
of $41,636.00 for a 2022 Ford 550XL, with the City keeping the 1996 Chevy truck until we
receive the new truck then trading the 1996 in for $4,500 off this price quote. Also approving
the quote from Henderson Products, Inc. of $51,842.00 for the truck bed, sander, plow, and light
package. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Kevin Stensland and Lynn Miller discussed their dissatisfaction with the uniform company.
They are requesting the City stop the uniforms from Cintas and go with each employee having
work clothing purchased and then replaced or repaired with cost reimbursement up to $800 a
year per employee. The employee manual is to be revised and presented at the next meeting.
Lynn Miller reviewed the hiring committee’s process and recommendation to hire Dallas
Chandler at $20.00 an hour. Brandon Lefebure’s and Joe Kell’s hourly rates were reviewed in
light of this $20.00 an hour recommendation.
Motioned by Volk, seconded by Wainwright to approve hiring Dallas Chandler as a full-time
maintenance department employee for $20.00 an hour, pending a pre-employment drug test and
with the requirement that he receive the needed CDL within 90 days of hire. Ayes: Otto, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2021-103
A RESOLUTION APPROVING WAGES FOR CITY EMPLOYEES. Roll call vote: Ayes:
Otto, Daly, Volk, and Wainwright. Nays: None. Kate Pacha abstained because she is on the
fire department and their pay is listed in the resolution. Motion carried. Mayor Frieden declared
RESOLUTION 2021-103 duly adopted.

A RESOLUTION TO APPROVE PAY APPLICATION NO. 2 FROM DAVE SCHMITT
CONSTRUCTION CO. FOR THE 2021 FAIRFAX COMPLEX PARKING LOT
IMPROVEMENTS PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-104
duly adopted.

A RESOLUTION TO APPROVE PAY APPLICATION NO. 1 FROM EASTERN IOWA
EXCAVATING AND CONCRETE, LLC FOR THE PRAIRIE AVENUE PAVEMENT
RECONSTRUCTION PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-105
duly adopted.

A RESOLUTION TO APPROVE PAY APPLICATION NO. 5 FROM SCHRADER
EXCAVATING & GRADING CO. FOR THE 2021 SANITARY SEWER & WATER
MAIN EXTENSIONS PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-106
