CITY OF FAIRFAX
REGULAR CITY COUNCIL MEETING
January 11, 2022
A regular meeting of the Fairfax City Council was held January 11, 2022. Mayor Frieden
called the meeting to order at 6:00 PM. Councilmembers present were: Tom Nurre, Mike Daly,
Kate Pacha, Nick Volk, and Marianne Wainwright.
Motioned by Pacha, seconded by Volk to approve the consent agenda. Ayes: Nurre, Daly,
Pacha, Volk, and Wainwright. Nays: None. Motion carried.
The Linn County Sheriff’s report is in the packet.
Darrell Walters, with Signal 88, the light has been fixed.
Cathy Bayne reported the library has purchased 13 new launchpads with donations.
Brian Merta reported the fire department has had several fires since the last meeting. They
are evaluating damage to some hose and equipment.
Chris Philipp reviewed the Building Department Report. The attorney is handling 331
Vanderbilt Street clean-up. Dollar General has started working on their building.
Lynn Miller reported some holiday decorations were damaged by the latest wind storm.
Dallas has his CDL. Jaden is working on his CDL. Brandon has passed his Grade 1 Water
Treatment and scheduled for more training. Prison Industries let the City know they will be
having a price increase later this month.
Kevin Stensland informed the Council some brick has been placed in the water building to
fix the problem. No work has begun. Hach informed the City they will be having a price
increase.
Joe Kell reviewed the Parks and Recreation Department Report. He has Arts & Crafts
classes planned as well as Activity Days in January, February, and March. They will be showing
a movie in February. He has started working on hiring the seasonal parks employees. Job
descriptions and a sports waiver are in the packet to review.
Jon Larsen, with Hall and Hall Engineers, Inc. stated he has talked to the Pump House
Project contractor. If they haven’t started the work by the end of the week, the City will look
into hiring a mason to finish the job.
Mayor Frieden opened a public hearing at 6:16 regarding a re-zoning request from Iowa Lot
Development. No comments had been received by City Hall or during the meeting. Mayor
Frieden closed the public hearing at 6:17.
Motioned by Wainwright, seconded by Pacha to introduce and approve the first reading of
ORDINANCE NO. 67, AN ORDINANCE AMENDING THE FAIRFAX ZONING
ORDINANCE OF 2017, OF THE CITY OF FAIRFAX, IOWA, BY AMENDING THE
OFFICIAL ZONING MAP AND ZONING DISTRICT BOUNDARIES OF THE CITY OF
FAIRFAX, IOWA. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried.
Motioned by Wainwright, seconded by Pacha to suspend the rules requiring an ordinance be
voted on for passage at two council meetings prior to this meeting with respect to ORDINANCE
67. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion
carried.
Motioned by Wainwright, seconded by Daly to give final approval to ORDINANCE NO.
67, AN ORDINANCE AMENDING THE FAIRFAX ZONING ORDINANCE OF 2017, OF
THE CITY OF FAIRFAX, IOWA, BY AMENDING THE OFFICIAL ZONING MAP
AND ZONING DISTRICT BOUNDARIES OF THE CITY OF FAIRFAX, IOWA. Roll
call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Mayor Frieden opened the public hearing regarding a voluntary annexation at 6:18 PM. One
email was received at City Hall and it is in the packet. No one at the meeting had any comments.
Mayor Frieden closed the public hearing at 6:19 PM.
Motioned by Daly, seconded by Pacha to approve RESOLUTION NO. 2022-01, A
RESOLUTION APPROVING THE VOLUNTARY ANNEXATION IN AN URBANIZED
AREA FOR PROPERTY LOCATED NORTH OF WEST SOUTHVIEW ROAD AND
WEST OF WILLIAMS BLVD/HIGHWAY 151. Roll call vote: Ayes: Nurre, Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared RESOLUTION
2022-01 duly adopted.
Discussion was held with Jay Stewart and Dan Zamastil about water back-up at Jay’s house.
He was instructed to turn a claim in to his insurance.
Motioned by Volk, seconded by Pacha to appoint Dan Gioimo to the Planning and Zoning
Commission for a term ending December 31, 2022. Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.
Motioned by Daly, seconded by Pacha to approve the Commercial Sign Permit application
for 105 Williams Blvd. for Dollar General. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright.
Nays: None. Motion carried.
Motioned by Daly, seconded by Volk to approve RESOLUTION NO. 2022-02, A
RESOLUTION APPROVING THE AMENDED DEVELOPMENT AGREEMENT FOR
HEARTLAND HEIGHTS FIRST ADDITION IN THE CITY OF FAIRFAX, LINN
COUNTY, IOWA. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried. Mayor Frieden declared RESOLUTION 2022-02 duly adopted.
Jon Larson, with Hall and Hall Engineers, Inc, went through the revised CIP list. Projects
were discussed. These will be reviewed during the budget meeting.
Motioned by Wainwright, seconded by Pacha to approve RESOLUTION NO. 2022-03, A
RESOLUTION TO ENTER INTO AN AGREEMENT WITH THE PUMP HOUSE
SEEDING SUBCONTRACTOR TO COVER THE REMAINDER OF THE SEEDING
WARRANTY PERIOD. Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright.
