Home My WebLink About10-12-2021 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING October 12, 2021 A regular meeting of the Fairfax City Council was held October 12, 2021. Mayor Frieden called the meeting to order at 6:00 PM. Council members present were: Mike Daly, Kate Pacha, and Nick Volk. Travis Otto was on the conference telephone. Marianne Wainwright was absent. This meeting was held with social distancing and masks required due to the raise in the COVID-19 cases in Linn County. Motioned by Daly, seconded by Pacha to approve the consent agenda. Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Darrell, with Signal 88, discussed vandalism at a parks restroom and a light that is not working in the area. Cathy Bayne stated the library will be hiring replacement staff and the windows are to be in next week. Mike Sankot reported the Lucas device is in service and the fire department members attended training at Kirkwood. Chris Philipp reviewed his building department report. Marianne Wainwright entered the meeting at 6:10 PM. Lynn Miller reported the maintenance department is getting ready for winter, they had a truck in for repairs, there was a storm sewer backup, and Musco worked on the park lights. He said the new employee, Dallas Chandler is awesome. Kevin Stensland stated the water and sewer systems are working well, but parts are getting hard to get. The water storage project should be complete soon. The lead and copper tests results were good. Joe Kell reviewed his parks and beautification report, highlighting upcoming events. Joe Horaney, from CR/LC Solid Waste Agency gave a presentation about their Forward 2044 Waste Planning Program. Mayor Frieden opened the public hearing regarding a revision to the Fairfax Zoning code at 6:26 PM. No comments have been received at city hall. No one wished to make any comments during the meeting. Mayor Frieden closed the public heating at 6:27 PM. Motioned by Wainwright, seconded by Daly to introduce and approve the first reading of ORDINANCE 61, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING CODE OF THE CITY OF FAIRFAX, IOWA, BY AMENDING PROVISIONS PERTAINING TO SUPPLEMENTARY DISTRICT REGULATIONS. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Wainwright, seconded by Pacha to suspend the rules requiring an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 61. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Wainwright, seconded by Volk to give final adoption to ORDINANCE 61, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING CODE OF THE CITY OF FAIRFAX, IOWA, BY AMENDING PROVISIONS PERTAINING TO SUPPLEMENTARY DISTRICT REGULATIONS. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2021-111 A RESOLUTION APPROVING THE SITE PLAN AND FINAL PLAT FOR STONEY MEADOW FARMS FIRST ADDITION TO LINN COUNTY, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-111 duly adopted. Motioned by Pacha, seconded by Volk to approve RESOLUTION NO. 2021-112 A RESOLUTION ACCEPTING THE PUBLIC WATER MAIN FACILITIES LOCATED ALONG THE SOUTH SIDE OF TRAVERO LOGISTICS PARK. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-112 duly adopted. Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2021-113 A RESOLUTION APPROVING THE PUBLIC WATER MAIN PLAN OF IMPROVEMENTS FOR THE LEXI, ADDY & PRESLEY’S ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-113 duly adopted. Discussion was held about the status of the Dollar General’s Commercial Building Permit Application. The City still needs documents concerning the development and final plat. Shane Wicks is working with their engineers to get needed documents, review these documents, and draft the development agreement. Discussion was held about the draft of a development agreement with BR5 Development, LLC. Staff will continue to work with the developer to see if they want this project moving forward. The Linn County Deputy Sheriff entered. He reported in the last month they had 47 calls and met their hour requirement. He briefly discussed fireworks enforcement. Marianne and Nick discussed their proposal of changes for fireworks in Fairfax. They th suggested making the time frame a week before the 4 of July (making sure the USA Days th weekend is included) and a week after (to include the weekend after the 4). They suggested December 30 – January 2 at New Years. Staff will draft an ordinance for review at the next meeting. Motioned by Wainwright, seconded by Pacha to approve RESOLUTION NO. 2021-114 A RESOLUTION TO APPROVE PAY APPLICATION NO. 3 FROM DAVE SCHMITT CONSTRUCTION CO. FOR THE 2021 FAIRFAX COMPLEX PARKING LOT IMPROVEMENTS PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-114 duly adopted. Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2021-115 A RESOLUTION TO APPROVE CHANGE ORDER NO. 1 FROM EASTERN IOWA EXCAVATING AND CONCRETE, LLC FOR THE PRAIRIE AVENUE PAVEMENT RECONSTRUCTION PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-115 duly adopted. Motioned by Wainwright, seconded by Pacha to approve RESOLUTION NO. 2021-116 A RESOLUTION TO APPROVE PAY APPLICATION NO. 2 FROM EASTERN IOWA EXCAVATING AND CONCRETE, LLC FOR THE PRAIRIE AVENUE PAVEMENT RECONSTRUCTION PROJECT. Mayor Frieden declared RESOLUTION 2021-117 duly adopted. Motioned by Wainwright, seconded by Daly to approve RESOLUTION NO. 2021-118 A RESOLUTION TO APPROVE CHANGE ORDER NO. 12 FROM KLEIMAN CONSTRUCTION FOR THE 2020 PUMP HOUSE & SITE IMPROVEMENTS PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-118 duly adopted. Motioned by Volk, seconded by Pacha to appoint Carmen Noska to the Fairfax Planning and Zoning Commission to fill a term that expires December 31, 2024. Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Chris Philipp discussed a sidewalk complaint about several addresses from a resident who fell while walking in Fairfax. The City Council directed Chris to send a repair sidewalk letter along with the code. Nick suggested the City look at our property and make any needed sidewalk or trail repairs. Cynthia Stimson reviewed the proposed changes to the Personnel Policy. Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2021-119 A RESOLUTION TO APPROVE THE PERSONNEL POLICY MANUAL. Roll call vote: Ayes: Otto, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2021-119 duly adopted. Motioned by Pacha, seconded by Volk to introduce and approve the first reading of ORDINANCE 62, AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FAIRFAX, IOWA, 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING PROVISIONS PERTAINING TO GENERAL TRAFFIC REGULATIONS.
