Home My WebLink About12-14-2021 Council Minutes CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING December 14, 2021 A regular meeting of the Fairfax City Council was held December 14, 2021. Mayor Frieden called the meeting to order at 6:00 PM. Councilmembers present were: Travis Otto, Mike Daly, and Kate Pacha. Nick Volk was on the conference phone. Marianne Wainwright was absent. Motioned by Pacha, seconded by Daly to approve the consent agenda, with the Legion’s liquor license renewal pending their dram insurance. Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. The Linn County Sheriff’s report is in the packet. Darrell Walters, with Signal 88, discussed vandalism at Prairie Creek Park and lights that need to be fixed. Cathy Bayne reported the library will have a new employee start on Friday, they have started Storytime again, and are busy with holiday activities. Mike Sankot reported the fire department has been busy. Chris Philipp reviewed the Building Department Report. He discussed the ruling in the packet and stated he has not been called for a final inspection of the garage involved in this court action. Lynn Miller reported the holiday decorations are up, they are waiting for a lift truck to repair lights, the street trees are trimmed, one truck is getting worked on, and they have been working on next year’s budget. Kevin Stensland informed the Council that the water storage tank has been drained and inspected, the booster station is close to completion, and the radium test results were good. Joe Kell reviewed the Parks and Recreation Department Report. Shane Wicks stated Hall and Hall Engineers, Inc. will have rate increases for 2022. This is the first increase since 2017. Cynthia Stimson and Christina Staton discussed the UHC employee benefits insurance policies renewal quotes. Motioned by Otto, seconded by Pacha to renew the UHC employee benefits policies with the change to a new short-term disability policy with the City still paying 100% of the premium for the full-time employees. Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Discussion was held about the status of required paperwork for the new liquor license for Chilango’s Mexican Restaurant, LLC. They have not shown the City a valid lease or warranty deed. This is required by state law. Motioned by Daly, seconded by Pacha to approve the new liquor license for Chilangos, Mexican Restaurant, LLC, pending receipt of a valid lease or warranty deed as required by the Iowa Alcoholic Beverages Division. Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden opened a public hearing at 6:28 regarding adopting a revised Fairfax Comprehensive Plan. No comments had been received by City Hall. Chris Philipp discussed the Fairfax Planning and Zoning Commission’s work on this plan. Joe Kell suggested some references for the Parks and Recreation Department. Mayor Frieden closed the public hearing at 6:31. Motioned by Pacha, seconded by Daly to introduce and approve the first reading of ORDINANCE NO. 65, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADOPTING A NEW, REVISED OFFICIAL COMPREHENSIVE PLAN with the changes discussed tonight. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Motioned by Daly, seconded by Pacha to suspend the rules requiring an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 65. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Motioned by Pacha, seconded by Daly to give final approval to ORDINANCE NO. 65, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY ADOPTING A NEW, REVISED OFFICIAL COMPREHENSIVE PLAN with the changes discussed tonight. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Many residents, staff, and elected officials gave their opinions about parking on Applewood. Convenience and safety were both concerns. It was suggested to make the ends by the intersections no parking, but allow parking on one side between these areas. Motioned by Daly, seconded by Pacha to introduce and approve the first reading of ORDINANCE NO. 66, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 69-PARKING REGULATIONS as revised tonight with no parking on Applewood to read as follows: 57. Applewood Drive the entire west side of the street and one hundred (100) feet from the intersection of Heartland Street and one hundred (100) feet from the intersection of Beverly Road on the east side of the street. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Motioned by Daly, seconded by Pacha to suspend the rules requiring an ordinance be voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE 66. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Motioned by Daly, seconded by Pacha to give final approval to ORDINANCE NO. 66, AN ORDINANCE AMENDING THE FAIRFAX CODE OF ORDINANCES OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING CHAPTER 69-PARKING REGULATIONS as revised tonight with no parking on Applewood to read as follows: 57. Jay Stewart had damage due to a storm sewer backup. The City’s insurance policy denied the claim. He had pictures in the packet. His hookup was discussed. The building code requirements will be checked. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2021-130, A RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF CONSIDERING A REZONING REQUEST FROM IOWA LOT DEVELOPMENT. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2021-130 duly adopted. Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2021-131, A RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE PURPOSE OF CONSIDERING A VOLUNTARY ANNEXATION REQUEST FROM FRANK BELLON AND NANCY AFRICA. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2021-131 duly adopted. Motioned by Daly, seconded by Pacha to waive the $50.00 annexation request fee due to the fact that Frank Bellon and Nancy Africa plan to donate this ground to the City of Fairfax. Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Motioned by Pacha, seconded by Otto to approve RESOLUTION NO. 2021-132, A RESOLUTION APPROVING THE SITE PLAN OF IMPROVEMENTS AND THE DRAINAGE REPORT FOR THE PROPOSED IMPROVEMENTS AT LOT 1 OF LEXI, ADDY & PRESLEY’S ADDITION IN THE CITY OF FAIRFAX, LINN COUNTY, IOWA. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2021-132 duly adopted. Chris Philipp briefly reviewed the Commercial Building Permit Application for 105 Williams Blvd. from Dollar General. Motioned by Pacha, seconded by Daly to approve the Commercial Building Permit Application for 105 Williams Blvd. from Dollar General. Ayes: Otto, Daly, and Pacha. Nays: Volk. Absent: Wainwright. Motion carried. Motioned by Daly, seconded by Pacha to appoint Jill Pressler to the Parks and Beautification Board for a term ending 12-31-2023. Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Joe Kell discussed minor changes to the agreement with FYSA for 2022. Motioned by Pacha, seconded by Otto to approve RESOLUTION NO. 2021-133, A RESOLUTION ENTERING INTO A PARTNERSHIP AGREEMENT WITH THE FAIRFAX YOUTH SPORTS ASSOCIATION. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2021-133 duly adopted. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2021-134, A RESOLUTION TO APPROVE PAY APPLICATION NO. 17 FROM KLEIMAN CONSTRUCTION, INC. FOR THE 2020 PUMP HOUSE AND SITE IMPROVEMENTS PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2021-134 duly adopted. Extensive discussion was held about closing out the Pump House and Site Improvements Project. There is a crack in the pump house. The general contractor attempted to repair this crack. The engineer says the crack is not structural. The City engineer feels the rebar does not go clear to the corner in this area. Motioned by Volk, seconded by Daly to approve RESOLUTION NO. 2021-135, A RESOLUTION TO ACCEPT THE WORK PERFORMED BY KLEIMAN CONSTRUCTION, INC., APPROVE THE BALANCING CHANGE ORDER, APPROVE THE FINAL PAY APPLICATION, AND ENTER INTO AN AGREEMENT WITH THE SEEDING CONTRACTOR TO COVER THE REMAINDER OF THE SEEDING WARRANTY PERIOD FOR THE 2020 PUMP HOUSE & SITE IMPROVEMENTS PROJECT. Roll call vote: Ayes: Daly and Volk. Nays: Otto and Pacha. Absent: Wainwright. Motion defeated. Mayor Frieden declared RESOLUTION 2021-135 defeated. Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2021-136, A RESOLUTION TO APPROVE PAY APPLICATION NO. 7 FROM SCHRADER EXCAVATING & GRADING CO. FOR THE 2021 SANITARY SEWER & WATER MAIN EXTENSIONS PROJECT. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2021- 136 duly adopted. Motioned by Otto, seconded by Volk to approve RESOLUTION NO. 2021-137, A RESOLUTION APPROVING THE PRIVATE UTILITY ON PUBLIC PROPERTY AGREEMENT BETWEEN TWIN OAKS LAKE CORP. AND THE CITY OF FAIRFAX. Roll call vote: Ayes: Otto, Pacha, and Volk. Nays: None. Abstain: Daly. Mike Daly abstained because he is a property owner of the Twin Oaks Lake Corporation. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2021-137 duly adopted. Motioned by Pacha, seconded by Daly to approve RESOLUTION NO. 2021-138, A RESOLUTION APPROVING THE PROJECT AGREEMENT BETWEEN LINN COUNTY AND THE CITY OF FAIRFAX. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2021-138 duly adopted. Discussion was held about city hall cleaning. The city clerk is to discuss options with Brianna. Shane Wicks reviewed the CIP spreadsheet. Some revisions were requested. Department heads reviewed their FY22 budget proposals. Discussion was held regarding an employee compensation proposal. Input was given by residents and staff. The Library Board has hired Jackie Stallman as a new employee and taken action on their employees’ compensation changes for 2022. Jackie is to start at $15.00 an hour as a library assistant. The other employees will each receive a $1.50 an hour as of January 1, 2022. These are the only changes in the proposed non-fire department compensation resolution. Motioned by Volk, seconded by Otto to approve RESOLUTION NO. 2021-139, A RESOLUTION APPROVING WAGES FOR NON-FIRE DEPARTMENT CITY EMPLOYEES. Roll call vote: Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Mayor Frieden declared RESOLUTION 2021-139 duly adopted. Motioned by Pacha, seconded by Daly to approve the claims list dated December 14, 2021. Ayes: Otto, Daly, Pacha, and Volk. Nays: None. Absent: Wainwright. Motion carried. Jo Ann Beer gave input about agenda topics. Mayor Frieden stated Fairfax had the largest turnout for the 2021 election and that he met with a current and a probable future Iowa representative for Fairfax. The city clerk/treasurer asked about the date for the special city council meeting concerning budget. Wednesday, January 19, at 6:00 was chosen. Mayor Frieden presented Travis Otto with a plaque for his service on the City Council and thanked him for his service. Mayor Frieden took the oath of office for mayor. Tom Nurre and Nick Volk took the oath of office for city council members. Motioned by Pacha, seconded by Daly to adjourn the meeting. Ayes: Otto, Daly, Pacha, and Volk. Nays: None.