Nays: None. Motion carried. Mayor Frieden declared RESOLUTION 2022-03 duly adopted.
Motioned by Wainwright, seconded by Pacha to approve RESOLUTION NO. 2022-04, A
RESOLUTION TO ACCEPT THE WORK PERFORMED BY EASTERN IOWA
EXCAVATING & CONCRETE, LLC., APPROVE THE BALANCING CHANGE
ORDER, AND APPROVE THE FINAL PAY APPLICATION FOR THE PRAIRIE
AVENUE PAVEMENT RECONSTRUCTION PROJECT. Roll call vote: Ayes: Nurre,
Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor Frieden declared
RESOLUTION 2022-04 duly adopted.
Lynn Miller discussed the mower quotes to add another mower.
Motioned by Volk, seconded by Pacha to accept the quote from Wade’s for a Toro 6000
Series with the options listed on the quote for $14,821.76. Ayes: Nurre, Daly, Pacha, Volk, and
Wainwright. Nays: None. Motion carried.
Cynthia Stimson discussed cleaning at City Hall.
Motioned by Wainwright, seconded by Daly to accept the quote from Source One 1 Cleaning
Solutions for once weekly cleaning of Fairfax City Hall for $539.00 a month. Ayes: Nurre,
Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Wainwright, seconded by Nurre to approve RESOLUTION NO. 2022-05, A
RESOLUTION ADOPTING A POLICY FOR THE INVESTMENT OF PUBLIC FUNDS.
Roll call vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Mayor Frieden declared RESOLUTION 2022-05 duly adopted.
Mayor Frieden appointed Marianne Wainwright as the Mayor Pro Tempore.
Motioned by Daly, seconded by Nurre to appoint Cynthia Stimson the City Clerk/Treasurer.
Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Wainwright, seconded by Volk to appoint Mike Sankot the Fairfax Fire Chief
as elected by the Fairfax Fire and Rescue Department members. Ayes: Nurre, Daly, Pacha,
Volk, and Wainwright. Nays: None. Motion carried.
Motioned by Volk, seconded by Pacha to appoint Randy Scholar with Simmons Perrine
Moyer Bergman the City Attorney. Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays:
None. Motion carried.
Extensive discussion was held about employee compensation. Several residents spoke up
about the proposed increases. Comparisons, duties, and the current hiring environment were
discussed. The City Council discussed last year the non-library and non-fire department
employees were all just given a 50 cent an hour raise. The proposed fire department raise is to
be funded with CARES Act money and be in effect for the calls during 2021.
Motioned by Wainwright, seconded by Volk to approve RESOLUTION NO. 2022-06, A
RESOLUTION APPROVING WAGES FOR FIRE DEPARTMENT CITY EMPLOYEES.
Roll call vote: Ayes: Nurre, Daly, Volk, and Wainwright. Nays: None. Abstain: Pacha. Kate
Pacha abstained because she is a member of the Fairfax Fire and Rescue Department. Motion
carried. Mayor Frieden declared RESOLUTION 2022-06 duly adopted.
Motioned by Daly to give a $3.00 an hour raise to the full-time and $1.50 raise to the part-
time non-library and non-fire department employees effective January 1, 2022. Mike withdrew
his motion.
Motioned by Pacha to give a 7% cost of living raise plus $2.00 an hour raise to the full-time
non-library and non-fire department employees, with the 7% plus $1.50 an hour for the part-time
effective January 1, 2022. This motion died for lack of a second.
More discussion was held regarding the recent history of raises given, the cost of living, and
the hiring environment.
Motioned by Volk, seconded by Wainwright to approve a 7% cost of living raise plus a $1.00
an hour raise for all non-library and non-fire department employees with RESOLUTION NO.
2022-07, A RESOLUTION APPROVING WAGES FOR NON-FIRE DEPARTMENT
CITY EMPLOYEES. Roll call vote: Ayes: Nurre, Pacha, Volk, and Wainwright. Nays:
Daly. Motion carried. Mayor Frieden declared RESOLUTION 2022-07 duly adopted.
The city clerk/treasurer mentioned the increase in taxable valuation, which is over 11%. She
has drafted the Max Levy Hearing Notice for the same levy of $8.10. The City Council will be
holding a special budget meeting next Wednesday, January 19. She will call when the
spreadsheets are ready.
Motioned by Pacha, seconded by Nurre to approve RESOLUTION NO. 2022-08, A
RESOLUTION SETTING TIME AND PLACE FOR A PUBLIC HEARING FOR THE
PURPOSE OF CONSIDERING THE MAXIMUM TAX DOLLARS FROM CERTAIN
LEVIES FOR THE CITY’S PROPOSED FISCAL YEAR 2022-2023 BUDGET. Roll call
vote: Ayes: Nurre, Daly, Pacha, Volk, and Wainwright. Nays: None. Motion carried. Mayor
Frieden declared RESOLUTION 2022-08 duly adopted.
